Clark, City Admir *.strator; Doris Hartig, City Recorder; Arline O'Leary, Administrative Aie. 2. CALL TO AUDIENCE FOR THOSE DESIRING TO SPEAK ON NON-AGENDA ITEMS Edward Thomas, 10765 S.W. Fairhaven (a) Mr. Thomas requested Council consider placing curb on the West side of 107th (in the vicinity of his residence) or vacating street. Mr.. Thomas stated Council had denied application to vacate 107th in the past. General discussion by Council, staff and Mr. Thomas regarding NPO#3's plan which identifies 107th as not a through street. (b) Council referred matter to staff for appropriate action to be taken - Mr. Thomas to be notified when item is scheduled for Co-am-il's c .r:s de-:ation. Roger & Sharon Zumwalt, 10665 S.W. Pathfinder (a) Roger Zumwalt expressed opposition to fee charged by City for the preparation of an appeal transcript, Mr. Zumwalt requested his appeal be exempt from charge because he filed appeal previous to adoption of resolution establishing fet,.s. Mr. Zumwal.t further requested Council consider an extension of the appeal. time. (b) Legal Counsel. stated the ordinance determining City would charge fee to offset cost of preparing appeal transcripts was adopted prior to Zumwalt's application of appeal, therefore fee would be applied. (c) General discussion by Council, staff and Zumwalt regarding cost, waiving fee, transcribing only last Planning Commission meeting which dealt with matter and process cost of preparing for an appeal hearing. Administrator stated Zumwalt's should make decision what meetings they desire be transcribed. (d) Sharon Zumwalt. stated she had been advised by her legal counsel the resolu- tion establishing fee can not be retroactive. Mrs. Zumwalt questioned why City's fee is high•_r than those charged by the County. (e) Motion by Councilman Wakem, seconded by Councilman Mickelson, to allow a 48 hour extension to Zumwalts to notify City of their intentions - if appeal is filed City must receive the $100 deposit within said stated time and tran- script will consist of last meeting Planning Commission considered item. Councilman. Cook advised Zumwalts that if item is appealed, Council will be considering no new testimony. Motion approved by 4 to 1 vote, Councilman Scheckla voting nay. 3. (b) Planning Director reviewed history of request and stated zone change had been approved by the Planning Coa--ission. Director explained applicant. was appealing the condition, placed on the approval, regarding access on 98th. (c) Public Testimony: Proponents: Kermit Carlile, Rt. 3 Box 278M, Sherwood ~ Mr. Carlile stated his opposition to condition number 4 - The applicant improve the street onto S.W. 98th Avenue when the right-of-way becomes available. Mr. Carlile also expressed concerns regarding process of obtaining a zone change, the fee charged and his desire to receive a copy of the transcript. General discussion by Council and Carlile followed. Council directed staff to provide copy of transcript to all who appeal in the future. Woody Hughes, 12850 S.W. 22nd, Beaverton Mr. Hughes expressed concerns with the process of obtaining zone change and the condition to improve the stra.at onto S.W. 98th Avenue. Opponents: None (d) Planning Director recommended (1) restricting left turns off Durham, in vicinity of proposed development; and (2) applicant to improve the street onto S.W. 98th Avenue to a 24 foot width if the right-of-way becomes available. (e) Public Hearing Closed. (f) Lengthy discussion by Council and staff regarding left turns off Durham, one .foot access control strips, Durham Road access deed restriction and possible future development of adjacent McCoy property. Carlile proposed to make. $5,000 deposit to be used for improvement of the street onto 98th should the McCoy property be developed. Acting Head Librarian attended Washington County Cooperative Library System (WCCLS) professional board meeting on May 9. Of interest: New board members were elected for 1977-78. Tigard Public Library will not be a member of this board for the coming year. Tigard Librarian was appointed to a committee to revise the WCCLS by-laws. Committee met on May 25, with Librarian attending. b. Tigard Library Board held its regular meeting on May 10. Minutes are attached. c. Librarian visited Sherwood Public Library on May 18 to discuss procedures and areas of common interest. Librarian plans to visit each public library in the County as a means of building cooperative relationships and observing procedures and policies. d. Librarian attended CETA orientation at Marylhurst on May 26. Of Interest: Tigard Library will receive a CETA summer pro- gram youth funded by Clackamas County CETA. Librarian has also applied to the WAshington County CETA summer youth program for someone to assist in childrens' summer programs. e. On May 10 following a demonstration of Audio-Visual equipment by Butterworth, Inc. , Sherwood, Cedar Mill and Tigard purchased for sharing by the network the following: one Insta Load 35mm sound/filmstrip projector, with two programs; one Study Mate, 35mm filmstrip projector; one overhead projector. These purchases were made with WOCLS-. funds designated for AV equipment and materials. The Insta Load and overhead projector will be stored at Tigard. f. On instruction of Library Board, the Librarian sutmitted a memorandum to the City Council through City Administrator con- cerning revision of chapter 2.36 of the Municipal Code. g. On May 17 the volunteers met with the Librarian and Library Assistant for Children. A majority of volunteers will continue their schedule through the summer. It was decided to hold these meetings bi-monthly in order to provide on-going training and to pinpoint and discuss •areasfor improvement of library "service. h. Organizing the store room continues. Friends of the Library removed books to be sold at Town and County Days, increasing usable space for Library. 