(a) City Administrator introduced Susan Bailey, representing the Corps of Engineers, who proceded to show the film and answer questions of Council and staff. 8. KATHERINE STREET SEWER AGREEMENTS (a) City Administrator noted Legal Counsel had drafted an agreement between City and 4 home owners for installation of Storm & Sanitary Sewers on Katherine Street . This contract would have a 1 year payback time limit . City Administrator also briefly synopsised history of project. City Administrator stated Unified Sewerage Agency would be responsible for the engineer- ing, letting of bids, and inspection of the sanitary line and City of Tigard would handle the storm line in-house. (b) Mr. Paul Patrick, S.W. Katherine Street, questioned why residents have to assume costs for this project. (c) President Mickelson stated since it was shortly after 8:00 P.M. that this item would be tabled until after the public hearings. 8:00 P.M. PUBLIC HEARINGS 9. ZONE CHANGE - ZC 1-78 (Rembold-Bishop) NPO #3 A request by Rembold-Bishop Properties for a retail/commercial- professional from C-3 to C-3 Planned Development on a 7.8 acre parcel at S.W. Park and S.W. Watkins Streets (Wash. Co. Tax Maps 2S1 2CB, Tax Lot 1800; 2S1 2CC, Tax Lot 700; 2S1 3DA, the eastern portion on Tax Lot 4700) . (a) Planning Staff representative gave synopsis of Planning Com- mission action. (b) Mr. Dick Klumpke, 13450 SW Watkins - questioned why a zone change was necessary and questioned placement of traffic signal on Pacific Highway. Mr. J. B. Bishop, 4263 NE Hazelfern Place, Portland - answered Council's questions regarding project, noting that NPO #3 had requested the project not have ingress-egress on SW Park Street. Mr. Bishop also stated that the project would only have a signal light on Pacific Highway if Council determined, during the T.S.M. project hearing, that a light should be placed in that location. Y Page 4 September 25, 1978 Council Meeting Minutes (b) Planning Staff representative presented the facts and synopsis of Planning Commission action. (c) Public Testimony Proponents: Mr. R.H. McSweeny, Attorney for N.W. Engineering Co.- noted Sabre Construction had not presented information to show undue hard- ship existed at the Planning Commission meeting because staff had recommended approval. Mr. Al Crombe, representative of N.W. Engineering - presented 5 pictures (noted as Exhibits 1-5 in file) showing the site and surrounding buildings. Mr. Crombe noted that business was growing so fast that they would either have to build new build- ing on site or rive to another site. Mr. Ed Phillips, Sabre Construction - noted land was smallest parcel Sabre had ever attempted to construct a light industrial building on, but noted that surrounding land uses had been granted setback variances to construct. Mr. Phillips also stated there was adequate parking and landscaping space if variance was granted. Mr. R.H. McSweeny stated a hardship had been proved, noting again the surrounding business were built close to the property lines also. (d) Planning staff representative recommended denial based on the failure of the applicant to meet the requirement of proving an undue hardship did exist. (e) Public Hearing Closed (f) After lengthy discussion by Council , applicants and staff, Councilman Cook moved the appeal be upheld with condition that the project be submitted to site design review prior to issuance of a building permit. Motion seconded by Councilman Scheckla. Approved by unanimous vote of Council present. 12. COMPREHENSIVE PLAN REVISION - Community Services and Transportation Plan. Amendment to the Tigard Community Plan in the form of a Community Services and Transportation Plan. (a) Public Hearing Opened Mayor Bishop arrived - 9:33 P.M. ) (b) Public Testimony Page 5 September 25, 1978 Council Meeting Minutes Mr. Leo Huff, Oregon Department of Transportation - stated CRAG had not finished their transportation plan and that ODOT was concerned with the impact on regional transportation system and state transportation system, including Pacific Highway, Scholls Ferry Road, Highway 217 and I-5. (c) Public Hearing Closed (d) Letter presented by Planning staff representative from Mrs. J. Grace Seifert, regarding 72nd Avenue density. Lengthy discussion followed regarding growth management plan and Scholls Ferry Road traffic problems. Planning Staff noted the transportation plan had been sent to each surrounding jurisdiction,but no one had responded with any input. (e) ORDINANCE No. 78-57 AN ORDINANCE ADOPTING THE COMMUNITY SERVICES AND TRANSPORTATION PLAN