TIGARD CITY COUNCIL
STUDY'SESSION
JULY 16, 1973
1. ROLL CALL: Present Mayor Daniel L. Larsen; Councilmen
Floyd H. Bergmann, John E. ;Cook, Robert C. Moore,
Charles L. Norton; Also Present: Bruce P. Clark,
City Administrator; lied A. Anderson, City
Attorney, Nick"F?iebert, Director of Public
Services , Facilities; Robert B. Adams,` Chief
of Police; Winslow C. Brooks, planner.
Meeting was duly called to order by Mayor Daniel Larsen, It
was noted that the meeting was not a'decision making session but
was open to the public.
2. POLICE PENSION PLAN - Consideration of Agent of Record
- (a) Mr'. Ralph Barkhurst and Mr. Gary Garnsey were 'present,
both of whom had previously made submission of the
Banker's Life Plan for the Police' Department Pension'
Plan. Both individuals made a separate presentation
pertaining to their capability to provide service
to the 'City if selected as Agent of Record. -Upon
conclusion of the presentations; further discussion
was held over until the other items on the agenda were
considered. -Upon resumption of consideration of :this _
matter, Council discussed the 'matter and determined
that the City';Administrator would make the selection'
of Agent of Record.
3. OPEN MEETING LAW
(a) The City Attorney verbally presented Council with his
interpretation'of `the law, noting in part that 'Council
and other legally constructed bodies must meet specific
requirements regarding notice and keeping of minutes.
Council noted the possibility of holding all sessions at
Charles F. Tigard Grade School. Mr.. Al Donnelly, of
the Tigard Times, indicated that the Times would be
running a weekly calendar of meetings of all governmental
bodies as a public service.
4. PROCEDURE FOR FILLING VACANCIES ON COUNCIL
(a) The City Attorney informed Council the proper method
for filling vacancies an Council is for the remaining
members to appoint someone to fill the remainder of the
unexpired term of the position in question. If a Council-
man were appointed Mayor by Council, then the Council
seat made vacant by that appointment would be filled
in a similar fashion.
5. PORNOGRAPHY
(a) Mr. Anderson, the City Attorney, stated that he would
try to have an opinion for Council for the next Council
meeting regarding the control by local governing
bodies of pornographic materials.
6. FOREMOST LITIGATION
(a) Mr. Anderson discussed his continuing legal efforts in
behalf of the City on this matter. Council concensus
was that Anderson continue this matter to conclusion.
7. COOK PARK FACILITIES `
(a) It was `noted that Mr. Mike Fisher had requested to use
the ".coke shack" at Cook Park during '.:own & Country
Days. Council instructed°the City Administrator to
contact Karl Hanneman, of the Park Board, and relay
that Council had no objections to the request.'
S. POLICE MONTHLY:REPORT
(a) Copies of the last month activities report had been
distributed to Council. City Administrator requested
Council hold'consideration of format andcontent for
a`month in order that administration might prepare
a one page summary sheet for its"consideration.
Council agreed to this request.
9. PARK BOARD PROPOSAL - Bond 'issue'& Building Permit Fee.
(a) City Administrator discussed opinions on proposal and
suggested he be allowed to investigate the matter
further in conjunction with the Park Board and others
of interest. Council directed Administrator to relay
Council's interest in the .subject,and to meet with
the Park Board and'research' subject and prepare
recommendations for Council.
10. TIGARD'DEVELOPMENT,CORPORATION
(a) TDC has recommended four names for appointment to a
Redevelopment Program Committee"with the request that
Council appoint three; more members. Council concensus
was that`TDC should"recommend three more persons for
its consideration at the next meeting. :.
11. OUTDOOR ADVERTISING
(a) Planning Commission recommendation was discussed for
some length of time with the result that the City
Administrator was instructed to prepare an ordinance
to be used as a basis for further. consideration.
12. ARROW HEATING ZONING FEE REFUND
(a) City Planner provided background information and
recommended that Council refund to Arrow Heating
the difference between the fee for a planned residential
development and a conditional use.
13. METZGER PARK PROPOSAL
(a) City Administrator noted that there had been some informal
discussions on the possibility of the City taking over
Metzger Park. He recommended that Council not consider
such a proposal favorably at this time. Council
concurred.
(b) In further park discussion, it was noted by the Director
of Public Services & Facilities that an 8" line was to
be installed in Cook Park with 2" meter estimated to
cost $50.00 per month. Status of the B.O.R. Grant for
Cook Park was also discussed and the stability of the
shelter house. City Administrator was instructed to
look into the latter.

14. PLANNING COMMISSION APPOINTMENTS
(a) It was noted that there were three vacancies to be
filled. A list, of persons who had expressed an
interest was,'reviewed and the City Administrator
was directed to determinetheinterest of all those
who resided within the City.
15. 115TH STREETL.I.D.
(a) Council requested information on the revised 1;method
of assessment be contained in their packets for the
next meeting.
16. BURGLARY PREVENTION PROGRAM (L.E.A.A,)
(a) Due to an apparant.`contradiction between manpower
constraints 'and;budgeted"funds, Council requested
that a special meeting of the_Budget Committee
be held.
17. INTERIM SPACE
(a) Council discussed the possibility of resolving the
interim space problem through the purchase of an
existing structure`. Councilman Moore and the City
Administrator were requested to inspect the property
and if, in their judgement, the building was suitable
for the City's purposes to secure binding rights to
purchase.
18. ,Meeting was adjourned at approximately 11:40 P.M.
