NOTICE OF SPECIAL MEETING
Notice is hereby given that a special Council meeting, called by
the Common Consent of the Council, will be held on November 6, 1978,
at 8:00 P.M. , in Fowler Junior High School Lecture Room, 10865 S.W.
Walnut Street, Tigard, Oregon. The meeting is called for the purpose
of considering the following items:

of the Planning Commission approval of a request by Raymond J. Bartel for density
review of Phase III of the Bellwood Residential Planned Development at S.W. 128th and
north of Walnut (Wash. Co. Tax Map 2S1 4AA, part of Tax Lot 100), which decision has
been appealed to the City Council.

Legal Counsel, Joe D. Bailey, City Administrator, Raeldon R.
Barker; City Recorder, Doris Hartig; Associate Planner, Ken Selby;
Planning Director, Ken Weaver.
Special meeting was duly called to order by the Mayor with the common consent
of Council.
2. APPEAL - ZONE CHANGE ZC 11-67 (Bellwood Park Subdivision). An appeal by City
Council of the Planning Commission approval of a request by Raymond J. Bartel
for density review of Phase III of the Bellwood Residential Planned Development
at S.W. 128th and north of Walnut (Wash. Co. Tax Map 2S1 4AA, Part of Tax Lot
100), which decision has been appealed to the City Council.
Tabled at October 23, 1978 Council Meeting.
(a) Motion to remove from the table: Councilman Mickelson, seconded by
Councilman Cook.
Approved by unanimous vote of Council.
City Planner Selby reviewed staff recommendations and stated the developers
involved had worked out problem areas.
Those who testified regarding the development of streets, easement
dedication, sewer and storm drains were:
Attorney Stan Martin
Jim Harris - Harris/McMonagle Engineer
Ray Bartel - Architect with J.W. Brayson
Gene Ginther - Engineer Wedgewood
Discussion centered around staff recommendations 6 and 8 regarding the
dedication and maintenance of the greenway areas. Planning Director
recommended the greenway be dedicated as an easement to the city and
referred to the Park Board for acquisition. It was suggested all dedications
or easements should be handled consistently.
Motion by Councilman Cook, seconded by Councilman Scheckla to approve
amendment to Phase III of the Bellwood plat subject to staff conditions
one through five, deleting condition six, adopting recommendations seven
through nine; staff recommendation eight to be amended to read; "That the
greenway be dedicated as an easement to the City and be referred to the
Park Board for further recommendation".
Motion carried by unanimous vote of Council.
3. ZONE CHANGE ZC 5-77 (Wedgewood) A request by Wedgewood Homes for a general plan
and program review for a Planned Unit Development of 348 units and a zone map
amendment from Washington County RS-1 to City R-7 Planned Development on a 68.31
acre site at the corner of S.W. 135th & Walnut Streets (Wash. Co. Tax Map 1S1 33D9
Tax Lot 700; 2S1 4A, Tax Lot 500).
(a) Associate Planner Selby stated the study area set aside in Ordinance
No. 78-67 should now be incorporated into the original ordinance showing
the agreement between the developers.
(b) Motion by Councilman Cook; seconded by Councilman Mickelson, to request
staff prepare an ordinance showing the amendment.
Approved by unanimous vote of Council.
4. RENEWAL OF GENERAL COMPREHENSIVE LIABILITY POLICY, FALSE ARREST AND COMPREHENSIVE
GENERAL LIABILITY UMBRELLA POLICY.
(a) City Administrator reviewed his memo and recommended city accept the
quotation of Leonard Adams in the following amounts:
LEONARD ADAMS INSURANCE AGENCY 1978-79
False Arrest Insurance (Expires Nov. 1) $ 6,084.38
The reason for the rate change is not due to
our loss record but rather an overall rate
increase of $125 to $165 per officer. In
addition we are covering more people under
the policy.
Comprehensive General Liability (Expires Nov. 5) 24,500.00
($300,000 BI & PD)
($300,000 Comp. Liability/Auto Liability)
($100,300 errors & Omissions)
Comprehensive General Liability (Umbrella) 6,654.00
(Expires Nov. 5) $1,000,000

(b) Motion by Councilman Cook to accept the Leonard Adams quotation, seconded
by Councilman Mickelson.
Approved by unanimous vote of Council.

