PLEDGE OF ALLEGIANCE 3. APPROVAL OF MINUTES April 28, 1969 (a) Approved as submitted 4. WRITTEN COMMUNICATIONS (a) City Administrator reported Oregon State Sanitary Authority and Federal Water Pollution Control Administration have approved City's application to improve the Burnham Street Pump Station. City will request Stevens, Thompson and Runyan to proceed with plans and specifications to increase capacity of pump station. 5. APPROVAL OF BILLS $23,463.90 (a) Motion to approve: Councilman Bergmann, seconded by Councilman Larsen. Approved by unanimous vote of Council present. 6. MONTHLY REPORTS (a) Motion to approve: Councilman Larsen, seconded by Councilman Moore. Approved by unanimous vote of Council present. 7. LAMB-WESTON ANNEXATION (a) City Administrator'explained proposed;annexation of State Highway right-of-way and Lamb-Weston property would encircle the area known as Rolling, Hills. "`Council discussed annexation of this en- circled area under:.Encirclement,Statute. `Council 'instructed .- Administrator to"'prepare annexation papers, 'however, they maintain- ed -the establishedpolicy of not forcing annexations but rather let the property;owners annex voluntarily. 8. ORDINANCE No. 69-45 - AN ORDINANCE ADOPTING, RATIFYING AND CONFIRMING ALL PROCEDURES AND DETERMINATIONS HERETOFORE MADE WITH'RESPECT TO THE "O.E.A. TRUNK SEWER IMPROVE- MENT DISTRICT" AS SET FORTH -IN PRIOR ORDINANCES AND RESOLUTIONS OF THE CITY COUNCIL OF TIGARD, AND AUTHORIZING'THE`ISSUANCE'OF BONDS PERSUANT TO.THE PROVISIONS OF THE BANCROFT BONDING ACTS, AND DE- CLARING AN EMERGENCY. (a) City Administrator reported owners of 19 parcels of land, totaling $33,765.20`have =signed to pay assessment under Bancroft Bonding Act. The remaining.`property ownershave;paid in'.cash-with the`. exception of Homer Martin, who had filed a remonstrance with the City.' Mr. 'Martin objected to the assessment on the grounds his property was not within the City Limits. The Council considered the remonstrance'and denied it, because the property is benefited proportionately to the assessment. (b) ,Motion to adopt: Councilman Larsen, seconded by Councilman Bergmann. Approved by unanimous vote of Council present. OTHER BUSINESS A. City Administrator reported Lions Club has completed bridge to Woodard Park.`. Council instructed staff to prepare Resolution commending;Lions Club for their Community service. B. Councilman Moore requested status report on Dairy Queen Parking. _ Attorney stated he has been discussing problem with Mr. Adkins and ' will<report"his findings at a `later"date. C. PCity Administratorstatedstaff has been negotiating a contract with Dickinson Jam and Jelly Company for treatment of'their sewage, Treat- ment of additional sewage would take 1/3 of 1% of plant capacity. Proposed contract would includequality control of effluent. (1) Motion by Councilman Moore to direct City Administrator, Director of Public Works and City Attorney to.draw up,contract for'treatment of Dickinson Jam and Jelly;Company sewage and authorize and Mayor and City Recorder to sign on behalf of the City; seconded by Councilman Larsen, Approved by unanimous vote of Council present. page 2 Council 'Meeting,minutes > .May 12, '1969 D. Since the Leron Heights area is experiencing sewage problems, City Administrator suggested City do preliminary engineering studies. Council authorized staff to proceed. E. Administrator commented engineering work was near completion on SW 98th and Derry Dell Sewers and information as to actual cost of the project will be available for next Council Meeting. F. Bills before the State Legislature were discussed by Council.. G. Administrator reported Sgt. Murley is making satisfactory progress. H. Administrator stated City has been negotiating with King City regard- ing street sweeping. King City has agreed to pay City of Tigard $160 per month for sweeping services performed twice monthly in designated area during the months of March through November and pay the City of Tigard at the rate of $80 per month, once monthly, for months of December through February. Any additional sweeping shall be at the rate of $10 per hour and contract shall continue for one year. (1) Motion to authorize Mayor and City Recorder to sign on behalf of City: Councilman Larsen, seconded by Councilm,n Moore Approved by unanimous vote of Council present. I. Mr. Gray requested Council reconsider his request to amend his sewer contract with City. Amendment would state that when Lot 29 of Leron Heights Subdivision connected to sewer, Mr. Gray and Mr. Ames would be reimbursed in the amount of $700. Matter was discussed by Council, staff, City Attorney and Mr. Gray. Attorney Anderson stated he felt there would be an inequity of assessment of lots benefiting from sewer. Council suggested matter be referred back to staff for further study. J. Mr. Dale Wilcox, Pastorof Church_of-Latter Day Saints, ;spoke to Council regarding plans for building in Tigard. K.
