Pacific Highway Transmittal - Unified Sewerage Agency zet Infiltration and inflow control program (a) Motion to receive and file; Councilman Wakem, seconded by Councilman Cook.. Approved by unanimous vote of Council present. 8. REQUEST BY METROPOLITAN SERVICE DISTRICT AND FRANCHISED HAULERS FOR MODIFICATIONS TO REFUSE COLLECTION RATES (a) Merle Irvine, Metropolitan Service District, explained the solid waste manage- ment plan for Washington, Clackamas and Multnomah Counties and the anticipated cost of project. Irvine further stated the implementation of the program will impose the user fees established by MSD Ordinance 33, June 1, 1977 - causing hauling cost to increase. (b) City Administrator suggested Council consider authorizing franchise haulers in the City to increase their monthly rates to meet the additional cost imposed by the MSD. (c) Carl Miller, Miller's Sanitary Service, expressed concern the anticipated cost of project to the haulers would be more than presently being projected. Herb Frank, Frank's Disposal Service, planned to identify the additional charge on his billings as MSD charge. (d) Consensus of Council was to further consider matter at a Study Session, staff to notify franchise haulers of session, 9. APPROVAL OF "UNDERTAKING" SUBMITTED BY WAY W. LEE RELATING TO EXTENSION OF S.W. 69th STREET (a) City Administrator synopsized request by Way Lee - City Attorney reviewed agree- ment submitted to Council for approval.. General discussion by Council. and staff regarding deferring construction of 69th to later date. (b) City Administrator recommended Council's authorization for Mayor and City Recorder to execute agreement as presented by City Attorney. (c) Motion by Councilman Cook, seconded by Councilman Wakem, to authorize execution by City and record document in Washington County deed records. Approved by unanimous vote of Council present. 10. PUBLIC HEARINGS - Commencing at 8:00 P.M. A. APPEAL - ZONE CHANGE - Request. by Howard L. Glazer for a zone change from Washington County Suburban (SR) to City of Tigard Single Family Residential (R-7) with an overlying Planned Development P.D. to permit six quad houses (four-plexes), at S.W. 121st South of Springwood Drive. (Washington County Tax Map 1S1 34B, Tax Lot 500) (1) Public Hearing Opened. (2) Associate Planner stated facts and findings. (3) Public Testimony: Proponents - Howard Glazer, 2068 NW Flanders, read letter synopsizing basis of his appeal. Glazer distributed copies of letter to Council. Opponents - None (4) Staff recommended approval with the following conditions: 1 - Half street improvement be installed to city collector street standard on S.W. 121st Street. 2 - Applicant agree to the vacation of S.W. 122nd if and when this is deemed necessary by the City. 3 - That the sidewalk construction adjacent the street be eight feet in width (minus the curb width) to accomodate pedestrian and bicyclists. 4 - That a berm be placed adjacent S.W. 121st and S.W. Springwood. (5) General discussion by Council and staff regarding Planning Commission's action on proposal. Administrator recommended Council have transcript of hearing prepared for further consideration. (6) : Motion by Councilman Cook, seconded by Councilman Wakem that the hearing be continued to May 9th - transcripts of Planning Commission hearing to be provided to Council as soon as possible. ZONE CHANGE - Request by Don Vredenburgh to change the zoning designation from R-7, Single Family Residential, to C-P, Commercial- Professional, on a .75 acre parcel on S.W. Hampton Street, East of S.W. 72nd Ave, (Washington County Tax Map 2S1 1AC, Tax Lots 1400 and 1500). (1) Public Hearing Opened. (2) Associate Planner stated facts and findings. (3) Public Testimony: Proponents - Den Vredenburgh stated surrounding ptoperty owners were contacted and voiced no objections to the zone change. , Opponents - David A. Tozer, 12775 S.W. 69th William Sims, 12775 S.W. 69th (4) Staff recommended approval subject to the following conditions: 1 - An agreement to participate in the improvement of S.W. 72nd Avenue and S.W. Hampton Street. to City Standards be filed with the City Recorder.. 