MINUTES OF MEETING,' OCTOBER 12 1964

F. H. Bergmann; C. E. Klock, Sr, and City
Attorney F. A. Anderson.
Mayor Woodard called the meeting to order at 7:30 P.M. and
requested reading of the minutes of the meeting of September
28, 1964, which were then read and upon call for omissions
or corrections Councilman Bergmann raised a question with
respect to a`motion which question was'answered by Mayor
Woodard and the minutes were then ordered approved as read.
Mayor Woodard: I checked with Mr. Brandon and this $34,834.00
is the replacement cost, so that figure was correct. We
also checked up on the equipment in City Hall, it was slightly
over $4,000.00. We insured for $4,000.00. We insured the
library books at $2,000.00; the books to replace would cost
much more than that figure.
On the interceptor sewer, it is completed now and I
brought Mr._Meigs ,here to give us the data on
Mr. G. R. Meigs: I have a letter of recommendation to
the City Council, that is here and together with it is the
final estimate of the interceptor sewer contract.
i would like to talk the job over a Tittle bit before
giving these out (referring to letter and sewer maps) and
begin with some comments from this letter.
We feel that the job has been completed in accordance`
with the plans and specifications and we recommend you
accept the job. The,work was completed;on the 5th of October
well within the time of 180 days ;from sometime in July.
The final estimate is $92,155.49 and this amount includes
all monies due the contractor and it is $1,720.26 less-than
the bid price. Thiswasa unit price contract and as it
worked out some of the quantities we provided for in the bid
price-were not needed, principally gravel. We anticipa.tedl
it might be a wet job and it turned o..t-'to be a nice job and
the quick sand problem never did develop, to everybody's
delight and surprise.
Now there are technicalities involved; the amount now
due is a little over eleven' thousand dollars. ' You will still
have about $9,215.55 ;that is due the contractor and this is
the ten per-cent retainage;'the City has to retain for 30 days
after you accept the job which is to serve as a lien fund.
I don't know of any but never-the-less you are required to
hold this money back for 30 days and unless something goes
wrong you automatically pay;them:that amount ;due.

We made some changes the Burnham Street pumping station
is still, standing; originally it was scheduled to be torn down.
When the time came it was suggested it could be used as a
store house for certain'City_functions. As long as there was
no room at the plant we decided it would be a good idea and
he gave us a credit of $100.00 for that. In return we had to
pay him for couple of flanges to seal off piping leaving
the pumping station so the net amount was, we had two extras
on the job, one for $1500.00 for grouting the tunnel under
the highway, we filled with sand and gravel, that is we had
the contractor fill it. The other extra was for $5.20 for
putting a wye'in for Howe Lee.
The Ash Strer,t interceptor is not eligiblefor Federal
participation. The cost is $8,140.05. We have included an
appendix to;the letter giving a total cost so the Government
can determine how much they will allow. The eligible portion
of the project amounts to $84,015.44.
The sewer is in operation. We have rented a pump and
are pumping with this temporary pump out of the plant. When
the plant is completed we will no longer need that temporary
PUMP
The Ash Street line has not been put into operation.
The sewers up in Jim Willock's sub-division have not been
tested in their entirety. We have a concrete plug in that
line so there will be no flow from his line.
Overall, we have enjoyed working on this project, we
have had excellent cooperation with the contractor. We
also feel he has been very cooperative with the people who
granted easements; in many cases he has done more than he
has been required to do .to restore property to its 'original
condition.
I think this closes the job; there are as-built plans
on Mr. 'Symons" desk'. Mr. Symons has been finally advised'.
concerning the cost of the Ash Street,line.
The interceptor job has a one year *yarranty for work-
manship and material, from the day you accept the job. It
has not been accepted yet, you have to-do that and as I said
earlier we recommend the City accept the job. Are.there any
questions.
Mayor Woodard: All the easements have been taken care of?
Mr. Meigs: 'Ve feel they have and we told the contractor if
he wants to leave the job;he can.
The entire project was tested for.leakage, some leaks
were detected and the leaks were repaired. You have a grade
A sewer line. + We specified grade A material, the workmanship
has been good and I 'think'you have something you can expand
on. We hope it will be trouble free and as far as the engineer
` and the contractor are concerned we think they have done as
good a job as they can.

