WITH RESPECT TO SECTION 4 THEREOF PRESCRIBING
NOVEMBER 6, 1968, AS THE EFFECTIVE DATE FOR
ANNEXING OF THE TERRITORY THEREIN DESCRIBED.

(a) Attorney Anderson suggested Copy of ordinance be sent to

7. 98TH STREET SEWER IMPROVEMENT DISTRICT
(a) ' City Engineer stated petition had been received requesting in-
stallation of sewer in the 98th Street area. Petition con
twined signatures of 12 families, representing 52.1% of the
total tracts, 55% oftotalacreage and 51% of total front foot-
age. City Engineer requested authorization to proceed with
engineering study preparatory to holding of public hearing for
formation of sewer improvement district.
(b) Motion by Councilman Bergmann to instruct city staff to proceed
with engineering study preparatory to formation of a sewer
improvement district. Motion seconded by Councilman Moore.
Approved by unanimous vote of Council present.
S. ORDINANCE No. 68-61 -- AN ORDINANCE AMENDING ORDINANCE No. 66-20
AS HERETOFORE AMENDED BY ADDING THERETO A NEW
SUBSECTION DESIGNATED 483.316T (4) PROHIBITING
LEFT TURN FROM PACIFIC HIGHWAY WEST INTO S.W.
87th AVENUE ANL PROHIBITING LEFT TURN UPON'
ENTERING PACIFIC HIGHWAY WEST FROM S.W. 87th
AVE. AND PRESCRIBING AN EFFECTIVE DATE.
(a) City Engineer stated State of Oregon requested City pass
ordinance prohibiting left turns in this area. By eliminating
the left turns, the storage lanes for left turns from Pacific
Highway into Main Street and the Beaverton-Tualatin Highway
could be extended. State would provide change in striping
and signing.
City Attorney mentioned sliminartng left hand turns would
increase traffic problems at S.W. Greenburg and S.W. Center St.
Mayor Ryle asked city staff to study,problem and report back.
(b) Motion to adopt ordinances Councilman Bergmann, seconded by
Councilman.Knauss.
Approved by unanimous vote of Council present.
9. AUTHORIZE PROGRESS PAYMENT PINEBROOK-BONITA SEWER
(a) City Engineer reported with the exception of some minor
clean-up work, project completed August 27, 1968.. Payment
now due $9,583.65. Total cost of the projects $52,591.50,
less 10% retained, $5,259.15 .to be paid in 30 days.
(b) Motion to authorize progress payments Councilman Knauss,
seconded by Councilman:Moore.

(b) Motion to set public hearing: Councilman Moore, seconded by
Councilman Knauss.

12. ROBERT MOORE REZONING APPEAL - 12575 S.W. Grant, Present zone R-7,
(Residential) ) Requested zone A-2 (Multiple Dwelling). Application
denied by Planning and Zoning Commission
(a) Mayor Kyle stated Mr. Moore was appealing the Planning and
Zoning Commission decision.
(b) Motion by Councilman Bergmann to set public hearing September
1 9, 1968, 8:00 P.M. Seconded by Councilman Knauss.

13.1 COOK;PARK ACCESS ROAD
(a) Mayor Kyle reported High School' District had graded and widened
load as far an Murphy's property. He further commented he had
talked with Murphys about closing rosy and at present time
barricade has been removed. Mayor stated on behalf of 'City
he would encourage County to expedite°development'of access
road into park.
14. COMPREHENSIVE LIABILITY POLICY RENEWAL
(a) Council wished to review specifications as prepared by
Attorney and set matter over until next Council meeting.
15. RESOLUTION 68-15 - AUTHORIZING AND RATIFYING LOAN FROM SEWER RE-
PLACEMENT AND EXPANSION FUND TO THE' "O.E.A. SEWER
IMPROVEMENT DISTRICT" AND PROVIDING FOR THE RE-
PAYMENT THEREOF.

16. RESOLUTION 68-16 - RECOGNIZING MERITORIOUS SERVICE OF CITY ADMIN-
ISTRATOR ROBERT K. LOGAN
(a) Motion to adopt: Councilman Bergmann, seconded by Councilman
Moore.

17. RICHARD O. FIMMEL REZONING APPEAL-14600 S.W. Hoffarber, Map 2S1 12B,
Tax Lot 1700, Present zone R-7 (Residential), Requested zone, C-4
(Commercial) Application denied by Planning and Zoning Commission
(a) Mayor Kyle read letter from Mr. Fimmel appealing decision of
Planning and Zoning Commission.
(b) Motion by Councilman Moore to set public hearing September
9, 1968, 8:00 P.M. Seconded by Councilman Knauss.

18. CAPITOL IMPROVEMENTS PROGRAM
(a) Chairman Dan Larsen of Citizen's Advisory Committee discussed
committee reports and read following resolutions:
1. Resolved: That the Citizens Advisory Committee recommend
to the Tigard City Council the adoption of the recommend-
ations of the subcommittees on Parks and Recreation,
Capital Facilities and Street Improvements.
2. Resolved: That the Citizens Advisory Committee recommend
to the.TigardCity Council to'proceed immediately to call
for an election on a Capital Improvements measure to in-
sure the sale of'bonds prior to the General'Election on
November 5,1968.
(b) Council, Attorney, and Citizens Advisory Committee chairmen
discussed improvements and possible election. Special;Council
Meeting called for Thursday,'August 29, 1968, at 7:30 P.M.
OTHER BUSINESS
I. Mavor Kyle read letter, signed by residents of S.W. Grant Street,
requesting street light be installed.
City Engineer stated installation of street light was included '
in 1968-69 street lighting program. Council'unanimously'agreed to
have street light installed immediately.

2. City Attorney presented P.G.E. contract easement with respect to
O.E.A. Sewer Project. Attorney requested Council's approval.
Motion by Councilman Moore to accept easement and authorize Mayor
and City Recorder to sign on behalf of the City; seconded by
Councilman Knauss,.
