agenda was to be postponed as Legal Counsel was unable to attend this
evening.

were in attendance to testify). Hearing no objections, it was agreed to

8. ORDINANCE No. 79-18 AN ORDINANCE REGULATING THE USE OF MODEL HOUSES IN
CONNECTION WITH THE SALE OF RESIDENTIAL REAL ESTATE.
(a) City Administrator recommended approval of the Ordinance.
(b) Chas. Cummings, 15855 S.W. Greenway, Summerfield, after addressing several
questions regarding the specifics of the Ordinance, stated that he supported
the Ordinance.
(c) Eldon Rickey, 15745 S.W. Highland Court, discussed the problem the neighbors
of the model houses have been having in Suimnerfield. fie supported the
Ordinance but questioned its impact on the current sitr_ation. Council said
that the possible retroactive nature of the ordinance would be addressed to
Legal Counsel.
(d) Mrs. Howard Finney, 15755 S.W. Highland Court, expressed her complaints
regarding the model houses in Summerfield, including: the length of time
they have been located there; the impacts on the neighborhood; and, the
fear that T.D.C. would be using Summerfield model houses for their new
development in Portland.
(e) Bob Bailey, Tualatin Development Corporation, apologized to the residents
for the inconvenience of the model houses, stating that T.D.C. was making
every effort to minimize their impact. He went on to say that regardless of
Council action, T.D.C. planned on discontinuing usage of those homes within
four months. He also stated that since the Summerfield project is almost
done, and T.D.C. has no other projects in Tigard, this ordinance would not
affect T.D.C. to a great extent. In conclusion, he stated that he had no
objection to the ordinance, but warned that if similar ordinances were passed
in other jurisdictions, it would place a serious hardship on developers.

(1) Mayor Mickelson, referring to a letter from the applicant, asked that
these items be deleted from this evenings' consideration, as the
applicant had requested that the hearing be set over to June 11, 1979.
Council agreed to set this hearing over.

The Canterbury Inn, 14455 S.W. Pacific Highway, Tigard, Oregon, Class A #
(a) Chief of Police recommended approval and forwarding to the State Liquor
Control. Commissision of this new applicant.
(b) Motion by Councilman Cook, seconded by Councilman Brian to approve.

11. HOUSING OPPORTUNITY PLAN.
(a) Planning Director, explaining 4un.. the MSD-staff had. been unable to attend
the meeting, gave a brief summary of the plan. He stated that this was a
ade lo::-
cooperative -effort among local jurisdictions to irnpro =, a==nd �_ �ell p
income housing. He went on to state that MSD needs formal support from
the local. jurisdictions.
(b) Councilwoman Stimler stated that she had read the plan and was concerned ,
about the amount_of administrative costs for such a plan. She went on to
say that the cost of administering such program often undermines them, a
the amount of money for recipients is so greatly reduced.
(c) Councilman Brian asked how the City of Tigard is doing in terms of having
"fair share" of low-income housing. Staff reported they are waiting for
further information from MSD.
(a) Motion by Councilman Brian, seconded by Councilman Cook to support the
Housing Opportunity Plan.
Approved by 4 to 1 vote of Council, Councilman Scheckla voting Nay.
(e) Councilwoman Stimler requested that the MSD staff be invited to come and
discuss this with Council.'

16. CONSIDERATION OF GRAYSON INVESTMENTS REQUEST FOR NON-OCCUPANCY AGREEMENT.
(a) City Administrator, referring to the letter of request from Grayson `
Investments, explained his problems with this type of action. He
expressed his fear that the City would not have good control on the
project if we issue building permits and allow construction prior to
obtaining ;sewer_fees. He suggested phasing>the sewer connection fees
throughout the project to minimize the cost impact on developers.
(b) ' Mickey Bowman, Grayson Investments, explained that the request was to
have permission to put in the main line and;begin construction, not .to
hook up prior to paying fees. He went on to say that if Council were to
approve this, it would mean a delay in;getting the fees of only four months.
(c) After much discussion by Council, the City Administrator requested further
study by staff. He scent on to say that if additional staff research did
not>find `any problems'with this type of action, he could recommend approval.

18. STREET RESURFACING PROGRAM.
(a) City Administrator described the changes made in the program due to

(a) City Administrator gave a report on the status of the B.O.R. grant
application, stating that four projects have been identified as priorities.
These are:
1. SuiTmerlake - dredging, grading, shoreline reinforcement, $30,000.
2. Wastewater irrigation system, $15,000.
3. New restrooms - Cook Park, $30,000.
4. Land acquisition, 13 acres off Burnham, some floodplain, $48,000.
He went on toremindCouncil that these grants are for 50-50 matching funds.

#2 and #3. Seconded by Councilman Brian.
Approved by unanimous vote of Council.
28. STATUS REPORT - CETA PROGRAM.
(a) City Administrator gave a status report on the proposed change in the
administration of CETA,personnel payroll. He went on to say that the

29. OTHER
(a) City Administrator stated that a request had been received from Wedgewood
Homes regarding the reduction of bond (street). He went on to say that
Wedgewood Homes had requested Council consideration,at the next Study
Session. "Council agreed to consider the matter at the next Study Session.

(}') Councilwoman Stimler reported that C.D.B.G. was nearing completion, and
'next Thursday, and to the Washington County Commission
would be presented
the following Thursday. She invited interested Council to attend.
(c) Councilman Brian reminded Council that he would not be in town for next
Monday night's meeting.
(d) Councilman Cook requested information on the status of the CH2if Hill st2orm
reported that staff had met with CH M Hill
drain project. City Administrator
last week. To this date they have identified runoff basins. He went on to
say that CH2M Hill has indicated willingness to report to Council on the
project within the next month or so.

in the City of Tigard between Highway 217 and hall Blvd.
We hereby formally request that we be placed on the agenda for your
next City Council meeting on March 12, 1979 for the purpose of discussing
the possibility of our obtaining a "Non-Occupancy Agreement" with the
City of Tigard and Unified Sewerage Agency for the sewer connections
on the 108 unit complex.
We have already spoken with Mr. Gary Krahmer, General Manager of
Unified Sewerage Agency, and they would have no objections regarding

I speak for a group of Calway Hill residents by saying that...
Since determination (during initial Planning Commission discussions)
stated that Mr. Hoffman's recreation building be placed "internally," we
will expect to have the full support of the planning commission and, the
City of Tigard in seeing that Mr. Hoffman follows their dictates.
We look forward, also, to Mr. Hoffman's repair of our common area adjoining
his property line where the grade is sunken.
We most seriously demand that any and all further changes in<Mr. Hoffman's
project be brought to planning review and also to public review.
Based upon the aforementioned letter, at this time we will expect to have
(as tax-payers and neighbors of the project) your full support and enforcement
of "internal" placing of the recreation building. If Hoffman wishes another
location - we submit that he must again go beforeplanning review and we also
submit - that this time a public bearing be held. We would wish to be notifed
of time and place of such meeting.

this determination is that during initial Planning Commission discussions it I
was stated that this structure should be placed "internally" to serve the
immediate residents.
