Ad-journment (f TICARD CITY COUNCIL MINUTES OF THE MEETING OF AUGUST 9, 1965 Present: Mayor E. C. Kyle, Councilmen E. A. Woodard; C. E. Klock, Sr.; D. W. Shinn and City Attorne,,, E F. A. Anderson The meeting was called to order at 7:40 P.M. by Mayor Kyle who opened the meeting with the pledge of allegiance. Mayor Kyle asked for corrections, additions or omissions to the minutes of the meetings of July 26, 1965, and July 27, 1965, There was one'correction on the July 26, 1965, minutes. ;The figure of 2085 for the census count was changed to 2203, still an unofficial census count. With this correction-the-minutes were then approved. Mayor Kyle stated :'..a4 Councilman Bergmann was absent because of illness. Mayor Kyle asked if there were any requests from the audience. Mr. Weber, who lives on Grant Street, registered a'complaint regarding the duplex that was moved to Grant Street at Walnut Avenue last week. Councilman Klock assured Mr. Weber that steps would be taken to have this building brought,up to Uniform Building Code standards. Councilman Woodard asked if the city had heard from Mr. McKinstry, County.Engineer, regarding Main Street. Mayor Kyle: I spoke to Mr. Nyman today, and because of their heavy work schedule it is impossible to survey Main Street within the next thirty days. His suggestion was that we should let the contract in the spring, and he has promised to survey the entire job and submit a proposal to the Council. Councilman Woodard: We received a letter from Mr. Trapp, Stevens and Thompson, Inc., regarding the suggested changes in the 'rest rooms at City Park: 1. Delete use of ;8" x 8 offset block or 8" x 8" scored 'block and substitute 8" x 16" standard block in thickness. 2. Substitute ;6" thick 8" x 16" concrete block walls for metal toilet partitions. 3. Eliminate' metal doors at men's toilet room and substitute painted plywood doors at women's toilet stalls. 4. Substitute 15 pound nailed asphalt felt base and 90 pound roll roofing mineral'surface cap sheet nailed,lapped and sealed with cold application roofing cement. 1 1 4,,e Also we need t more lights at the Park. We should contact Portland General Electric Company and have these lights installed. Mayor Kyle: S will contact Portland General Electric Company regarding the 'lights'. I might add that the Junior Chamber of Commerce constructed a 40 x 60 foot structure at the 'Park over the week-end, all volunteer labor and materials. Air King also furnished some supplies for the building. ', 8-9-65 )Page l Councilman Bergmann is absent, this evening, and we have the Insurance Program to discuss tonight. Attorney Anderson suggested that uniform specifications should be drawn up and we should ask for bids on the insurance. He pointed out that competition does result in some saving for the City. Councilman Klock: I move that we allow Councilman Beramann to contact Attorney Anderson to resolve our insurance needs. Motion seconded by Councilman Shinn." Upon call for vote the motion was unanimously approved by Council, majority members being present. Councilman Klock: In the, future one member of the Planning and Zoning Commission will attend our Council meetings. Councilman Shinn: Chief Batchelar has prepared specifications in regards to the new police car which will be selected and ordered on a competitive bid basis some time in October or November. Councilman Shinn also read the police report for;the month of July 1965. Mayor Kyle: We will now have a Public Hearing in regard to a zone change on the property located at S.W. Walnut and Brookside for Vance Lee, Tax Lot 102, and the requested zone change is from R-5 (Residential) to A-1 (Duplex) . 'Since_ there was no response the Public�l Hearing was then closed. Charles Woodard submitted a petition objecting to this zone change. Councilman Woodard: I move that we instruct the City Attorney to draft an Ordinance on this zone change. Motion seconded by Councilman Klock. Upon call for vote the motion was un- animously defeated, majority members being present. Mayor Kyle: We have another Public Hearing on opening of bids for- the surplus equipment at the Sewer Plant. ;Since there were no bids the Public Hearing was declared closed." Mayor Kyle: It is my recommendation that the 'City Council authorize the Plant Superintendent to bargain for the best' price on this equipment. Attorney Anderson suggested that the city keep a record of what equipment is sold, how much it is sold for and a receipt for the equipment. Mayor Kyle: I£ there are no objections from Council', the ' Engineer and I`will set a minimum price on the surplus equipment which is to be sold. Mayor Kyle: Our new Sewage Treatment Plant will be officially dedicated on August 28, 1965, at approximately 11:30'A.M. and the Honorable Secretary of State, Tom McCall, will be here for the decliation. All members of the Council are 8-9-65 Page 2 asked