P. Clark, City Administrator; Doris Hartig, City Recorder.
Special meeting was called by the Mayor with the common consent of the Council for the
purpose of considering adoption of an ordinance calling for a special election in regard
�.. to an initiative petition to amend the city charter.
City Recorder distributed copy of letter from Kenneth W. Scheckla requesting the title
of the initiative petition measure be amended to reads "School Proximity Property
Vehicular Traffic Limitation".
Suggested amendment discussed by Council and staff.
(a) Motion by Councilman Moore the title be amended to read School Proximity Vehicular
Traffic Limitation Measure; seconded by Councilman Cook.
Motion approved by 4-1 vote of Council; Councilman Moore voting NAY.
Mayor Bishop requested further comment regarding proposed text.
Eleanor Quimby, from audience, read letter from Attorney General Lee Johnson regarding
the constitutionality of the initiative petition. Thera were no further comments from
Council.
Council and staff discussed scheduling the date of the election. Councilman Moore stated
he intended to vote against the ordinance and Council should take this under consideration
In setting the date.
ORDINANCE No. 75-26 AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HELD ON THE 27th DAY OF
MAY, 1975, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS AN AMENDMENT
TO THE CITY CHARTER BY ADDING THERETO CHAPTER 10, SECTION 45, ENTITLED
"ZONING AND LAND PLANNING" PROPOSED BY INITIATIVE PETITION; FIXING AN
EFFECTIVE DATE AND DECLARING AN EMERGENCY.
(a) Motion by Councilman Barkhurst to adopts seconded by Councilman Nickelson.
Councilman Nickelson displayed map and discusses relevant points regarding
effect of the 750° radius limitation on land use in Tigard.
Attorney Fasano, from audience, requested station of ordinance declaring an
emergency be read.
Motion to adopt ordinance passed by 4-1 vote of Council.
Roll call of vote as follows Councilman Barkburst,AYE; Councilman Cook, AYF.; Councilman
Mickelson, AYE; Councilman Moore, NAY; Mayor Bishop, AYE.
As ordinance did not receive unanimous vote it will bo_ read second time at May 12, 1975
Council meeting.
