Barkhurst, John E. Cook, Alan W. Mickelson, Robert C. Moore; Russel Austin, Building Official; R. B. Adams, Chief of Police; Joe Bailey, Legal Counsel; Dick Bolen, Planning Director; Bruce P. Clark, City Administrator; Doris Hartig, City Recorder. 2. APPROVAL OF MINUTES: July 28, 1975 (a) Council requested item 8, subsection (b) be amended to read "Attorney Bailey ruled testimony by a member of the Planhing Commission was not appropriate; that the minutes would so indicate all of the evidence from that body". (b) Motion to approve minutes as corrected: Councilman Cook; seconded by Councilman Barkhurst. Approved by unanimous vote of Council. 3. WRITTEN COMMUNICATIONS (a) Written letter of resignation from Robert Ball. (b) Letter from L.C.D.C. setting out time periods for approving plans and processing of applications. City Administrator stated that Council will be advised of new information and progress of city's application. (c) Joint meeting of City of Tigard and Washington County Commissioners. City Administrator set Sept. 10th or 11th as tentative date for meeting to discuss property located adjacent to city limits covered under Tigard's comprehensive plan and treated in another manner by County's plan. City Administrator proposed City and Washington County Planners point out and discuss specific areas of conflict in planning. It is hoped some policy direction would result from the joint meeting. (d) Letter from Senator Mark Hatfield's representative regarding proposed community relations program. Representative would meet with cities to discuss problems and needs. It was suggested Beaverton and Tigard city councils meet at Beaverton City Hail on August 22nd, 7-9 P.M. Council requested City Administrator to express an interest in having joint meeting., 4. CALL TO AUDIENCE FOR THOSE DESIRING TO SPEAK ON NON-AGENDA ITEMS (a) Paul Warner, S. W. 72nd, requested city alleviate the rough road while S. W. Hunziker is under construction. City Administrator stated plans were to re-route through traffic while street is under construction. 5. APPROVAL OF EXPENDITURES & INVESTMENTS: $115,243.87. (a) City Administrator requested Revenue Sharing check #3234 in amount of $3,500 be deleted and the total payable be amended to read $115,243.37 (b) Motion to approve: Councilman Cook; seconded by Councilman Barkhurst. Approved by unanimous vote of Council. 6. APPROVE SUBDIVISION COMPLIANCE AGREEMENT AND AUTHORIZE EXECUTION - Scott Subdivision (a) City Administrator synopsized p::oposed subdivision and recomz?ended City approve agreement and authorize execution by Mayor and City Recorder. (b) Motion to accept and authorize execution of agreements Councilman. Cook; seconded by Councilman Barkhurst. Approved by unanimous vote of Council. 7. ACCEPT SEWER EASEMENT AND AUTHORIZE EXECUTION - J. A. & Odette A. Robertson. {a) City Administrator recommended City accept and authorize Mayor and City Recorder to execute easement on behalf of the City. (b) Motion to accept and authorize execution: Councilman Mickelson; seconded by Councilman Cook. Approved by unanimous vote of Council. 8. O.L.C.C. APPLICATIONS - P.S. City Administrator .responded Council was considering the variance request only at this time. Cross Examination - None Public Hearing Closed Discussion of testimony and facts by Council. (c) Motion by Councilman Mickelson the variance be granted to allow an 18 foot wide, oneway ingress, from S. W. Main Street: motion seconded by Councilman Cook. Approved by unanimous vote of Council. 11. TIGARD WATER DISTRICT APPEAL Councilman Barkhurst abstained from discussion and voting on appeal. (a) Continued from 7/28/75 Council meeting. (b) Public Hearing Opened. City Planner distributed copy of minutes and report by Design Review Board. City Administrator commented Council's decision is how to handle, review the reasons for denial, and determine if the Design Review Board acted improperly. (c) Public Testimony (� Appellant `.. Approved by 3-1 vote of Council. Councilman Moore voting NAY and Councilman Barkhurst abstaining. 12. (c) ORDINANCE No. 75-40 - AN ORDINA14CE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.12, GENERAL PROVISIONS, WITH RESPECT TO VISION CLEARANCE STANDARDS AT INTERSECTING STREETS AND CENTERLINE SETBACKS FOR DESIGNATED ARTERIAL AND COLLECTOR STREETS: PRESCRIBING AN EFFECTIVE DATE AND DECLARING Alt EMERGENCY. Motion to adopt: Councilman Barkhurst; seconded by Councilman Cook. (d) Discussion of facts and testimony by Council and staff. Attorney Bailey discussed section 4 (b) with respect to tree trunks and poles limited to not more than ten 1Mc4es in diameter. Legal Counsel recommended the reference to 10 inches in diameter be eliminated. Attorney Bailey also stated he would like to research the non-conforming use status and will give legal opinion at next meeting. (e) Motion by Councilman Barkhurst to table the matter; seconded by Councilman Cook. Approved by unanimous vote of Council. 