MINUTES OF MEETING JANUARY 11 1 5
Present: Mayor E. G. Kyle, Councilmen E. A. Woodard,-
F.
oodard;F. H. Bergmann, C. E. Klock, Sr.; D. W. Shinn
and City Attorney F. A. Anderson
The meeting was called to order at 7:30 P.M. by Mayor E.
A. Woodard, who then turned the meeting over to Attorney
Anderson to administer the oath of office to newly elected
Councilmen C. E. Klock, Sr., E. G. Kyle and D. W. Shinn.
Attorney Anderson requested the three new Councilmen'to
rise and then administered_to them their Oath of Office.
The meeting was turned back to Mayor Woodard who stated
the next order of business would be the election of Mayor. '
Councilman Bergmann: 'I would move that Mr. Kyle be appointed
as Mayor. Motion seconded,by Councilman Klock and upon call
for vote was unanimously approved by Council all members
being present.
Mayor Woodard then turned the meeting over to the newly
elected Mayor, E. G. Kyle.
Mayor Kyle: I-have a resolution I would like to offer to
the City'Council. Mayor Kyle then read the Resolution a
COPY of which is attached hereto and made a part of the
minutes the same as if copied herein in full.
Councilman Klock: I so move. Motion seconded by Council-
man Bergmann and upon call for vote was unanimously approved
by ,Council all membersbeing ,present.
Mayor Kyle: I have a letter for Mayor Woodard ,(Reading
letter) to convey to you the'appreciation;of the people
of the City of Tigard for your past service as exemplified
by the attached Resolution.
I have a letter of resignation to bring before the
Council. (Reading letter ofresignationfrom R.V. Symons,
City Recorder and Municipal Judge) iWhat are the wishes of
the Council?
Councilman Klock: I move we accept. Motion was seconded
by Councilman Bergmann and roll call of votes resulted as
follows: Councilman Woodard, AYE, Councilman Bergmann, AYE; -
Councilman Klock, AYE; Councilman Shinn, AYE; Mayor Kyle,
AYE.

Mayor Kyle: At this time, I would like to appoint Doris
Hartig to the position of Temporary City Recorder and would
entertain a motion. from Council.
Councilman Bergmann: I would move that we appoint Doris
Hartig Temporary City Recorder. Motion seconded by Council-
man Woodard and upon call for vote was unanimously approved
by Council.
Attorney Anderson then administered the oath of Office of
City Recorder to Doris Hartig.
Mayor Kyle - We have the selection of the President of
the Council, and this shall be selected by ballot.
Council then voted with the following number of votes
being cast: Councilman Bergmann 4 votes; Councilman Shinn
I vote.
Mayor Kyle: At this time I would like to appoint Mr. William
Poole to the office of Mun-r :pal Judge, City of Tigard.
Councilman Klock: I so move. Motion seconded by Councilman
Woodard and upon call for vote was unanimously approved by
Council all members being present.
-City Attorney Anderson then administered the oath of Office
for Municipal Judge to Mr. William Poole.
Mayor Kyle: You have all received copies of the minutes of
the previous meeting.; Are there any corrections, deletions'
or additions. if not, the minutes stand;approved as distributed. '
I would at' this'time like to'announce the Councilmen's`
assignments. Councilman Klock, Building Department Planning
and Zoning, Codes, Permits; Councilman Woodard, Roads: and
Highways, Federal state, county and city, Parks and recreation,
Storm sewers; Councilman Shinn, Public Safety, Police,
Fire, Civil Defense, Municipal Judge; Councilman Bergmann,
Administration, City Treasurer, Budget and Finance, Census
enumeration, Business'licenses, Library Board Mayor Kyle,
Public Utilities, Sanitary Department, Street Lighting,
Franchises, 'Water.
Councilman Bergmann: I move Council approves these assign-
ments. Mntion seconded by Councilman Klock and upon call
for vote was unanimously approved;by Council all members
being present.
Mayor Kyle: I believe every organization needs some type
of rules to conduct their meetings, Roberts Rules of order
seems to be the most common and if;this body sees fit to
adopt these rules I would hope that they would :accept a
loose interpretation of the rules so that this body does not
bog down in parliamentary procedure. Does the Council
have any wishes.
Councilman Klock: I move that we adopt Roberts Rules of
order as ,,governing laws of this organization. Motion
seconded by Councilman Bergmann and upon call for vote

