CITY COUNCIL OF TIGARD
May 22, 1967
A Resolution was approved by unanimous vote of Council
to hold a Common Consent Meeting of the Council at City Hall
on Monday, May 29, 1967, 7:30 P.M. for the purpose of receiving
and opening the bids for the sale of City of Tigard General
Obligation Improvement Bonds:

Subject: Report on appeal for Vance R. Lee, Tax Lot 114,
"'tap 2S1 2BC, Walnut Acres, heard before the Tigard
Planning & Zoning Commission on April 12, 1967.
Planning
Zoning Action: Conditional Use was granted with the following
conditions: (1) Dedication of 5 ' right-of-way
for S.W. Walnut St. , (2) Agree to participate
in the proposed improvement district d

St., (3) Agree to conform with the proposed Mans
and drawings.
The sketch presented to the Planning & Zoning Commission showed a
single story structure,, residential in character with a single
driveway off Walnut. This would, we feel, be very compatible with
the surrounding dwellings. Increased vehicular traffic along
Walnut is making lots such as :this one less and less' attractive
for single family homes. We, therefore, recommend that the City ,
Council deny the appeal and allow this >Conditional Use on STS?.

and Zoning Commission on April 12, 1067.

Zoning Action: Conditional Use request and variance for minimum'
lot area and setbacks.
The majority of the Planning & Zoning_Commission opposed this
Conditional Use on the following grounds:
A. Proposed plan violated Section 130-4B of the ?Tanning and
Zoning Ordinance - (The side yard setback shall be' 20' feet
except when abutting or- across the street from a residential
zone, a side yard setback of 50 feet shall be required.)
B. Proposed plan violated Section 130-4D - (Offstreet Parking may
be located within any required yard except that where located
within a side or rear yard adjacent to anV residential zone,
parking shall be screened from said adjacent residential zone.
If parking is to be located within any required front yard,
the first twenty feet within said 'yard will be retained as
landscaped' area, )
The M-4 zone was designed to fill the needs of those industries
who by' the nature of their operation and site development can exist
side by side with residences. This 'zone can put to use property
in the City, which is now unsuitable for residences`yet-too near
residential neighborhoods for M-3 or M-2 zoning.
17hen this area was zoned M-4 under our new Planning & Zoning
Ordinance, many adjacent residents expressed the fear that they
would, in time, be living next to an unsightly industrial area.
They were assured that the' provisions of the Psi-4 zone would allow
only the most attractive of developments in an open, park-like
setting.
The Planning & Zoning Commission urges the denial of this appeal
on the !grounds that only by the strictest application of the 'pro-'
visions of this zone will this open, park'-like character be
realized.