13. RESOLUTION No. 75-41 - RESOLUTION OF CITY COUNCIL ACKNOWLEDGING RECEIPT OF TRIPLE MAJORITY ANNEXATION AND RECOMMEND FORWARDING TO PORTLAND METROPOLITAN AREA LOCAL GOVERNMENT BOUNDARY COMMISSION - Southern Pacific Railroad, 6'8 acres located vicinity of S. W. 72nd Ave. north from Upper Page 4 Council Minutes - August 11, 1975 Boor_es Fer.T.y Read. `. ,a) City Administrator stated the Petitioner stipulated the annexation was subject to an agreement by city staff that unwilling landowners would not be made part of the annexation. However, several other adjacent property owners have indicated to staff an interest in annexing at this time. (b) Motion by Councilman Mickelson to adopt; seconded by Councilman Cook. Approved by unanimous vote of Council. 14. CONTRACT REVISION KEARNEY BROTHERS - S. V. Hunziker L. I. D. (a) City Administrator stated there were two areas of concern and recommended a revision in the contract. The two issues of concern ares- the City bear the increased cost of asphalt due to delay in starting project and; City agrees to maintain the street during the winter months so the road will not deteriorate due to bad weather. Attorney Bailey commented Kearney Brothers would like Council to authorize the agreement be executed with the understanding there may be some minor verbage changes but they would not affect the substantive meaning of the agreement. Attorney Bailey read the agreement in full and requested Council authorize execution by Mayor, subject to the condition there will be no changes in the substantive issues and only gramatical changes. (b) Motion by Councilman Moore to authorize execution of agreement under conditions as stated by Attorney Bailey; seconded by Councilman Barkhurst. Approved by unanimous vote of Council. Council requested copy of finalized agreement. 15. OTHER-BUSINESS (a) S. W. GRANT STREET SPEED CONTROL. City Administrator reported preliminary investigation indicated there was sufficient right-of-way on S. W. Grant between S. W. Walnut and Charles F. Tigard Grade School to put in a sidewalk on one side. It was suggested S. W. Grant be widened and the centerline of the street be moved 5' east and a sidewalk with curb installed on N.W. side of street. Staff to check into problem further and report back to Council. Council and staff also discussed installation of sidewalk on S. W. Johnson. Interested parties have moved from area and City wound need further public input before proceeding on project. (b) CITIZEN INVENTORY FORMS City Administrator called attention to blank citizen inventory forms included in Council packets. (c) Site Design Review Board - Planning Coaanission Alternate Appointment City Administrator suggested the Selection Committee meet and bring back recommendation for Council consideration. (d) Citizen Liason with Tri-County Community Council. W. Wanut City staff is working on project and will have completed Tuesday. (f) S. W. 115th L.I.D. Attorney Bailey requested Council adopt an amendatory ordinance with respect to the sale of the S. W. 115th Street bonds. The proposed ordinance would correct section two of ordinance 75-31 to read: "the interest would be payable on the first days of May and November of each year". ORDINANCE No. 75-41 - AN ORDINANCE AMENDING ORDINANCE No. 75-31, CORRECTING AN ERROR IN NAMING THE DATES UPON WHICH INTEREST ON BONDS SHALL BE PAYABLE. (1) In accordance with provisions of the city charter, Attorney Bailey read ordinance 75-41 in full and twice by title. (2) Motion to adopt: Councilman Cook; seconded by Councilman Mickelson. Approved by unanimous vote of Council. (g) Councilman Moore discussed with staff and Council sidewalk improvement in area of the old post office on S. W. Main and Burnham. City staff has contacted new property owner who plans to have parking on site; landscape on S. W. Main and eliminate perpendicular parking on Main Street side of building. City Administrator suggested property owner try to work out problem and if not acceptable then city can review. (h) Mayor Bishop commented on the successful Babe Ruth tournament held in Tigard the past week. (i) Adjournment 10:35 P.
