(a) Mayor stated that this Ordinance was not up for a second reading,;rather,
it was up for consideration on removing it from the table.
(b) Motion by Councilwoman Stimler, seconded by Councilman Cook to remove

(c) Fred Anderson, Attorney for the owners spoke in favor of approval, asked
for questions from Council and introduced Richard Drinkwater, the con-
sulting Engineer on the project.
(d} Richard Drinkwater, Consulting Engineer, gave a history of the project
including some of the problems discussed and the extensive review
process. He concluded by saying that the project has been approved
by the Planning Commission, Park Board, Fire and Police Departments,
and planning staff.
(e) Councilman Scheckla reiterated his problem with the liability question
of the;ponds,and the park access.

(f) Councilwoman Stimler stated that she had problems with the street
width both in terms of fire truck access and park access. She sug-
gested that the project could be re-designed to make the street wider
without substantially reducing the number of. units.
_ (g) Richard Drinkwater pointed out that to do this would require a complete
re-design of the project, and again mentioned the lengthy process the
owners have been subjected to in obtaining approval.
(h) Fred Anderson questioned the application of the new street standards
on a project which has been in a developmental stage for so long. He
also pointed out that this project was up for Council consideration
prior to the adoption of the new street standards.
(i) Councilwoman Stimler, stated that she still had problems with the pro-
ject but did not wish to subject it to a final vote tonight, therefore,
she moved to re-table the Ordinance until next Monday at which time
further questions could be addressed. Seconded by Councilman Brian.
Tabled by 4 to i vote of Council. Councilman Scheckla voting Nay.
Staff to report on rationale as to offsetting coumiunity benefits to
narrow streets, access problems and questionable public park.

11. ORDINANCE No. 79-26 AN ORDINANCE SPECIFYING THE ANNEXATION PLAN FOR VARIOUS

PLANNING AREA AND MORE SPECIFICALLY DESCRIBED AS SEVEN
DISTRICT AREAS REFERENCED BY ADOPTED NEIGHBORHOOD PLAN-
NING ORGANIZATION PLANS
(a) George Benz, S.W. 113th, spoke in opposition to the annexation of his
property stating that he saw no reason to be included as a part of the
City. Councilwoman Stimler pointed out that his,pa-rticular land was
in an area which specifies "eventual" annexation.
(b) Mona Steele, S.W. 113th, spoke in opposition to the plan.
(c) Marge Davenport, 15100 S.W. 109th, 'spoke in opposition to the plan

also spoke to the previous promises of Council
not to force annexation.
(d) Don Forrest, 8985 S.W. McDonald, spoke in opposition. He gave a brief
history of annexation in Tigard and displayed several maps. He'con-
cluded by saying that the promise by politicians has always been the
nff" of the Tigard boundaries. however as evidenced by his
maps, this has never been the reality.

(e) Jessie Flowers, 11700 S.W. Gaarde, spoke in opposition, stating that
such a plan removes the individuals right to vote.
(f) Pat Biggs, 8787 Mountain View Lane, spoke in opposition.
(g) Lillian Ashley, 9585 S.W. O'Mara Street, spoke in opposition, pointing
out that a policy of forced annexation takes away the right to voce;
a basic right in this country.
(h) Bruce Hollister, 14380 S.W. 118th, spoke in opposition of the plan,
stating that he personally was not so opposed to annexation, rather
that he was opposed to the policy, philosophy and morality of pur-
suing and/or forcing annexation. He stated that the City should be
working to attract annexation.
(i) Councilman Brian stated that he supports the annexation plan, pointing
out the value of being within the City and the minimal costs. He also
mentioned that each annexation would still be considered individually,
with opportunity for public forum.
(j) Councilman Scheckla stated that he opposed the annexation plan, and
maintains the philosophy he has always had; and has promised to the
citizens in the past.
(k) Councilwoman Stimler pointed out that this plan would still allow for
individual consideration of each annexation, and reminded the public
that this was only a "plan", a direction to be aiming for.
(1) Motion by Councilman Brian to amend the ordinance by: 1. inserting the
word:"consider" 'in the policy of Subarea #5, after the word immediately;
2. deleting the word "encourage", and inserting in its place the words
"not pursue" in the policy of Subarea X19; 3. inserting the word"event-
uaily" after in
in the`policy of Subarea X610; ' 4. inserting the
words "considered.. ..for" surrounding the word "immediately" in the
policy of Subarea #11; and 5. inserting the words "considered.. ..for"
surrounding the word "immediately" in the policy of Subarea X613.

18. OTHER
(a) City Administrator reported that James Sidey had accepted the nomination
to serve on the Library Service Agreement Committee. He further report-
ed that Betsy Chick is unable to serve on this Committee and recommended
the appointment of Yvonne Burgess.
Motion by Councilman Cook, seconded by Councilwoman Stimler to nominate
Yvonne Burgess to serve on the Library Service Agreement Committee.
Approved ,by unanimous vote of Council.
(b) City Administrator explained that the study being performed by CH2M
Hill would be delayed one to two months while they wait for the
final report from the Corps of Engineers. This delay is necessary
to avoid possible duplication.
(c) City Administrator reported that some patching and 'minor overlay
work was being done on 72nd Avenue from;approximately Bonita Road
to Boones Ferry 'Road. He went on to say that the complete cost of
repairing this portion of the street would be,$26,000. He suggested
G that we stop atthispoint and see the bids for the overlaying.. Staff
will evaluate gids and,make recommendation if work is to be done by
City or Contractor receiving the street overlay work. City Administrator
further stated the property owners were 'still interestedinthe 72nd
sheet L.I.D.
(d) City'Administrator asked Council to approve the writing of a letter
to the State Bureau of Outdoor and Recreation`Department requesting
and extension on the soccer field.grant Consensus;of Council was to
have staff,prepare such a letter.
(e) City Administrator mentioned that letters had been sent to both
Burlington Northern and Southern Pacific' Railroads regarding the
Main Street crossing. He went on say that Burlington Northern

had not even responded to the letter. Southern Pacific has promised
to look into the problem, but has taken no action thus far. He con-
eluded by saying that follow-up letters have been sent.
(f) City Administrator stated that a letter had been received from MSD
regarding the Durham and Cipole proposed landfill sites. MSD is
requesting citizens to sit on a local advisory board. He suggested
that Council begin thinking of names as quickly as possible.
(g) City Administrator requested that Council consider the transfer of
monies from the contingency fund to the general account for the purpose
of purchasing two new police radios. Council directed the City Admin-
istrator to prepare such resolutions.
(h) Councilman Brian questioned the check #1209, a $200.00 doctor bill.
City Recorder stated that that should be discussed in Executive
Session, or with City Administrator.

Mr. Sorg has agreed to continue the lease for the Library under the same
conditions for a period ,7ul.y 1979 thru 1982.
COUNTY CHARTER REVIEW.
County Charter Review Committee Chairman, Chuck Williams, scheduled the
first public hearing to discuss various aspects of the county charter on
April 511979 in Hillsboro. As soon as a report of this meeting is avail-
able, staff will report to Council.
FIVE FIRMS CONTACTED.
Five engineering firms have been contacted relative to inventory of city
streets in preparation of a transportation finance policy. Staff antic-
ipates receipt of proposals by the end of this month or mid-May.

related issues on Scholls Ferry Road.
STREETLIGHTS.
Street Lights have been installed on Lomita Street. This was a request merle
by the City last December to PGF,.
72N-D AVE. PATCHED..
City Crews continue to patch various sections of streets in the city. 72nd
Ave. received major work this week. We have used approximately 10 tons of
material to date on this street.