2 - Extensive vegetative screening be provided along the perimeter of the site to minimize the impacts on the adjacent residents. (5) Public Hearing Closed. (6) ORDINANCE No. 77-28 AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION BY DON VREDENBURGH FOR AN AMENDMENT OF THE 1970 ZONLNG MAP OF THE CITY OF TIGARD, CHANGING THE ZONE DISTRICT OF A TRACT OF LAND DEPICTED ON WASHINGTON COUNTY TAX MAP 2S1 1AC, AS TAX LOTS 1400 AND 1500, FROM (R-7) SINGLE FAMILY RESIDENTIAL TO (C-P) COMMERCIAL-PROFESSIONAL, AND ADOPTING THE ATTACHED EXHIBITS A, B, AND C AND FIXING AA' EFFECTIVE DATE. Staff advised Council the Ordinance be amended by adding staff's two recommended conditions. (7) Motion by Councilman Wakem, seconded by Councilman Cook, to adopt ordinance as amended. Approved by majority vote. Role call vote as follows: Mayor Bishop, Councilmen Cook, Mickelson and Wakem voting aye and Councilman Scheckla abstaining. Second reading of the ordinance will be required. C. ZONE CHANGE - Request by Ken Bouman to apply R-7, Single Family Residential, zoning in place of RS-1, one acre Washington County zoning, at the S.W. corner of S.W. 92nd Avenue and S.W. Durham Road (Wash. County Tax Map 2S1 14A, Tax Lot 300). (1) Public Hearing Opened. (2) Associate Planner stated facts and findings; and read letter requesting zone change to Council. Durham Road, Staff also advised Council. referral of S..W. 95th should be corrected to read S.W. 92nd. (5) Public Hearing Closed, (6) ORDINANCE No. 77-29 AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION BY KENNETH BOUMAN FOR AN AMENDMENT TO THE 1970 ZONING MAP OF THE CITY OF TIGARD, CHANGING THE ZONE DISTRICT OF A TRACT OF LAND AT THE INTER- SECTION OF S.W. DURHAM ROAD AND S.W. 92.d AVE AND DEPICTED ON WASHINGTON COUNTY TAX MAP 2S1 14A AS TAX LOT 300,FROM WASHINGTON COUNTY RU-4 (R-7) SINGLE FAMILY RESIDENTIAL AND ADOPTING EXHIBIT "A", GRANT- ING THE APPLICATION AND FIXING AN EFFECTIVE DATE. ZONING ORDINANCE AMENDMENT - Amendment to Tigard Municipal Code Section 17.28.110 to establish 400 feet as the maximum cul-de-sac length. (1) Public Hearing Opened. (2) Associate Planner stated there appears to be a conflict between the Tigard Community Plan, 1971 and the 1968 subdivision ordinance. The Plan is overriding and Its effect will be to create a safer, more equitable traffic pattern throughout the neighborhoods and community. Associate Planner read letter from Tualatin Rural Fire District, March 1. 1977, stating support of the amendment to 400 feet. (3) Public Testimony: Proponents - None Opponents - None (4) Staff recommended replacing the words "four hundred" for "six hundred", in Section 17.28.110 of t'se Tigard Municipal Code. APPEAL - CONDITIONAL USE - Request by Corbett Development Corp. for a conditional use permit to locate a model home at 12035 S.W. Pacific Highway (Washington County Tax Map 2S1 2AA, Tax Lot 1000) (1) Public Hearing Opened. (2) Associate Planner stated the Planning Commission had approved applicants request subject to the following conditions: 1 - Billboard be removed. Associate Planner stated Mr. Corbett was appealing condition number 1. (3) Public Testimony: Proponents: Nelson Corbett, 12035 S.W. Pacific Highway, appealed the removal of the billboard as an unrealistic burden to place on him as lease holder of the property. Corbett further stated the owners of property did not feel favor- able to removing the billboard. Opponents - None Discussion by Council, applicant and staff regarding access, landscaping and removal of billboard. (4) Staff recommended removal of the billboard. (5) Public Hearing Closed. (6) Motion by Councilman Scheekla, seconded by Councilman Mickelson, to approve conditional use subject to the following conditions: 1 - This approval is valid for one year, at which time the conditional use permit will be reviewed and annually thereafter. If at that time, the applicant has purchased the property, the billboard will be removed. 2 - Sewer and water hook-up be prohibited. 3 - Only one model home at a time for a duration of no less than two years be allowed. 4 - The entire site be subject to Design Review Board with each model home change. Approved by unanimous vote of Council. G. TEMPORARY USE - Request by Richard A. Cooper to allow a temporary mobil office at S.W. Pacific Highway North of S.W. Gaarde Street (Washington County Tax Map 2S1 3DD, Tax Lot 1000) (1) Public Hearing Opened. (2) City Administrator advised Council the Planning Commission would be acting on Mr. Cooper's conditional use request at their May 3rd meeting. Administrator further advised Council could; (1) hold hearing to consider temporary use request and take matter under consideration; or (2) continue hearing to such date the Planning Commission has taken action on the conditional use request. General discussion by Council and staff. (3) Motion by Councilman Mickelson, seconded by Councilman Wakem, to continue hearing to May 9th, pending Planning Commission's May 3rd determination. Councilman Wakem stated the intent of his motion, March 28, 1977, regard- ing remanding conditional use request to the Planning Commission, was