Mr. Steve Allison, SW Katherine Street resident, expressed interest by a majority of the residents to have Plate II used so that the lots below the flood plain would not be included in the improvement. (c) After lengthy discussion, Legal Counsel stated that the plates could be changed since the boundaries of the improvement would remain the same. Motion seconded by Councilwoman Stimler. Approved by unanimous vote of Council. (e) John Skourtes and Mr. William Dieter requested they be notified when Council will consider. 20. NOISE MITIGATION - 99W TSM Project (a) Planning Director stated St. Anthony's School has requested something be done regarding the increased noise from Pacific Highway. This could be done with the TSM Project at an additional cost of $46,000 of which the City's share would be 15% or approximately $6,440. (b) Mr. Don Adams from Oregon Department of Transportation spoke regarding the ways to decrease the noise level inside the school and answered questions from Council and staff regarding decible levels and alternatives to help the school face this problem. (c) Consensus of Council was to direct staff to contact the school and see if there was still a desire on their part to pay the $6,440 for the project to be completed with the TSM project. This must be done quickly so as to allow the state to include this item in the letting of bids in September. 21. ORDINANCE No. 79-60 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 10.28, OF THE TIGARD MUNICIPAL CODE BY ADDING TO SECTION 10.28.130 TO PROHIBIT PARKING ON A PORTION OF SW GAARDE STREET, FROM SW PACIFIC 'HIGHWAY TO SW 112TH AVENUE,;,DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. (a) Chief of Police recommended approval due to traffic hazards.' (b) Motion by Councilman Cook, seconded by Councilwoman Stimler to approve. Approved by unanimous vote of Council. 22. APPROVE WASHINGTON COUNTY LIBRARY SERVICE CONTRACT - Authorize Signing by Mayor (a) Planning Director stated the contract had been rewritten to give the City more latitude in servicing the area and use of the funds. Planning Director recommended approval. (b) Motion by Councilwoman Stimler, seconded by Councilman Scheckla to,approve and authorize signing by the Mayor. Approved by unanimous vote of Council. 26. OTHER (a) Councilwoman Stimler requested staff investigate the problem on SW Walnut Street caused by cars lining up for the gas station and blocking driveways in the process. Planning Director stated he would investigate and eliminate the problem. (b) Councilman Brian questioned the effect Canterbury Woods would have as far as planning, if in 'fact, the buildings were determined to have three stories instead of two as required in the code. Staff assured Council that adequate information would be compiled for the August 7th Planning Commission hearing. (c) Planning Director noted that the Christian Bookstore on Main Street had re- quested Greyhound to use them as a stop in the Tigard area. Particular emphasis has been placed on the approval of the original P.D. and how this relates to what is currently being constructed. I would like to point out that the initial approval was , in fact, granted on a three-story concept (see site plan enclosed plus. 'writeen submittal material ) . These units , to be sure, were ;one, two and three-story units combined into one building. The cu rren-f—proposa`;i"s-'or a two story development. The new loft space addition was ;an afterthought proposed because of the amount of open (unusable space) evident once the trusses were set in place. Note that the addition takes advantage of the existing building configuration--it does not add to it. The change is an interior, not exterior alteration. Since the space is open to the living area it acts as a loft or ^ezzanine level . 0n page 45 of the Uniform Building Code the definition of mezza- nine `is listed as "an intermediate floor placed in any story or room If that area is less than 33 1/3% of the total of the r room it occupies it will not be considered a floor. x The proposal for Canterbury Woods is for a loft addition of 212 square feet and therefore could be considered a floor by - ' definition. This addition is allowed un ecTr Table 5-6,page 61 ni OFf the form Building Code which states that if the building is of a_n - aur construction , a three-story building is . permis sible'. Additional structural engineering with regard to three'- story structures i .e. , equivalent 3x4, studs at 16" o.c. -on L.r lower floor) will also be carried through by the Owner. There is no requirement which states that the height must be consistant with that of the underlying district in a P. D. This reference to underlying zones applies to lot coverage and lost size. The P. Q ldis.trict makes no mention of building height, and in fact in 18.56.060 TtheTCode is very specific, "In_ cases of conflict between standards of the underlying dis- trict and the Planned Development district, the standards of the Planned Development district shall apply. " (Ord. 71 -4 Exh , "A" 1971 ; Ord. 70-32 S 185 . 3. 1 1970. ) In our instance the three-story concept was clearly__s._ho.wn , discussed and was approved alas part of the P.D. As City Administrator of Tigard, I will not allow any Certificates of Occupancy to be issued for any of the units in the Canterbury Woods Planned Development (and I have instructed other members of the City Staff accordingly) until such t;'me as the buildings and related development of the property conform to and comply with all applicable City ordinances, or until such time as a court order is issued forcing me to issue Certificates of Occupancy. Some of the issues that must be resolved before Certificates of Occupancy can be issued include the following: 1. Proper ;installation of chimney boxes. 2. - Removal of stairs-leading, to "basement" area. 3. Landscaping installed according to landscaping plan. 4. Fence to be installed per plans. 5. Large berm properly graded. While "I took the position earlier that the City could not legally stop the project (and I still hold to that position), I feel strongly that the City should not issue certificates of occupancy until the buildings and related development meet the City ordinances. As of this writing Mr. Hoffman-has not yet repaired the damage done in-laying ---_ sewer line on S. W. 106th Avenue and Del Monte Drive. _ Nor has he-made any attempt to repair the sunken ground where our two proper- ties meet at the eastern boundary. The corner of one building is only twen�Y feet from our line (not to mention the over-hang caused by deck'ng) and the agreement clearly states that he build no closer than twentfeet from the Association property line. He has also stated that he does not intend planting the trees called for in our agreement and that - furthermore - he does not intend constructing the five foot fencing along the boundary lines. We were advised in a meeting on March 22, 1979, that the Canterbury Woods Project is to, be condominiums, and that they are intended for sale in the month of May., This information came from Mr. Hoffman, his architect, property manager, etc. We would like to know if this is a matter of county record in Hillsboro. The attorney for Mrs. Libby;Anderson has been in touch with me during the last week, and he states that his client is as concerned about this project asare the residents of Caiway Hill. New radios and other equipment are currently being installed. One of the new vehicles will be in service Friday and the other one the first of next week. SCHOOL BOUNDARY-CHANGE The School Board recently considered the City's request to change the boundaries between the Tigard and Beaverton School Districts. Superintendent Fennell said that inclusion of the Summercrest area would mean 15 more students would attend Tigard schools. However, inclusion of the entire area being considered would mean an additional 261 students. Further, discussion with the Beaverton School District and with residents of the area is planned. Mr. Fennell said no action would be taken by the Boundary Board until August or September. Their ruling would not be ef- fective until May 31, 1980. PUBLIC WORKS DIRECTOR POSITION The City Staff has interviewed two candidates for the position of Public works Director to date. Two more candidates will be, interviewed, one Friday and one on Monday. Two of the final six candidates, both from out of state, have" indicated they,are no longer interested in the position. WANT MORE GASOLINE For purposes of gasoline allocations, the Federal'Government has set for the "base year1° the period November, 1977 through October, ;1978. During that period the City used 31,867 gallons of gasoline.