Attorney Anderson: If you feel the recommendation should be
carried out you should do so.
Mavor Woodard: 'I would like to have a motion from Council to
E` accept the job on the engineer's recommendation.
Councilman Bergmann: I move we inform the contractor we
accept the job. (Attorney Anderson advised the motion should
include "andthat a letter'should be written to him accepting
it and the letter should state subject to,the warranty period").
Motionseconded by Councilman Klock and upon call for -ote
was unanimously approved by Council all members being present.
Mayor Woodard suggested that Attorney Anderson should`
write the letter to the contractor.
Mayor Woodard (addressing Mr. Meigs) what further information
do you have on the Paterson' job?
Mr.' Meigs: I have not been in contact with them since a week
ago Friday so I don't know the present situation.
Mayor Woodard: ' I understand they got on some terms, maybe to
put in a retaining wall as'suggested. Paterson told me every-
thing was now taken care of so I guess we are all set there.
Mr. Meigs: My feeling is, while I am supposed to advise the
City"on 'engineering, in a case like this, the preparing and
detailing plans, that is more of Mr. Mohr's problem than mine,
he hasn't called to say he needed help so I havn't offered
any.
Mayor Woodard: I believe we should have our engineer start
and check it according city's specification.
A lengthy discussion followed with questions directed to
Mr. Meigs by Attorney`Anderson with respect to the possibility
of blocking or dammigg the creek by reason of the pipe crossing.
Mayor Woodard and City Attorney Anderson expressed their
thanks to Mr. Meigs.
Mayor Woodard: - The next item is the zone change for 'Stan
Adkins - Builder (reading fetter from Planning and Zoning
Commission) .
Councilman Klock: You can have "office space" in bight
Manufacturing or you can step down to where they are only
classed as C-2.'
Attorney Anderson: You can have lesser,` I do not b3lieve you
, . can have a commercial independent of the,industrial use. The
office for the'industrial use would be the lowest class.

Councilman Klock: I would move we accept the Planning and
zoning Commission's recommendation for the zons 'change. Motion
seconded by Councilman Bergmann. Upon call for vote the
motion was unanimously approved all Council members being
present.
Mayor Woodard: Does anyone in the audience have anything to
bring up?
Owen Snyder: _I have the Vance Lee project ready for inspection.
I would like to have the blacktopinspected as soon as possible.
Mayor Woodard: I want to talk about this Ash Street project.
I had the engineer, Mr. Allison, down there and he looked
over the situation all the way from the County Road down to
the creek. He said he would not be able to get any action
on the money for next year, it would have to be the following
year; so the deal is that we put in for it, for $20,000.00,
they furnish the engineer, draw up the plans and they also
make up the specifications free of charge and they turn that
over to us and then we can contract it to whomever we t_hin;C
best. They thought the State could do it cheaper. If they
see we mean business they will send their engineers down here
during the flood stage to see how high the water is and figure
out on the plans how high the bridge would be built. As
far as the road money is concerned, we can do that on our own
to show our good intentions, giving the office up there the
idea we mean business and we don't need any approval to set
aside funds for the road.
Councilman Bergmann: Under what plan do we get it?
Mayor Woodard: They are allowed $250,000.00 a year;and give
$20,000.00 to;cities under;5,000. That fund is strictly for
that purpose.
Councilman Klock: What place could we use this $20,000.00.
Mayor Woodard: Roads or bridges'.
Councilman Bergmann:' I would like to make sure this is the
most logical place to use this $20,000.00.
Mayor Woodard: He thinks it would be the best place; it
would hold a lot of traffic off ,the highway that wants to
come to Tigard, also to take the traffic off the southeast
section to come that way.
Councilman Bergmann: $20,000.00 would do a lot to straighteh
Y up Main Street.

Mayor Woodard: We wouldn't take the road over unless they
bring it up to standard in the first place.
Councilman Klock: I think something as important as this, I
would prefer to hold that in obeyance until we get a full
Council.
Councilman Bergmann: There are possibly other things we
might use that for; we apparently do have time since it is
next year's money.
Mayor Woodard: Mr. Gass is willing to put some money in
that road, he is figuring on using that ground down to the
creek.
Councilman Bergmann: We havn't had anybody look into the
Road Dept. since Dr. Johnson resigned.
Mayor Woodard: I have been looking after the roads since
Dr. Johnson resigned.
Councilman Klock: Mr. Gass is going to put in some money,
how much is he going to put in, how much is the City going
to put in; I think these figures should be down in black
and white.
* Mavor Woodard: Don't get the idea that we would have to
accept; the figure should be put in so that when the time
comes we can get that money if we want it. We figure the
street would cost us, up to Brewing, up to $6,000.00; we
are not doing it that far,', Willock is doing;it; as far as
Gass' property is concerned, he is going to do the high ground.
This is, just to get the road. We don't have :to accept it
we can go ahead and file. We are now filling in Ash Street.
Councilman Cooper: `I am one who thinks this bridge;would
be an asset. I will move ;that we request the $20,000.00 from
the State for this project'.
Mr. Ben;Brazauski: I am representing the Planning Commission.
It is the suggestion of the Planning.Commission that it is a
definite need to get this bridge in and we highly recommend
that the City,put in for it.
Mayor Woodard: The bridge would cost in the neighborhood of
$17,000.00
Mayor Woodard then spoke about having Mr. Allison, Field
Engineer, for the State Highway Department, look at Center-
Street on the basis of the possibility of doing away with
the right-hand turn from Greenburg Road onto Main Street and
the left-hand turn from Main Street onto Greenburg Road.