to have the item heard at their April 19th meeting. RESULTS OF MAIN STREET POLL REGARDING STREET TREES & PLANTERS (a) Administrator read letter and ballot which had been mailed to the 23 merchants and/or property owners between Burnham and R/R originally contributing to project. Official vote count was - 10 for removal and 8 to modify Administrator further stated two additional votes for removal had arrived at City Hall one day late, leaving three who did not respond. (b) Motion by Councilman Scheckla, seconded by Councilman Mickelson, to confirm vote to remove trees and planters and to return street to its previous condition. Approved by unanimous vote of Council. (c) Administrator stated work would hopefully begin by the end of the week. 12. APPROVE O.L.C.C. CERTIFICATION OF APPOINTMEVT OF TIGARD REPRESENTATIVE TO CRAG'S WASHINGTON COUNTY GROWTH MANAGEMENT TASK FORCE (a) Motion by Councilman Wakem, seconded by Councilman Cook, to appoint Mayor Bishop as representative. GRANT FUNDS FOR ADDITIONAL PERSONAL SERVICES IN CONFORMANCE WITH GRANT CONDITIONS (a) Administrator reported to Council the City's 701 fund was running out - at the same time an excess of $2,000 exists in L.C.D.C. furds. Administrator requested Council authorize transfer of Ben Altman (part-time) from 701 funds to L.C.D.C. funds for the remainder of 76-77 fiscal year. Primary emphasis during the past month has centered on preparation of the proposed 77-78 budget document. This vorlL has required that other matters be deferred which has created a substantial work backlog. Not withstanding; these problems, several notable activities have been successfully undertaken as follows: • Tigard hosted the Washington County Elected Officials Caucus A Systems Development Charge Ordinance has been enacted • Housing Policies have been adopted • An application requesting 86;6 State funding of traffic signals, channelization and median construction for 99W has been sub- mitted to CRAG and will be considered on April 28 • Meetings with O.S.H.D. officials have been held regarding state highway improvements • The Clerk Typist II position vacated by Sande Fite has been filled by Judi Heise. The absence of Clerk Typist II, Loreen Wilson, on pregnancy leave has been handled through the utilization of temp- orary help through Manpower Inc. • Negotiations with T.E.A. have been held for the purpose of eliminating the Assistant Planner classification from the bargain- ing unit due to the temporary nature of this position. The Tigard Library Board held its regular meeting on March 8. Minutes attached. The Library Board chairman called a special meeting on March 17 to study the Tigard City ordinance relating to the library. Minutes attached. 2. Acting Head Librarian attended the professional board meeting for WCCLS on March 2. Of interest: The budget proposal which was approved for WCCLS will allocate $25,989 to the Tigard Public Library. A proposal for a Union Catalog is being submitted. This will have impact on TPI. workload. Courier service between the libraries is to be increased from twice a week to three times a week. It was proposed that the money remaining in this year's budget be apportioned to each of the libraries for ordering its own films and sending the bills to .WCCLS for payment. 3. TPL hosted the monthly meeting of the Citizens Advisory Board, WCCLS on March 9. 4. Received donation of two battery-operated wall clocks from Friends of the Library. 5. Ralph Delamartar, Senior Consultant for Library Development, Oregon State Library, was introduced by Chairman Burgess. 3. Chairman Burgess called for exploring the question of relations between the Library Board and the Head Librarian and between the Board and City Council. Board members reviewed Dast actions and involvement of the Board relating to activities in the Library. A general discussion followed exploring areas of concern and action for the Board to pursue and seeking clarification ofduties and powers under the law. The Board and the Council discussed possible selection process for choosing the new Head Librarian. The issue of appointments to the Board was intro- duced and Bishop outlined Council ' s powers and philosophy regarding appointments. Delamartar urged the identification of definite areas of Board responsibility, clear lines of authority and the need for referring to the law for detercinat:on. Public announcement of vacancies in local news- papers. b. Council solicit suggestions from Library Board. C. Terms of office run from July 1 through June 30. d. Board member may serve no more than two consecutive terms, but may be reappointed after one year