STUDY SESSION, APRIL 21, 1975, 8:00 P. M.
1. ROLL CALL: Present: Mayor Wilbur Bishop; Councilmen Ralph Barkhurst, John Cook,
Alan Mickelson, Robert C. Moore; R. B. Adams, Chief of
Police; Fred A. Anderson, Legal Counsel; Russel Austin,
Building Official; Dick Bolen, City Planner; Bruce P. Clark,
City Administrator; Doris Hartig, City Recorder.
2. BOY SCOUTS BUILDING DONATION FOR CITY PARK.
Mr. Hughs, representing Scout Troop number 228, stated the troop had received an
offer to donate a 12V x 13' building to be used for storage by the scouts. Mr. Hughs
requested Council allow the scouts to locate the building at Cook Park. Council and
staff discussed the location and donated building, as well as leasing arrangements.
Councilman Cook moved the City Administrator be authorized to work out arrangements,
with proper legal considerations, and space at Cook Park be granted for use by the
boy scouts; motion seconded by Councilman Barkhurst.
Approved by unanimous vote of Council.
Council requested Attorney Anderson draft a ground lease arrangement for their
consideration.
3. PARKING - VICINITY OF TIGARD HOME FURNISHINGS.
Request of Mr. & Mrs. Parker to remove two hour parking discussed by Council and staff.
It was recommended that the two hour parking for the five parking stalls in question
be changed to all day parking. Concensus of Council was to instruct staff to prepare
an ordinance for consideration at the next meeting.
4. VACANCY APPOINTMENTS.
Mayor Bishop reported selection committee has been checking out applicants and should
be ready to submit names to Council next Monday evening.
City Administrator recommended abolishing the Building Code Board of Appeals and
recommended an ordinance be prepared for next Council meeting. Councilman Cook
suggested all terms of office for each cummittee expire at one time. Councilman
Barkhurst requested list of names submitted and area of interest. Staff will prepare
and include in Council folders.
5. S. W. HUNZIKER STREET L.I.D.
City Administrator distributed sumnary sheet of bids received on the Hunziker
Street Improvement District. In evaluating the bids it was found that all bids
were acceptable however, Kearney Brothers made an error of $3.00 in computing their
bids. City Administrator stated that in light of the previously estimated cost of
$187,40%andthe total estimated cost of the project $245,131, it would be advisable
to take the matter back to the property owners and apprise them of the cost before
accepting the bid. Fred Fields, interested property owner on S. W. Hunziker Street,
agreed to coordinate meeting at his business office with interested property owners
and staff. Staff to meet and report back to Council.
6. OTHER
C-3 PROPOSED TEXT CHANGES
City Planner stated he had discussed the text changes with NPO #1 and felt the
recommended changes are adequate and will have the ordinance ready for April 28, 1975
meeting. The revisions to C-3, General Commercial zone, was synopsized by Planner.
Staff and Council discussed criteria for amendments and recommended amendments to
zoning on Pacific Highway and other commercial zones. It was suggested the Pacific
Highway area zoned C-311 applied only to newly created lots on Pacific Highway. Council
and staff also discussed the initiative petition being circulated to restrict
restaurants, d=ive-in, or other high volume traffic business within 750 feet of
public or parochial schools. Council and staff discussed definition of high
volume traffic and placing this type of business as a conditional use in C-3 zone.
Staff to prepare ordinance incorporating these changes for next Council meeting.
City Administrator reported there will be a meeting on City-County Streets and Roads
Committee Wednesday, April 23, 1975, and requested Council guidance whether the City
supported the County proposal on gas tax and serial levy. Concensus of Council was
to generally support proposal.
Councilman Cook stated the City's request for B.O.R. funds were approved in the
amount of $8,216 as submitted for City of Tigard.
Adjourned 10:30 P. M.
Executive Session.
City Administrator gave general over-view of status of negotiations with the Police
Association. Council provided City Administrator with further guidelines in respect
to future negotiations.

2. AN ORDINANCE RELATING TO THE 115th STREET LOCAL IMPROVEMENT DISTRICT.
(a) City Administrator stated that the proposed assessments were established
by Council with the exception of an $800.00 charge for driveway alteration
on the Clark property. Staff has reviewed contract and'made an on-site
inspection and it is their opinion the driveway should be reconstructed.
The City Legal Counsel was not prepared to state the City's legal position
with respect to using City funds to pay the $800.00. Staff and council
discussed construction of driveway and how to aleviate the problem.
(b) Councilman Cook moved the $$00.00 charge be removed from the L.I.D. assessment
roll and be paid by city funds; motion seconded by Councilman Barkhurst.
Approved by unanimous vote of Council.
Attorney Anderson stated the amount ($800.00) may be credited against
each assessment and if a deferred payment has been applied for, property
owners do not have to resign the application but the City can credit their
account.
f 3. TERRACE TRAIL SUBDIVISION - Authorization to execute a subdivision compliance
agreement.
(a) City Administrator commented the required bond has been posted and fees paid.
City Administrator recommended Council accept the agreement and authorize
the Mayor and City Recorder to execute.
(b) Motion by Councilman Moore to accept agreement and authorize execution;
seconded by Councilman Barkhurst.
Approved by unanimous vote of Council.