was unanimously approved by Council all members being
present.
Mayor Kyle: cI have Ordinance 65-1 to offer to City Council
and I would like to have the City Recorder read this Ordinance
three times by title only if there is no objection by the
Council.
Ordinance 65-1 was then read by title three times being
AN ORDINANCE AMENDING AND SUPPLEMENTINGSection 21-A
PARKING REGULATIONS OF TRAFFIC ORDINANCE No. 63-15, TO
REGULATE PARKING ON THE NORTHEASTERLY SIDE OF S.W. BURNHAM
STREET NEAR THE INTERSECTION THEREOF WITH S.W. MAIN STREET.
Councilman Woodard: ;I make a motion that we accept Ordinance
65-1. Motion seconded by Councilman Klock and roll call
of votes resulted as follows: -Councilman Woodard, AYE;
Councilman Bergmann, AYE; Councilman Klock, AYE; Councilman
Shinn, 'AYE; Mayor Kyle, AYE.
Mayor Kyle:;- I will call for reports of the Councilmen.
Councilman Woodard: I have a letter from Mason's Inc.
(Reading letter) protesting dropping of dirt from trucks
on Main. Street.
Mayor Kyle: Perhaps this should be turned over to Council-
man Shinn for discussion with our Police Department in
regards to enforcing our Nuisance Ordinance. Willyou
bring back your recommendations on this.
Councilman Bergmann: I have a letter from Jack Wright and
Associates regarding our Faithful Performance,Blanket
Bond written in the 'amount of $25,000. The renewal premium
of $588. prepaid includes the three new;employees which were
added since it was written three years .ago. First year installment
$293.00; second year $176.00; third year $131.00. I would`
move that therexpenditure for the first year of $293.00 be
approved. Seconded by Councilman Klock and upon call for
vote was unanimously, approved by Council all members being
present.
Councilman Shinn: . Ii have a letter from Mr. John Baggenstos
(reading letter) regarding manner he was treated by Washington
County Sheriff. I think it would be in order to ask the
Washington County Sheriff's Office to look into this.
Mayor Kyle then declared open a public hearing on the
proposed zone change of C. F. and C.L. Kienle apts.
Since there was no response the public hearing was then
closed. '

Mayor Kyle: At this time I would like to present to Council
Ordinance 65-2 and ask the City Recorder to please read the
Ordinance by title only three times if there are no objections.
Ordinance 65-2 was then read by title three times being
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE
LANDS OF CLIVE F. `KIENLE, et uX, BEING TAX LOT 3000 1S 1
35 DC (TIGARDVILLE PARK) IN THE SW 1/4 OF THE SE 1/4 OF
SECTION 35, TOWNSHIP 1 SOUTH, RANGE 1 WEST, WILLAMETTE
MERIDIAN, IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
Councilman Woodard: I move we accept Ordinance 65-1..
Motion seconded by Councilman Klock and roll call of vote
resulted as follows; Councilman Woodard,-A"E; Councilman
Bergmann, AYE; Councilman Klock, AYE; Councilman Shinn
AYE; Mayor Kyle, AYE.
Councilman Shinn then read the Police Dept.'s report for
the month of December.
Councilman Shinn: The Council invited a Mr. Marqueline of
the Oregon Insurance Rating Bureau to a work session meeting
and he is going to request a regrading of the area of the
Tualatin Rural Fire Dist. They will evaluate just this
area and will tell us if there is any possibility of re-
grading this district as to insurance needs, fire protection,
etc. I move we request the evaluation of the Oregon
Insurance Rating,Bureau as soon as feasible. Motion seconded
by Councilman Klock and upon call for vote motion was
unanimously approved by Council all members being presented.
Councilman Shinn reported a Civil:.Defense Conference .
to be held at Hillsboro January 16th, starting at 9:00 A.M.
Mayor Kyle: I would like to appoint a Committee of Council-
men Bergmann, Woodard and Shinn to bring before the Council"
the best applicants for the,position Of City Recorder at
the earliest possible convenience.'
I have received very thorough report from Mr. Meigs;
of Stevens and Thompson, including Mr. Ferguson's observations
of;the flooding effect and heavy rains December 20th through
27th and;also his recommendations to alleviate this situation.
I would like to appoint a Committee of the Council to study
these reports and bring back their recommendations. I would
like to appoint Councilmen Klock, Woodard and myself to
serve on this Committee.
I have a letter of resignation (reading letter) from
Mr. C. E.'Janos, Chairman of Tigard Beautification Committee.
Councilman Klock: I move we accept. Seconded by Councilman