interval. e. Regular representation outside the City boundaries be a goal. f. Suggest use of the terms "Chairman and Chairman Pro-Tem" instead of "President and President Pro-Tem. " g. Suggest that the Head Librarian be designated Secretary. Regarding section 2.36.040 relating to the duties and power of the Board: a. Participation of the Library Board in oral boards for selecting the Head Librarian. b. TRAINING A. Advanced Officers Training. Officer Featherston attended the Police Academy on March 7 through the 11th for a week's advanced officer's training course. B. Identi-Kit System. Sgt. Wheeler and Officer Landis received training on proper procedures of the Identi-Kit System. This school was for two days, and was held in Vancouver, Wn. IX. PUBLIC RELATIONS A. Crime Prevention Programs. Chief Adams talked on various crime prevention programs on March 16, contacting approximately 16 Kiwaniis at their evening meeting held at the Hi Hat. B. First Aid Training. Sgt. Jennings and Officer Killion taught an 8-hour first aid class to 16 members of the school district on March 2. C. Rap Session. Officers Landis and Newman, and Specialist Carrick went to Tigard High School on March 18 for a rap session with approximately 20 students for 45 minutes. D. Station Tours. On March 8 and March 9, 16 three year old pre-schoolers from the Tigard Co-Op Play School -toured our police department. Then on March 29, 14 pre-schoolers from the Scholls Pre-School toured the department. i �G TO:: Honorable Mayor and City Council FROM: Director of Public Works DATE: April 21, 1977 SUBJECT: Monthly Report Administrative Division: The Administrative Division of Public '.Forks was primarily involved in finalization of the Gaarde/McDonald Streets Path- way plan submittal; Budget re-assessment and presentation; prepara- tion of the Category III Application for Interstate Transfer Project funding of Pacific Highway Traffic Improvements; preparation and mailing of preassessment notices to Park Street Sanitary Sewer District property owners; including discussions and plan review with consulting engineers regarding the proposed Scholl's Trunk alignment; the Greenburg/Tigard Street pathway projects and the proposed S.W. Tiedeman Avenue Street re- alignment (north of walnut) for the pedestrian/bikeway projects. Engineering Division: The Engineering division completed its field engineering for the McDonald/Gaarde Street pedestrian bikeway projects and is currently drafting required easements for right-of-way acquisition needed to complete the bid documents. Several construction projects are underway and our inspection capabilities are somewhat strained. Field demand is causing a shortage of staff office time necessary for timely report and application processing. Operation and Maintenance Division: Due primarily to program scheduling of crew assignments the parks were readied for opening earlier this year. The parks were opened on Good Friday to afford opportunity for Easter Sunday egg hunts. Pavement patching and restoration, sanitary sewer manhole and system location and repair programs are operating efficiently. Work will be scheduled shortly for the improvements to Liberty Park. Materials for the sprinkler system are on hand and will be placed as soon as other site work is completed. Staff is awaiting direction prior to proceeding with Main Street Planter (2) removal, redesign or elimination. Theron L. Martin MEMORANDUM TO: Planning Commission and, City Council FROM: Planning Department SUBJECT: Work Schedule for Growth Management Plan DATE: April 25, 1977 Staff has developed the attached work schedule for the Growth Management Plan in consultation with county staff. Work to be accomplished includes city-county agreement on an Urban Service Area Boundary, an Immediate Growth Area Boundary, policies governing extension/provision of urban services and facilities, policies for joint review and coordination of current planning activities (eg. , subdivision approvals), and annexation policies. County staff appears comfortable with the City taking the lead position on this because of its heavy schedule in other areas. Several items deserve special attention. The Town Hall Meeting (XIV B) is required by the county. County staff will therefore take responsibility for a mass mailing or newspaper Insert notification. A Joint hearing conducted by the city and county planning commissions was felt to be very desirable in order to expedite the decision-making process. Progress reports will be sent to the City Council, Board of Commissioners, and the two planning commission after each of the meetings with the citizen committee.