FOR TIGARD TO THEREBY ATTAIN THE PURPOSES AND OBJECTIVES OF CHAPTERS 197 and 227 O.R.S. INSOFAR AS APPLICABLE, WITH RESPECT TO THE TIGARD DETAILED PLAN AREA, THUS SUPERCEDING THAT PORTION OF THE TIGARD COMMUNITY PLAN AS ADOPTED BY ORDINANCE No. 73-6 AND NEIGHBORHOOD PLANNING ORGANIZATION PLANS ONE THROUGH SIX, AS ADOPTED BY ORDINANCE NUMBERS 74-25, 75-8, 75-55, 77-69, 78-9, AND 78-27, AS AMENDED, HERETOFORE APPLICABLE TO THE SAME AREAS, AND FIXING AN EFFECTIVE DATE. KATHERINE STREET SEWER AGREEMENTS (a) City Administrator gave brief synopsis of hearing earlier in the meeting for Mayor Bishop who arrived late. Paul Patrick S.W. Katherine Street -gave synopsis of history of project. Steve Allison, 10265 S.W. Katherine Street - requested matter be resolved as quickly as possible due to health hazard presented with septic failures. (b) After lengthly discussion, Consensus of Council was to have residents submit in writing what type of sewer improvement is desired, legal description of properties involved, how cost is to be split between property owners and time needed for payback. (a) City Administrator recommended approval of amendment as it is a decrease in the contract cost of $4,334. due to the City purchasing signing and markings for the paths, and installing same. (b) Motion by Councilman Cook, seconded by Councilman Scheckla to approve and authorize execution. Approved by unanimous vote of Council. 29. OTHER (a) City Administrator noted he had received a phone call from a radio station asking about the paving of the bikepath on Tigard and Greenburg Road. The radio station had received a complaint regarding the breaking up of the pavement and noted the paving had been done wrong. City Administrator noted that pavement looks good and if a problem does occur, the paving will be under a maintenance bond for one year. (b) City Administrator requested Council authorize partial releases of bonds on the following developments because work was part- ially completed: Douglas Heights Subdivison - $20,960. be released Shilo Subdivision - $33,446.08 be released Motion by Councilman Cook, seconded by Councilman Scheckla to approve above noted refunds. Approved by unanimous vote of Council. (c) Recorder pro-tem requested Council approve Subdivision Com- pliance Agreement and Cash Bond Escrow Agreements be ap- proved for Scheckla Park Estates. Librarian attended meeting of the Washington County Cooperative Library Services (WCCLS) Committee to Study Administration of Libraries. Points discussed included setting of minimum standards for all libraries in the county and whether or not receiving county funds should depend on meeting minimum standards. b. There was no Library Board meeting on August 8 because of lack of a quorum. c. The WCCLS Citizens Advisory Board met August 9. Officer Martin instructed a class at the Police Academy for four days, teaching a Kiwanis Youth Camp police procedures. He received certification from the Board on, Police Standards and Training. IX. An important element of the study is drainage management for urban and developing areas. As part of our public involvement program, to explain the need for sound drainage planning, we have prepared a slide show called "When Rain Falls." The show vividly portrays the impact of increased land development on drainage, and dramatically presents the urgency for sound drainage management practices in a non-technical way, intended for citizen and environmental groups, planning and public works staffs, and elected officials. The site is currently zoned M-3 "Light Industrial" and is designated "Light Industrial" on the NPO #5 Plan. 2. The surrounding land use is manufacturing. 3. On the northwest sides the subject property is bounded by parking with a screen fence and planting to the Property line. On the south boundary there is a service drive adjacent to a residence. 4. The applicant is requesting a variance from the minimum side and rear setbacks of 20 feet to a 5 foot setback on the south and west sides and a 10 foot setback on the north side. The front setback would be 124 feet. 5. ' The applicant is requesting a variance in order to get maximum use from his property without adversely affecting the surrounding properties. 6. There is no maximum lot coverage limitation in a M-3 zone. II. Conclusionary Findings: 1. The proposed site plan allows for adequate parking for the present proposal and for future expansion. 2. Because of the current use of the abutting land a variance of the setback requirements would not adversely affect the surrounding properties.
