Application by Ralph J. Peters and Aloys Schulz for Conditional
Use approval to allow 3 duplexes on an R-7, Single Family
Residential parcel comprising 11 acres, located on the west side
of S.W. Tiedeman Avenue approximately 470 feet south of S.,

(a) Second reading of ordinance, continued from July 1.0,
1972 Council meeting.
(b) Steven Pope, 11825 S.W. Tiedeman questioned developer
regarding easement and sewer line. Developer Schulz
apparently does not have an easement to use sewer line
that is on Pope's land. Matter was discussed by staff
and Council, however problem will have to be solved by
property owners, City will not issue building permit
` unless public sewer is available.
(c) Motion to adopt: Councilwoman Paisley, seconded by
Councilman Moore.,
Approved by majority vote of Council present. Roll
call of vote as follows: President of,Council Bergmann,
AYE, Councilman Moore, AYE: Councilman Norton, NAY:
Councilwoman Paisley, AYE.
10. "APPROVE STIPULATION REGARDING RAILROADS AND PUBLIC UTILITY
COMMISSIONERS - S.W. MAIN STREET CROSSING
(a) City Attorney stated this was a revised agreement,
however it contained the same stipulations as previously
approved by council. Attorney Anderson stated a copy
of each previous agreement with each of the railroads
would be attached to the stipulation'. r,
(b) , Motion by Councilman Moore to authorize Mayor and City
Recorder to'sign stipulation on behalf of the city;
seconded by Councilman Norton.
