ORDINANCE An ordinance Determining the Final ,Costs of Sewer Improvements in the S.W. Pacific flighway Seger Improvement District; Daetermining,that the property benefited shall bear all of the cost of the T:nprovements; Ratifying and Adopting the Apportionment and Assessment of the Cost of the respective;Lots, Farts of Lots and Parcels of T,and viithin the Assessment District according to the `special and peculiar benefits accruing thereto from the Improvement; Spreading the Assessment; Directing the City Recorder to enter all Assessment in a separate Lien Docket of the City and Declaring same to be a lien on the rest_ �-e properties' until paid; and Declaring an Bme.rgeticy. ordinance No. 67-17 - ordinance read three times by title and number The City received threeobjections to the cost= of Sewer Improvements in the S.W. Pacific Highway Sewer Improvement District: Mr. Henning D. Severson objected Because he does not -live within the city limits of Tigard, Oregon.` Mr. John W. Setniker objected because the Contractor did not replace the soil which was removed from his property during the construction of the sewers. Attorney Anderson states that Mr. Seve4s;n°s` and Mr. Setniker°s objections were not;valid. The Tigard Community Methodist Church objected because they feel that TaxiLot #1.90 will not benefit' from the Improvement. They also stated that the property is used as a Roadway. Motion:` Councilman Fisher, Seconded by Councilman Knauss < Adopted by unanimous vote of all Council Members present. 8. ANNEXATION ORDINANCE - An Ordinance Annexing to the City of Tigard Lands of James P. McGrade et ux, ;r. H. Katterman and Charles E. Motion: Councilman Fisher, Seconded by Councilman Knauss Approved by unanimous vote of all council members present. 10. AUTHORIZATION TO CALL FOR BIDS ON ROTARY PU'Nt:R MOb°:.: (a) Hifi Opening - 4000 P.M., March 10, 1967, City Hall, Tigard, Oregon (b) Award of Bid - March 13, 1967 It was moved by Councilman Knauss, Seconded by Councilman well and unanimously carried by all Council members present that Council authorize the City Administrator to call for bids on a Rotary Power Mower. 11. ACCEPTANCE OF ANNUAL AUDIT 1965/66` (a) Motion: Councilman Well, Seconded by Councilman Fisher ' Approved by unanimous vote of all Council members present. The City Auditor recommended that the 'records of the library board should be incorporated into the overall accounting system of the City., City Attorney stated that the library records should be audited. The City Administrator recommended that a separate checking account be established for the library. It was moved by Councilman Knauss, Seconded by Councilman Fisher and unanimously carried by all Council members present that Council authorize the City Administrator to take the necessaryi action to have the library records audited in the future. (Y1111,R BUSINESS 1. The City Administrator recommended that the City enter into an agreemer.t with Farmers Inaurance Group and Georgia Pacific regarding sewer service to their properties. The estimated cost ofextending sewer service from 72nd Avenae to the Georgia Pacific an6 Farmers "insurance properties would be approximately $25,000. Two properties', which would benefit, owned by Mr. Fought and Mr. Sievers, do not:wish to participate in this project. it woul.�! however, be necessary to obtain easements from these gentlemen. The plans and specifications for construction' of the sewer would be drawn by the City of Tigard and they would be reimbursed for the expense. The Farmers Insurance Group and Georgia: Pacific would pay;the Citv of Tigard for inspection of the project, costs of obtaining rights of way and easements. Georgia Pacific and Farmers would award the construction contract subject to review by the City 'Staff.: It was moved by Councilman Well, Seconded by Councilman Knauss and unanimously approved by,all Council members present that Council authorize the City;,Administrator and City Attorney to take the necessary steps"to negotiate an agreement with Farmers Insurance and Georgia Pacific to construct a sewer lisle, providing the easements can be obtained and that proper protection be 'given the City. {` Page 4 -- 2/27/67 2.