2. Personnel: a. Three persons from city and county courts completed a total of 102 hours service. b. CE-2 student completed program. c. Another volunteer has dropped temporarily. There are now 15 active volunteers. However, a new flurry of applications for zone changes, primarily in conjunction with proposed residential develop- ments, has extended the waiting period to 1i months. The vacated associate planner position has been filled by promoting John Laws. Although the position will not be officially open until July 1, John has spent this month carrying the duties of the asso- ciate planner. Neighborhood Planning NPO #4 - The plan text is presently being typed and will be delivered to the NPO members when copies are available. NPO #5 - The City Council is scheduled to hold a hearing on this plan on July 11. NPO #6 & #7 - The first meetings are scheduled to begin in July. Park Plan Staff is making revisions in the plan based upon changes directed by Council at their June 20 meeting. In addition, work toward publish- ing the rather sizeable document which will include several color plates has begun. Pollock Investments hereby appeals the June 7, 1977, decision of the Tigard Planning Commission to deny ZC 17-77 to amend the Tigard Zoning Ordinance Map changing the zoning designa- tion from R7 Single Family Residential to A2 Medium Density Resi- dential for tax lots 1600 and 1700, Section 35AD, T1S, R1W, and tax lots 2500 and 3900, Section 35DA, T1S, R1W; Washington County, Oregon; and within the City of Tigard corporation boundary. We, the applicant and owner of the property, have requested the zone change in compliance with the Tigard Zoning Ordinance and in conformance with the Tigard Community Plan. We have also identified a community need which was acknowledged by the Tigard Planning Commission in their deliberation on this matter. The Planning Commission denial was based on findings of too high a density, surface drainage impacts on adjacent properties and on the downstream drainage system, and traffic impacts on Hall Blvd. We disagree with the finding thL. : the proposed density is too high, when in fact it conforms with the Tigard Community Plan. Consideration of surface drainage impacts is an appropriate con- dition of development, but not i justification for denying the change. E. 1/4 of Section 14, Township 2, South Range 1, West of the Willamette Meridian. This proposal was to go before a public hearing April 19, 1977. However, it was tabled at this meeting due to the formation of the Neighborhood #5 Committee pending their recommendations. Further, at the next meeting in May, 1977 my proposal was tabled again because Neighborhood #51s report only concerned itself with the land East of S. W. 85th and Neighborhood #6 Committee was formed for consider- ing land West of S. W. 85th. After talking with Mr. Dick Bolens, City Planner for the City of Tigard, I learned the earliest possible time for my proposal to go before a public hearing would be in the July, 1977 meeting, but probably not before the August, 1977 meeting. Cowles r MEMO June 24, 1977 T0: City Council FROM: City Administrator and Finance Director SUBJECT: Data Processing of Payroll ��,�� V. The workload in the Accounting Department exceeds our ability to keep the records current as well as preparing the required "in house" audit reports. With the adoption of a Program Budget, the number and complexity of account- ing entries will increase several fold. Recognizing the space problem in City Hall and not wanting to add to the financial burden by adding new employees, it was suggested the city contract for payroll services. The budget committee approved the recommendation and the 1977-78 budget has $2,500 for this service. Staff has reviewed proposals to process the City's payroll through U.S. National Bank, First National Bank and First State Bank. U.S. Bank and First National Bank offer a similar service level and total estimated costs are about equal. In our opinion First State offers limited service in preparing supplementary payroll reports and check writing (SAIF, Social Security, etc.) For the service they do perform the charges are comparable to U.S. and First National. In reviewing the proposals it is estimated that First National or U.S. National will do the work for approximately $2,000. It is difficult to give an exact figure as some reports are figured on a per line basis and we will also be picking up data on 1977 terminated employees. However the $2,000 estimate is x.ell within the budget. As costs are very similar, in my opinion the selection should be made on the basis of "service performed". We will not have an answer to this until we contract with a firm, however it would appear U.S. Data Corp. will give the best service. The City has a checking account with U.S. Bank, their representative has been most helpful in sorting and evaluating services to be performed, and has displayed excellent willingness to work with our staff and schedule. This conclusion is also backed up by our prior experience with U.S. Bank staff. Therefore, it is recommended that the City enter into an agreement, copy attached, with U.S. Data Corp. at the earliest possible date in order to provide for payroll conversion by July 15 which is the closing date for the first payroll period of the new fiscal year. In such case, Datacorp's liability shall extend only to direct loss resulting there- from as opposed to consequential or special loss or damage. Customer agrees to indemnify and hold Datacorp harmless from any liability, loss or damage in connection with any claims arising out of or resulting from this agreement or the performance of services hereunder. 