5. APPROVE BOND RELEASE - DOUGLAS HEIGHTS SUBDIVISION.
(a) City Administrator recommended $14,532 of the bond be released as the storm
sewers have been inspected and passed tests.
(b) Motion by Councilman Mickelson to release the bond as requested; seconded
by Councilman Cook.
Approved by unanimous vote of Council.
6. WAVERLY MEADOWS SUBDIVISION - APPEAL CONDITION #2, S.W. Fanno Creek Drive 34to
36' paved width.
(a) Planning Director referred to Council for interpretation of a previous
condition regarding the above subdivision. Problem concerns paved width of
S.W. Fanno Creek Drive. City standards require local street to have 50'
right-of-way with 34' pavement. Subdivisions as approved to have 50' right-
of-way with 36' pavement. Council, Bill McMonagle and staff discussed
situation and requirement of a 34' or 36' paved right-of-way.

` (b) Motion by Councilman Cook, the Waverly Meadows Subdivision, S.W. Fanno
Creek Drive be a 34' paved right-of-way. Motion seconded by Councilman
Mickelson.
Approved by unanimous vote of Council.

7, RESOLUTION No. 78-92 RESOLUTION DECLARING
CITYOFTIGARDASAPUBLIC STREET AND ROADWAY SAND EACCEPTING
THE SAME AS A PUBLIC STREET AND ROADWAY.
(a) Attorney Bailey stated the description between the dedicated width and
actual width of S.W. 110th has been a problem in the past, and the adoption
of the resolution declaring a portion to be a public street would clear up
the records.
(b) Motion by Councilman Cook, seconded by Councilman Mickelson to adopt
Resolution No. 78-82.
Approved by unanimous vote of Council.
For safety reasons, Councilman Scheckla requested staff to check if
barricades or no parking restrictions should be placed along S.W. 110th.

LEAGUE OF OREGON CITIES CONVENTION IN PORTLAND.
The Hilton Hotel it. Portland will be the location of the LOC Convention November
12-14.
CETA.
We have received no word from CETA concerning the termination of employees
do to lack of funding. Jim Jackson, CETA co-ordinator, would not comment
on funding and had no idea when we would be notified of change in status.
HALLOWEEN PARTY.
The Halloween Party at the Library was a real success. Our thanks to the
Library Staff for their interest and participation. The children had fun.
SUBDIVISIONS.
.85 Subdivisions are in various stages of development within the City. This
is a tremendous strain on Staff, but all systems are operational and we are
progressing.
72nd INTERCHANGE.
Staff met recently with Mr. Klineschmidt of ODOT concerning the 72nd Ave.
Interchange. A final plan has been prepared. Final apptdv8i will depend upon
the pending approval of the DEQ.
PLANNING COMMISSION RESIGNATION.
Mrs. Corliss has resigned from the Tigard Plannin- Commission. A replacement should
be appointed as soon as possible.
A WINNER.
.. .-The .City of Tigard has been awarded FIRST PLACE in Group IV in the seventh annual
Employees Safety Awards Competition. This competition has been sponsored by the
League of Oregon Cities and the State Accident Insurance Fund. A plaque will be
presented to the City at the LOC Convention. CONGRATULATIONS TO ALL EMPLOYEES.
PUBLIC HEARING.
On November 14, 1978 in Room 402 of the Washington County Administration Building
a Public Hearing will be held on surrender of jurisdiction of certain roads to the
City of Tigard. All interested persons are urged to attend.

2. Mayor Bishop called the special meeting to order, noting the purpose of the
meeting was to have the second reading of Ordinance No. 78-67.
3. ORDINANCE No. 78-67 AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN AMENDMENT
TO THE 1970 ZONING MAP OF THE CITY OF TIGARD CHANGING THE
ZONE DISTRICT FOR A TRACT OF LAND LOCATED AT THE CORNER OF

(a) Motion by Councilman Mickelson, seconded by Councilman Cook to approve the
Ordinance No. 78-67 as amended.
(b) Planning Staff noted the amendment was shown on Exhibit "C". Staff also
expressed concern regarding conditions dealing with emergency access.
Consensus of Council was that this type of concern should be handled at staff
level.
Ordinance No. 78-67 passed unanimously on second reading.
