MINUTES COUNCIL STUDY SESSION SEPTEMBER 17; '1973, 7.30 P.M. CHARLES F. TIGARD GRADE SCHOOL ADMINISTRATION OFFICE ROLL CALL: Present: Mayor Floyd H. Bergmann; Councilmen John E. Cook, Robert C. Moore, Charles L. Norton, J. Allan' Paterson, Bruce P. Clark, City Administrator; Fred A. Anderson, :City-Attorney; ,Winslow C. Brooks, City Planner; Robert Adams. Chief of Police; Doris Hartig, City Recorder. 1. FRANCHISE ORDINANCE AMENDMENT `Jim Tryon of State Industrial Accident Commission explained his position regarding' the,proposed franchise amendments. He stated the Commission would not cancel the insurance but rather the rates were `dependent on the franchisee's accidentrateexperience. if the Council chose to adopt the proposed amendments, Mr. Tryon suggested the SAIF assume responsibility for the recommended changes. Allan Paterson suggested the ordinance be amended to state "it is recommended that such a' 'can'shall not be sunken in the ground."` Carolyn Paisley,;14570 S.W. 89th asked about in- creased-costs and John Schmidt of.Schmidt's Sanitary Service stated he had no objection to picking up garbage ;from the sunken garbage cans. Council agreed 'to'adopt Frank's Sanitary recommended amendments with the correction' that "it is recommended that such container shall not be 'sunken in the ground." 2. S. W. 69th STREET VACATION City Administrator read memorandum from City Planner, Dick Bolen recommending'denial of reruested vacation. Council discussed the triangle plan and it was their opinion the re,uest was premature nd-not _in the public interest to grant the vacation at this time. 3. PACIFIC HIGHWAY LIGHTING COSTS City Administrator"reviewed memorandum regarding street lighting program and requested Council decision regarding implementation of program. Yn view of the eleetrical energy crisis and.budgetaxy problems due to sewer moratorium, Council agreed not to implement street lighting program on Highway 99W and will not curtail ex- isting 99W lighting, subdivision or neighborhood street lighting. 4. APPROVAL OF BILLS PROCEDURE City Administrator recommended copy of bills be submitted to Council for their perusal. He felt City Administrator should assume .re- sponsibility for daily routine functions of City and payment of bills under $1,000. City Attorney suggested he review Oregon State Statutes regarding proposed change in procedure and give his opinion. Council approved present plan pending City Attorney's memorandum. 5. PRIORITIES - PROJECT PROGRAMMING City Administrator read list of suggested priorities And recommend- ed Council adopt specific projects based on need, cost estimates and available funds. Councilman More stated his number one priority would be Ash Street Bridge. Council suggested City Administrator have a report ready by October 15th to assist them in establishing project program. 6. O.R.S. CHAPTER 482 - CREATION OF REGIONAL PLANNING DISTRICT City Administrator reported City;of Beaverton is holding'a public hearing September 27th. Council discussed the new'bill and re- commended staff attend public herring and make concerns of small cities known. City Administrator to contact other small cities regarding representation. 7. WOODARD PARK New lighting,for Woodard Park was reviewed, Council renuested a' change;and.staff will proceed with installation accordingly. S. ANNEXATION PETITION - S. W. PACIFIC HIGHWAY City Administrator reported he had received,additional petition and suggested Council recommend Boundary Review Commission con Sider this petition the same time as pending Highway 99W :annexa- tion. ; Councilman Paterson recommended city staff attend Boundary Review-Commission hearings when city has annexation petition on agenda. 9. BUILDING CODE ADOPTION City Administrator reported a member of City Building Code Board, John`Merrifield, is also on Advisory BoardforState of Oregon that is to prepare and adopt 7a State-wide 'building code'. City Administrator suggested staff continue to use existing building code until amend- ments have been analyzed and state code adopted. 10. SIGN CODE BOARD OF APPEALS City Administrator,proposed Council appoint 5th member to sign Code Board of Appeals. `Building Department has recommended George Penrose and Terl�Y D- McKee.` Councilman' Norton suggested Council consider Duane Hesketh. City Administrator will prepare resolution for Council consideration 9/24/73. 11. CHAPTER 739 ON CITY PLANNING City Attorney reviewed his memorandum regarding the impact of the new provisions. City Attorney recommended no action at present time. 12. NATIONAL LEAGUE OF CITIES CONFERENCE Council agreed to allot $500. from their budget to be used by no more than two council members. 13. OTHER BUSI14ESS City Administrator reported an anonymous letter containing erroneus information has been circulnted in the community regarding the Police Department. Council staff and Tigard ,Times editor reported no re- sponse or reaction from community to date. Council, st ff and city attorney agreed to wait further developments before taking any action City Administrator distributed letter addressed to City Council from Jack Murley regarding level of pay, staff position and responsibilities of Community Relations Officer. Council felt letter should have been sent through proper channels and recuested City Administrator contact Jack Murley. PAGE 2 - COUNCIL MINUTES - STUDY SESSION - SEPTEMBER 17, 1973 City Attorney discussed with council his concerns regarding the functions and duties of the Office of City Attorney. Council expressed their confidence in the city Attorney and directed him to continue to attend planning commission meetings. Councilman Paterson requested frequent reports on status of the sewer permit allocation. He also suggested that since the Metzger and Aloha plants were being; expanded the staff should inquire if the capacity of the Tigar d<pLant`could'be increased.` Councilman Paterson distributed memorandum regarding his position and comments on the.function of the Planning Commission. Councilman Norton requested the City'Administrator'write`"a memorandum regarding the current problems. They (P.G.F.) will atter,pt to hav-j their proposal back to us by September 17, 1973. If their proposal is acceptable they would proceed as crews are available. COOK PARK B.O.R. NO. 17.2 The approved Cook Park B.O.R. application covered expansion of c�:c isting facilities in the park. The "items covered under the grant and the status of each item is as follows: 1.