Putting Center Street through to Commercial can be done at
very little expense since the'State owns most of the property.
Councilman Bergmann: What part would be our responsibility.
Mayor Woodard: None, because this isStateproperty.
Councilman Klock: Wouldn't it be advisable to have the merchants
that are`etffected to come into the picture.
Mayor Woodard: - The merchants have been talking about it.
The status of the .,Paterson contract was questioned and
-`Attorney Anderson told Council the engineers reviewed the
contract and have made some corrections and the contract is
to be rewritten to include inspection and storm drains and
etc', not to be included in the sewer.
Mayor Woodard:- The cost to the City is going to be the
differ nce between 18 inch and 24 inch pipe to the City Limits
at the 8 property and that amounts to between $2800.00
and $3,200.00, and then that portion will be City sewer.
The 24 inch line will be City property if we pay the difference.
That will be a very cheap line. I would like to have the
Council pass on this allowing us to pay this difference on
this pipe and we accept that part of the 24 inch sewer.
Councilman Cooper: ' I will move the City pay the difference
between 18 inch and 24 inch sewer pipe on the Paterson sewer
and that all easements, rights-of-way and rights in that pipe
line be transferred to the City in consideration of the pay-
ment. Motion seconded by,Councilman Klock. ;Upon call for
vote the motion was unanimously :passed by Council all members
being present.
Attorney 'Anderson: As you know the regular election, ff"ational,
occurs in Oregon on the 3rd of November,'being' the 'first
Tuesday 'after the first Monday and our Charter provides that
.,regular City elections shall be held at the same times and
places as bienr&l general state elections' in accordance with
applicable state election laws". I suggest the following
resolution, which I will now state, be'passed: ` "BE 'IT
RESOLVED by the Council of the CITY OF TIGARD, OREGON: that
the general election scheduled within the City;of Tigard and
elsewhere throughout the State of 'Oregon for November 3, 1964,
be, and the same is hereby, designated, confirmed and ralhfied
as a, general election whereat three Councilmen for the City;
of Tigard shall be elected - the two receiving the highest
number of votes shall hold office for four years, and the
remaining one shall hold office for two years - and whose
terms of office shall begin at the first Council meeting in
the year 196 .

That the City Recorder he, and he is hereby, authorized and
directed to cause to be published in one issue of the Tigard
Times, a newspaper of general circulation within the City of
Tigard, Oregon, within twenty days immediately prior to
November 3,'1964, and the City Recorder is further directed
to give notice of the election within the City of November 3,
1964, and of the candidacies being submitted tothevoters and
by posting notice thereof, one within each voting precinct
within the City of Tigard as established by the County clerk
of Washington County, Oregon, not less than ten days prior
to November 3 1964, and by publishing said notice once each
week for two consecutive weeks, the first publication to be
not less than ten days prior to the date of said election.
That the City Attorney be, and he is hereby, authorized and
'directed to cause to have prepared an official ballot with
respect to the candidacies to be voted upon at the election
of November'3,' 1964, and the City Recorder be, andheis hereby,
directed to cause to have a sufficient number of ballots
printed and to cause to have published in one issue of the
Tigard Times not later than the fourth day, nor earlier than
the 15th day,;prior to November 3, 1964, a facimile of a
sample ballot conforming to the official ballot except as to
size, color, and labelled "SAMPLE BALLOT", and that the City
Recorder and the City Attorney are authorized to take all
other necessary steps to provide that the election shall be
held asthelaw requires.
Councilman Klock: I`will move that that takes place. motion
seconded by Councilman Bergmann. Upon call for tote the_motion
was unanimously approved by. Council all members being present.
Mayor Woodard advised that he had received certain data with
respect to taxi cab franchises and license which he referred
to; Councilman Beramann. It was decided to goiover this
matter further and upon Ccuncilman Klock's discussion with
City Attorney Anderson the motion was made by Councilman
Klock to grant the license and tell the applicant the franchise
would be forth-coming and the City Attorney would prepare the
franchise for the applicant's signature. Motion seconded by
Councilman Bergmann. Upon call for vote the motion.was un-
animously approved by Council all members being present.

Mayor Woodard then requesteiJi Councilman whether they
had anything to bring before the Council.
Councilman Klock: Nothing.
Councilman Cooper: .:Nothing.
Councilman Bergmann: 'Nothing.

Mayor Woodard: We will pay the bills.
Councilman-Treasurer Cooper then read the bills after which
Councilman Cooper moved we accept and nay the bills," Motion
seconded by Councilman Bergmann and upon call for vote the
motion was unanimously carried,all Council members being
present.
Councilman Klock: I'move we adjourn. Motion seconded by
Councilman Bergmann and unanimously approved by Council.
