The meeting ,aas called to order by A^.avor Woodai.d at 7:30 P.M.
The purpose of this meeting was to receive the retort:. of
Attornev Anderson and Mr. Meigs with ropect. to t;7e j:osition
of the interceptor sewercontract.
Attornev Anderson reported on the situation and
indicated no problem would be encountered on the Federal
Grant if it were necessary to resolicite bids. Nor woul(?
there be any difficulty in the event it should be necessary
to break it down,into two contracts, one for the Ash Street,
job andone for the Federal );;articipation in order to get
the Ash Street,job under way b_y August first.
Attorney Anderson further detailed the legal position
in connection with awardincj the contract to the second -
low bidder and inquired from Mr. Meigs if there were any
posisibility at all that a rebidding would result in lower
prices. Mr. Meigs stated he wouldn't think so on this
basis, that in the spring the general contractors were
looking for work but now a great majority have work.
There was further discussion on the legal position and
justification for developing with the second low bidder
as to whether or not he would accept the contract.
Attorney Anderson and Mr.' PMeigs went into this matter
quite thoroughly, after which the following motion was
made:
Councilman Johnson: I move we instruct Attorney Anderson
and Mr. Meigs to (let the final answer from Mr. Matthews,
the loin bidder and that if that answer is negative that
Attornev Anderson see that if he can find justification
for us; awarding the bid to the second lowest bidder; if
the justification does appear to award the contract to
the second low bidder, the Mayor can go ahead and 'submit-
the matter to the <Federal Government. Motion seconded
by Councilman Klock and 'upon call for vote the motion
was unanimously approved by Council, all members being
>present.
Councilman Johnson: I move we adjourn. PSotion seconded
b.r Mayor Woodard and unanimously approved by Council.