7. Datacorp (Datacorp) and City of Tigard (Customer) Datacorp has entered into an agreement with United States National Bank of Bank Oregon g (Bank) to process automatic deposits, as referenced in paragraph 5.d, of the contract, to Bank and other banks who are members of Oregon Automated Clearing House Association (DACHA) . With the adoption of a Program Budget, the number and complexity of account- ing entries will increase several fold. Recognizing the space problem in City Hall and not wanting to add to the financial burden by adding new employees, it was suggested the city contract for payroll services. The budget committee approved the recommendation and the 1977-78 budget has $2,500 for this service. Staff has reviewed proposals to process the City' s payroll through U.S. National Bank, First National Bank and First State Bank. U.S. Bank and First National Bank offer a similar service level and total estimated costs are about equal. In our opinion First State offers limited service in preparing supplementary payroll reports and check writing (SAIF, Social Security, etc.) For the service they do perform the charges are comparable to U.S. and First National. In reviewing the proposals it is estimated that First National or U.S. National will do the work for approximately $2,000. It is difficult to give an exact figure as some reports are figured on a per line basis and we will also be picking up data on 1977 terminated employees. However the $2,000 estimate is well within the budget. As costs are very similar, in my opinion the selection should be made on the basis of "service performed". We will not have an answer to this until we contract with a firm, however it would appear U.S. Data Corp, will give the best service. The City has a checking account with U.S. Bank, their representative has been most helpful in sorting and evaluating services to be performed, and has displayed excellent willingness to work with our staff and schedule. This conclusion is also backed up by our prior experience with U.S. Bank staff. Therefore, it is recommended that the City enter into an agreement, copy attached, with U.S. Data Corp. at the earliest possible date in order to provide for payroll conversion by July 15 which is the closing date for the first payroll period of the new fiscal year. MEMORANDUM To: City Council From: Planning Director Subject: Washington County review of the Mayor' s proposal for street extensions in the NPO #3-Bull Mountain area Date : June 20, 1977 The County staff is in the process of reviewing several traffic circu- lation alternatives for the NPO #3-Bull Mountain area. At the June 6 City Council study session, Mayor Bishop proposed an additional al- ternative for consideration. At the Council 's request I presented this alternative to the County staff and asked that the traffic engi- neering section evaluate it. I have since been provided the results of their work and will summar- ize the information which was provided me over the telephone. No written report was drafted. The traffic engineer did not actually "load" the entire street system proposed by the Mayor but instead of- fered a general evaluation as follows: 1. The extension of 135th directly south to Bull Mountain Road ex- ceeds acceptable maximum grades for a residential collector street but could be built. 2. The southerly connection of 135th to Bull Mountain Road will not provide access to Scholls Ferry Road for the developing area on the northeast slope of Bull Mountain, as intended by the original 135th extension proposal. The result will be to put this traffic onto Walnut, 121st, and Gaarde. 3. The projected 1990 traffic volumes on the extended portion of 135th would be approximately 1,000 vehicles per day but not to exceed 1,500. 4. The extension of 121st to Bull Mountain Road will result in this street becoming the most convenient north-south route and the heaviest traffic carrier. 5. The extension of Gaarde due west to meet a southerly extension of 135th is probably unfeasible due to rough terrain in the form of several ridges and valleys which would have to be traversed. In addition, this would tie Gaarde and 121st into the developing area on the northeast slope of Bull Mountain and place the major- ity of the traffic generated on these facilities. By this continuation of existing streets under residential collector standards and by making available numerous ava '-a;=e inter-connecting residential streets, no one street will have to bear the burdening traffic load or through traffic originating from Pacific Highway. 4. I•.urray Blvd. extension should follow a route west of bull Mt. and connect with Pacific Hwy. near Sherwood, which in turn should connect with a future bypass route from I-5 in Tualatin to this point on Fac.-nwy. near Sherwood. This would complete a full by-pass of Tigard and relieve much of the Hwy. 99 traffic that is choi:_no-up Hwy. 99 through Tigard. 5. With the passage of this bill, the Port Commission approved a fiscal year 77-78 budget of $50,000, primarily for Port staff time for this technical assistance program. It is anticipated that this budget will enable Port staff to participate in 7 to 10 projects during the next 12 months. Port staff would like to invite you or a staff representative to a briefing for Washington County governments and chambers of commerce on the parameters and guidelines of the program and to discuss potential uses of this Port program. Criteria and application forms have been developed and will be discussed. The briefing has been scheduled for 9:30 a.m. on Thursday, June 30 at the PGE Auditorium, 14655 S.W.
