4; MINUTES OF MEETING MAY 10, 1965
Present: Mayor E. G. Kyle: Councilmen E. A. Woodard;
F. H. Bergmann) C. E. Klock, Sr., D. W. Shinn
and City Attorney F. A. Anderson
The meeting was called to order at 7:30 P.M. by Mayor Kyle
who,opened the meeting with the pledge of allegiance. Mayor
Kyle asked for corrections, additions or omissions .-he
minutes of the meeting3 of April 26, 1965, and May "s, 19',5.
None being offered the minutes were then approved.
Mayor,Kyle then asked if there was any correspondence to
be brought before the Council.
Mr. Cagle (audience) complained about sub-contractors doing
business in Tigard without a business license. Council
informed Mr. Cagle that steps are being taken to correct
this situation.
Councilman Woodard introduced Mr. E. N. McKinstry, Washington
County Engineer. Mr. McKinstry showed a map of Main Street,
Tigard, Oregon, and explained what could be done in regards
to width of street, curbing and sidewalks. This was discussed
by Council and Mr. McKinstry, and it was decided that the
City should plan to survey;the entire length of M,,- ,! 3treet`.
and do all the work at one time instead of doing one` alf this
year and the other half of Main Street next year.
The City has instructed Mr. McKinstry to go ahead with plans
to;survey the entirelength'`of Main Street, get an estimate
of the cost and present to the County Board to determine what
portion they will pay.
Mayor Kyle appointed a committee of Councilman,Klock, Council-
man Woodard and himself to continue the study of Main Street.
Mayor Kyles We will now have a Public Hearing on the Annexation
of°Lands-of School District #23, Washington County, Oregon, in
the Northeast Quarter of Section '1, T2S,' R1W, W.M., Washington
County, Oregon„ and directing giving of notice thereof. Since
there was no response the Public Hearing was then closed.
Mayor Kyle: We have an Ordinance 65-11, and if th4:4r� nra no
objections by Council we will have the City Recorder iead the
Ordinance three times`by title only.
The City Recorder then read.ordinance 65-11 three times by

Councilman Klock: I move that we adopt Ordinance 65•-11. Motion
seconded by Councilman Bergmann. Roll call of vote resulted
as follows: Councilman Woodard, AYE; Councilman Bergmann, AYE
Councilman Klock, AYE; Councilman Shinn, AYE; Mayor Kyle, AYE.

ANNEXATION OF A PORTION OF LOT 22'FREWING ORCHARD TRACTS,-WASH-
INGTON COUNTY, OREGON, AND DIRECTING THE GIVING OF NOTICE THEREOF,
Councilman Klock: I move that we adopt Ordinance 65-12,
Motion seconded by Councilman Woodard. Roll call of vote re-
sulted as follows2 Councilman Woodard, AYE; Councilman Berg-
mann, AYE; Councilman Klock, AYE, Councilman Shinn, AYE;
Mayor Kyle, AYE.
Councilman Bergmann: I move that we set the date for the
Public Hearing for Monday, June 14, 1965, at 8-00 P.M. in
the Council Chambers. Motion seconded by Councilman Klock.
Upon call for vote the motion was unanimously approved by
Council, ;all;members being present.
Mayor Kyle: We have an Ordinance 65-•13 Providing Prorac,.ng;
of Annual Licensing Fees, and if ther,� are no objections by,
Council we will havethe 'City Recorder read the Ordinance
three times by title only.
The City Recorder then read Ordinance 65-13 three times by
title only being an Ordinance Amending Ordinance No. 63-5
PROVIDING PRORATING OF ANNUAL LICENSING FEES FOR TRADE, SHOPS,
OCCUPATIONS, PROFESSIONS, BUSINESSES AND CALLINGS FOR THE
PURPOSE OF REGULATION ARD REVENUE.'
Councilman Woodard: I move ,that we adopt Ordinance 65-13.
Motion seconded by Councilman Bergmann. 'Roll `call of vote

Councilman Shinn: How do we become aware of new bus is s

Mayor Kyle: This is an Ordinance established by the City,
and therefore is enforceablebyour Police Department.