Mayor Kyle; I have a proposal from the Portland General
Electric Co. I would like to present to the Council at this
time (reading letter regarding upgrading and modernizing
Tigard Street Lighting Program)
Councilman Klock: I move we accept the proposal as pre-
sented by the Portland General Electric Co. Seconded by
Councilman Shinn and upon call for vote motion was unanimously
approved by Council all members being present.
Mr. R.P. Chvatal,-Auditor, presented his report and suggested
after Council had time to review it he would like to coo
over some of the details.
Attorney Anderson: I would like to report on the proposed
road dedication in the'Hunziker area. We have a petition
for annexation for that part of the road which was"not pre-
viously in the City of Tigard so that it will come under
the jurisdiction of the City. (showing map)
In connection with the Poulin Annexation I had the
County surveyor prepare a legal',description that we could
use. The next step will be to get a certificatefrom the
County Assessor as to h-.ving two-thirds of the assessed
value and another requirement is that we officially'have
two-thirds of the owners signed or more. I wonder if you
would feel that I could incur: an expensetohave this run
r by a title company so that when:we do it there are no
possible gaps in the procedure. I feel that we should have
some official certificate of that fact.
Councilman Klock: I-move we appropriate enough money to
have the title company survey these plot plans the amount
not to exceed $150.00. Seconded by Councilman Woodard and
upon call for vote was unanimously approved by Council all
members being present.
Attorney Anderson: I have on a number of occasions appeared
on behalf of the City as.Prosecuting Attorney;on traffic
cases. That has been without any mandate from the Council.'
There are a number ofoccasions when the City should be
represented by;Counsel on traffic matters. I would like
authority or direction to appear when I :think it is necessary.
I feel I'would be in a position to judge when that should
be done and I would like your instructions.
Councilman Klock: I move that we endow Mr. Anderson the
authority to appear before the City Court when he deems
necessary. Seconded by Councilman "Bergmann and upon``call
for vote ;motion was unanimously approved by Council all
members being present.
Councilman-Treasurer Bergmann read the bills.

Councilman Klock: I have one more bill from the Office of
County surveyor for $25.00 that should be added to the
bills.
Councilman Bergmann: I move we approve the expenditures.
Motion seconded by Councilman Klock and upon call for vote
was unanimously approved all Council members present.
Mayor Kyle: At this time I would entertain a motion that
the remaining $600.00 under personal services budget under
Administrative Department be transferred to Councilmen's
expense and that the Mayor now be compensated at the same
rate as the Councilmen.
Councilman Klock: I so move. Motion seconded by Council-
man Bergmann and upon call for vote was unanimously approved
by Council all members being present.
Mayor Kyle announced that Council will meet with the Tigard
Water Board on January 12th and the Housing Home Finance
Agency January 18, 1565.
Councilman Klock: I move we adjourn. Motion seconded by
Councilman Bergmann and unanimously approved by Council.
