(c) Motion by Councilman Bergmann to direct the City Attorney to prepare ordinance amending the fee :in the P.D. Planned Development Zone 260.2, seconded by Councilman Norton, Approved by unanimous vote of Council. (d) Motion by Councilman Bergmann to refer Amendment to Section 280 back to staff for recommendation, including possible changes in the nuisance ordinance seconded by Councilman Moore. REQUEST FORLOADING ZONE (a) Gaffer's - S,W. 87th Avenue City Administrator stated Public Work=_ hac! made study of S.W. 87th and recommended stall #1 be excluded frcm parking, stalls 2 and 3 be limited to 15 m;nute parking, stalls 4 through 8 remain as they are in conformance to city parking ordinance. Stall 9 be no parking in conformance with state statutes requiring no parking within 25' of intersection of 99W and 87th. Administratcr recommended City Attorney be directed to prepare an ordinance amending the city traffic code. - (b) Motion by Councilman Moore to accept the recommerdatxon of the City Administratcr seconded by Councilman Norton. Approved by unanimous vote of Council, (c) Tigard Bargain House, S.W, Pacific Highway - Limited Parking &/or Loading Zone City Administrator stated staff has no recmmendation, however, School District staff and Board of Directors has submitted letter opposing the request. a Mr. Downing of the Tigard Bargain House testified for change. Council and staff discussed matter„ City Attorney stated it would be departing from general rule and would be giving preferential. treatment to the Tigard Bargain House. (d) Motion by Councilman Bergmann to instruct City Attorney to prepare an ordinance to allow two 15 minute parking stalls on the northerly curb end of the property line in front of the Charles F. APPROVE PROGRESS PAYMENTS (a) Derry Dell Sewer Improvement District - $4,500. Final Cleanup. Director of Public Works stated releases have been obtained from all property owners in Derry Devil, and recommended final, payment be approved, Motion to approve: Councilman Bergmann, seconded by Councilman Moore. Approved by unanimous vote of Council. (b) S.W. Walnut Street Improvement - Progress Payment #1 - $10,110.60. Motion to approve: Councilman Moore, seconded by Councilman Bergmann. Approved by unanimous vote of C'ouncii. (c) Sewer Treatment Plant-- Final Payment $29,565.09 City Administrator reviewed detail of costs and improvements. City Attorney suggested it might be desirable to have Stevens, Thompson and Runyan inspect plant to-see'if contract has been fulfilled, City would stilt have recourse for any engineering or design work. OTHER BUSINESS A. City Administra+.or commented City had received executed agreements for the two traft;c signals,, one for S,,W.. Main and Johnson and the other for S.W. Bull Mountain Road.. Cost of Signals to be shared 25% City and 75/ State, B. City Administrator announced he was temporarily closing the recycling station until the community has some solution to get rid of the waste, Mayor requested Administrator to discuss the problem with Mr. Bunch, C. City Attorney reported he had discussed the proposed railroad crossing contract with the officials of the two railroad companies and they are happy with the City's attitude. However, in_preparing the contracts the cost of the predictors were erroneously listed. One-half the cost of City's share with the' Southern`Pacific should be $2,700 and $8,000 City's share with the.Oregon Electric. Attorney requested;authorization to make the changes in the `.agreement. Administrator stated the referendum regarding the' $5� motor vehicle registration rincrease'puts'the City's ability to pay in jeopardy. Filing of referendum petitions opposing cigarette tax and motor vehicle registration increases: As you have probably read, the circulators of petitions with respect to these two items have successfully gathered the reauir.ed number of signatures. This action will have the effect of negating the legislation enacted by the Last :-session with respect to both the $5.00 motor vehicle registration f,e and the property tax relief provided by an increase in the cigar.ettr tax. As I understand the law, these fees cannot be collected until the outcome of the el,�ction is known. Needless to say, it will be a difficult campaign to win and in the lone, run we will probably be no better off than we have been in the past. Onr-- sometimes wonc;ers whether democracy is such a wonderful thing? It is conceivable that the govenor will have to call a special session of the legislature in order to find'a way to; recover the tremendeous loss of revenue to the .state as a result of the filing of these referendum petitions. If so, it is conceivable some alternative f revenue source for Cities could be adopted. Undoubtedly, this will cause some hardships on our future road program. Particularly with our commitment to finance the installation of gates and signals at the Main Street Railroad Crossing. 2. Supplemental Budget: Despite the loss of the motor vehicle + registration increase I will be presenting to you within the next several weeks a supplemental budget, ;the revenues of which will come from unanticipated cash carry ,overs and several other miscellaneous sources. ' a 3. Whittaker Property: Tom Whittaker has agreed to exchange a portion of his `land adjoining Woodard Park for the' assumtion' - by theCityof his sewerassessment. At this time I am having 'a legal description prepared for submission to the City Attorney in order that' he 'may prepare a contract accomplishing this goal. The land will be a directly useable addition to Woodard Park and during this budget year will be a minor outlay ;inasmuch as we would be making payment only on the Bancroft principle interest. The remaining cost could be either budgeted next year or paid over several }rears via the 'Bancroft procedure. Walnut Street: The contractor is currently about 1/3 done on the Walnut Street project, He seems to be progressing smoothly and we anticipate completion of the project on time. At your meeting Monday evening, we will have a change order to discuss that accomplishes the following: Randall Construction, the developer of the apartment complex between the Circle K store and the Willows apartments, has agreed to pay for the majority of a; storm drainage 'system that will solve our water problems on Grant Street. We have therefore, received a check from him in that amount and have requested the Walnut Street contractor to do that work. The net affect of this change order Will be a decrease in the cost to; the City of the Walnut Street project. ; Twill explain in more detail Monday evening. 7.
