2. OATH OF OFFICE - Lynn R. Wakem
(a) Legal Counsel administered the Oath of Office to Lynn R. Wakem.
(b) Legal Counsel reaffirmed Councilman Wakem's term of office expiring
1/1/79 which was the balance of Ralph Barkhurst's term. He further stated
Councilman Wakem's appointment was made under existing City Charter &
would remain the same regardless of the outcome of proposed City Charter
being voted on in May. Council concurred.
(c) Mayor Bishop, Councilmen and staff expressed congratulations and
welcome to Councilman Wakem.

at 8:00 P.M. at Fowler Junior High School and directing staff to ask
representatives from Commonwealth Investment Corp. and the Planning
Commission to be present at said public hearing and further that copies of
the Planning Commission minutes on March 2, 1976, be supplied to the Council-

C MEMORANDUM REGARDING SUBDIVISION APPLICATION FEES
(a) Planning Director stated in response to the request of Council he had
reviewed the current subdivision fee scale and had prepared three
alternative fee scales for Council consideration. He recommended an
alternate that would reduce the large subdivision fee.
(b) Discussion with staff and Council followed and Council concluded due to
the many areas of service provided to the developer by the City, the
present fee scale was equitable.
(c) Motion, after due consideration, to continue using subdivision fee scale
presently in existence; Councilman Moore, seconded by Councilman Wakem.
Approved by unanimous vote of Council.
16. RESOLUTION No. 76-42 A RESOLUTION OF THE TIGARD CITY COUNCIL MAKING APPOINTMENTS
TO THE PLANNING COMMISSION.
(a) City Administrator stated the Selection Committee recommended the
following people for appointment to the Planning Commission:

(b) Discussion followed and Council requested in the future they receive
names and brief background information on people recommended by
Selection Committee before the regular meeting.

16.A RESOLUTION No. 76-43 A RESOLUTION OF THE TIGARD CITY COUNCIL MAKING AN APPOINTMENT
TO FILL ONE UNEXPIRED TERM ON THE TIGARD PARK BOARD.
(a) City Administrator stated the Selection Committee had recommended the
following person to the Park Board:
Kenneth Shheckla term expires 6/30/78.
(b) Motion to adopt: Councilman Cook, seconded by Councilman Moore.

21. RECEIVE AND FILE APPRAISAL REPORT SUBMISSION.
(a) City Administrator described pertinent points contained in the appraisal
and recommendations included in the letter of transmittal. He also noted
actions taken regarding fire insurance. Councilman Wakem received copy of
report for further study and indicated desire to be more involved in
insurance discussion and actions.
22. OTHER
(a) MEETINGS - City Recorder reminded Council of meetings to be attended in
the month of April.
(b) City Administrator reported the city employees had voted to disaffiliate
themselves from Local 189 Tigard Council 75, American Federation of State,
County and Municipal Employees, AFL-CIO and were now called the Tigard
Employees Association.
(c) Councilman Cook inquired about the reason for manholes below asphalt on
streets that had been overlayed. City Administrator advised that this
was caused by lack of inspection capability that existed several years ago.

Subject: Subdivision Fees
At the March 8, 1976 Council Meeting, a representative from Tualatin Development
Company, Bill McMonagle, requested that the Council consider a reduction of the
fee schedule for larger developments. lie stated that he and T.D.C. consider
the $1,800 fee required for Phase IV of their development as excessive.
In response to the request of Council that staff review this matter and report
back, the following is respectfully submitted.
ALTERNATIVES:
1. No change from Resolution No. 75-51 ($100/+$5 per lot).
2. Put a ceiling on fee schedule of $600. - this would effectively limit
the maximum fee to that for a 100 lot subdivision.
3. Establish a graduated scale - $100 + $5/lot for 1st 50 lots, #3 each for
next 100 lots, and $1 each for all over 150.
4. Establish a graduated scale with a threshold and ceiling - $100 for the
first 10 lots, plus $5/lot to a maximum of $600.
It occurs to me that a 10 lot subdivision is easy to evaluate, a 50 lot
subdivision is substantially more difficult and a 150 lot subdivision is
generally pretty complex. A 300 lot subdivision isn't much more difficult
to evaluate than a 150 lot subdivision but a 500 lot subdivision is a whole
different matter.
An evaluation of the impact of the four proposed alternatives shows the
fees that would accrue to "the applicant" for a subdivision of various sizes.

In conclusion, I recommend alternative #3 which seems to be suitably
equitable, while apparently offering enough revenue to cover the expense
of a really large subdivision. However, as a paranthetical thought,
in view of the course that Phase IV of Summerfield is taking, the
$1,800 fee may be justified in terms of the amount of staff time that is
probably going to be required.