to please attend this dedication. I have a request from Mr, Harvey Prock'asking for a Taxi Franchise to 'operate a taxi in the City of Tigard. I have contacted a few of our adjacent cities to find out what is required for such a franchise. First, adequate proof of insurance and public liability 2.0, 40, 20 coverage, establish rates, and applicant must be registered owner of the vehicle. We should also run a .Police check on Mr, Prock. Councilman Klock: I move that we investigate the applicant for the Taxi Franchise, and have a report back for our next regular Council_meeting. Motion seconded by Councilman Woodard. Upon call for vote the motion was unanimously approved by Council, majority members being present. Mayor Kyle; A lawn mower is needed for the Sewer Plant as there is 35,000 square feet of lawn, and I feel that we should invest in'a mower at this time. If there are no - objections from Council, I would like to request bids for a rider type lawn mower for the Disposal Plant. Mayor Kyle: I would like to mention the 15" sewer line which is to go under the new highway near Crystal Lake, and we have been asked by the State Highway Department how we would like to handle this sewer line', whether we would want their Engineers to install rhe line or if we would prefer to have our own Engineer install the sewer line. Councilman Shinn: I think we should have our Engineer give us his recommendation before taking action on this sewer line. The Mayor and Council discussed the sewer service charges on new homes in Tigard. Councilman Woodard: I move that 'sewer service charges on new homes begin with first occupancy. Motion seconded by Councilman Klock. Upon call for 'vote the motion was' un- animously approved by Council, majority members being present. Attorney Anderson: I have prepared a draft of a proposed agreement concerning the Industrial Area for your comments; Attorney Anderson: About a'; year ago some felt that we should amend the traffic code of Tigard, and I`felt at that time that it would be best to wait, but if the Council wishes 'I would rncomnend that I be authorized to review the traffic`;code and bring it to the standards of the State Traffic Code. ° Councilman Shinn: I move that we"instruct our City Attorney to revise the Tigard Traffic Code, and bring it to ,the ,standards of;the State Traffic Code. Motion seconded by:Councilman Woodard. ' Upon 'call for vote the motion was unanimously approved by Council, majority members being present. 8-9-55 Page 3 Mayor Kvle: Mr. Meigs is not here this evening so we do not have a report on the sewer extension, Mr. Meigs has been on vacation but will be back at work tomorrow. We do not have a report on Center Street yet either. Mayor Kyle: We will now have the paying,of the bills. There is one correction under the Sewage Disposal Fund. Check 4*39 in the amount of $229,05, payable to Teeco Products, Inc., has been cancelled. The total for the Disposal Fund will now read $2,502.97 and the book balance is $16,535.86. This also changes the Total Payable figure to read $21,580.38. Councilman Woodard: I" move that we approve the paying of the bills as corrected. Motion seconded by Councilman Klock. Upon call for vote,the motion was unanimously'approved by Council, majority members being present. Charles Woodard (audience) asked about the "no parking" proposal 'for:Center Street. He asked that perhaps they might consider a 5 or 10 minute parking there. Attorney Anderson and Council discussed the stop sign on the theatre street at'length. Attorney Anderson: The stop sign that comes in by the theatre is the only sign 'I.have ever seen or heard of that stops you when you enter private property instead of stopping when you enter a<public way. It might be well to have-a stop sign to stop,people coming off the Plaza on to Center Street. I think the hazard is equally as great coming off the Plaza on to Center Streetpastthe liquor store than it is going north on the theatre street. I feel that we are creating=a possible trap there for the unwary. The law is that every one entering a public way from private property must stop and yield right of way to all traffic on the public way. People are misled into believing that it is a throughway from Highway 217 through the Plaza parking lot on past the liquor store, and they would be guilty of: violation of the State Motor Vehicle Code for not stopping at the line between the Plaza property and Center Street. They would have no chance whatever if they were involved in an accident at that point because they must yield right of way to all cars on Center Street. Mayor Kyle: We have eleven`qualified applicants for the position' of City Administrator. We should consider a few of these an interview. Also, should we make applicants and request some sort of travel arrangements for these prospects as most of them are out of state applicants.