Mayor Kyle introduced Mr<.-tJunston, Division Manager of Portland
General EIectric Co. Mr, Dunston stated that Portland General
Electric is �-illirg to put their utility poles underground,
and will cooperate with the city in this operation. Mayor
Kyle then suggested that the gentlemen from Portland General
Electriz meet with the Beautification committee for further
study.

the Peace in Tigard for use of the Council Chambers at such
times as he might have a Jury `Prialo
l-move that we allow the Justice of the Peau
use the Council Chambers at such times as needed for Jury
Trials. Motion seconded by Counci.lmas: Klock, Upon call for
vote the motion was unanimously approved by Council, all
members being present,
Councilman Bergmann: I have a letter, from the State Board of
Census asking if we are contemplating a census enumeration.
Councilman Bergmann; I move that we ask the State Board of
Census to take a Census in the City of Tigard in June 1965,
Motion r�ieconded by Councilman Klock. Upon call for vote the
motion was unanimously approved by Council, all members
being present,
Councilman Klock discussed replacing the roof on City Hall,
and suggested that we should have a bondable type - ", and
advertise for bids. He also suggested that we mimeo. the
specifications and send out copies to the Roofing Asses ration,
and they in turn would pass out copies to all the Rooflnq
Contractors in this area.
Councilman, shinny I move that we advertise with specifications
as set forth by Councilman Klock for a bondable type roof
for City HalloSeconded by Councilman Woodard. Upon call
for vote the motion was unanimously approved by Council,
all members being present.
Councilman Klock— I would like to establish what we should
do when an emergency arises in regard to the sewer lines,
and what the Sewage Superintendent should do when he is
unable to locate, any of the Councilmen,
Attorney.Anderson„ There 'are many cases, which w"T arise
over a period of time, when the City's interest fo_
reason or another will require immediate action. It m—,Lr he
established first that an emergency dols exist'. I think
there should be an informal conference between two or. "three
of the Councilmen, and one of the Councilmen would act as
Nxecutive Officer and speak for the entire group„

Councilman Bergmax;n I might point out that the police
allocation i.n general funds will be totally used for tni.s
fiscal year. We might consider this applicant at a later
date.,
Mayor-i<yle' asked if Mr, Meigs, City Engineer, had anything
to report in regards to the Paterson Sewer;
Mr, Me gsa Mr. Paterson indicated that he, had to r rchase
an ease.meut from Mr. Greenwell and had to put in aln-
ing wall, and he seemed to think that the City shoalc,
forthis retaining wall. I do not see any logic in the
c
City's paying for this retaining wall. I hope to get a
report to Council by the middle of the week
Mr; Meigs also stated that several people had been to see
him regarding the new sewer, The area is being mapped by
Aerial Photographs, 4°he Plans for the restrooms at City
Park could not be finished by tonight, but he hopes to have
them ready by the middle of the week,
Mayor Kyle= I would :Like the Council's permission to call
a special meeting when these RestRoomPlans are available.
As you know, we had hoped to complete these rest rooms prior
to the first week in July so that we could utilize the park
facilities during the summer,
Mayor Kyles The cigarette tax was passed by the ley,_ . -ire
and will be referred to the voters in the May primaries ..
1966. This means $2018 per capita to `ehe City of Tigard,
Attorney Anderson: At the last meeting, some discussion
was held concerning the need for'procedural ,guides for the+
acquisition for public improvements. It would be possible
to have an Ordinance covering public improvements and
should 'require bids only for public improvements in excess
of $500000.
Mayor Kylez Mrs, Adams cannot serve on the Election Board
because of a conflict.- in dates. I have appointed Lita Mote
to fill this position.
Councilman Klocks I move that we appoint Mrs; Lita Mote
to the City Election Board. Motion seconded by Co' °lman
Shinn„ Upon call for vote the motion was unanimou ,.;proved

Mayor Kyles 1 would like to appoint ., John Perry, who is
an Architect, to the Planning and Zoning Com.nission to serve
outside the city limits, and Mr, Everett Severson, who is a
builder, for the position inside the'city limits.

May 11, 1965, a Budget ComAni.t;tee Meeting May 18, 1965, We
also have a City Election on May 25, 19650
