MINUTES OF MEETING_SEPTEMBER 23, 1963.
Present: Mayor E. A. Woodard; Councilmen F. J. Cooper;
F. H. Bergmann; N.E. Johnson; C.E.`Klock and
Attorney F. A. Anderson.:

Meetino called to order at 7:30 P. M. by Mayor E. A. Woodard
who then called for reading of the Minutes of the Meeting of
September 9, 1963. The Minutes were then read and upon call
by Mayor Woodard for corrections or ommissions, none being
heard, the Minutes were ordered approved as read.
Mayor Woodard: We were talkingtoday'about the purchase of the
police car and got the information from Mr. Ball that our
request for bids to be submitted by September 25th would be
the ending of the 1963 prices and the beginning of the 1964.
In view of this we have asked the, prospective bicders to submit
bids on a 1964, car instead of 1963, so we will take a little
longer to get the car.
Mr. John Ryan, of Tarbell Communications addressed Council and
requested permission to speak about the radio specifications
to be prepared by Attorney Anderson. Mr. Ryan and Attorney
Anderson then discussed, for a short time, various features
which might be embodied in the specifications to be submitted
to various firms for bidding on the two-way police radio to
be 'installed'in the police car. No action required to be
taken by Council.
Mayor Woodard: We will proceed now to Councilman Bergmann
on;police; we have to discuss the salary tonight, we have
never set the salary.
Councilman Bergmann discussed the figures talked about at
the times of the interviews and moved "I would move we establish
the Acting Chief of Police pay at $4.00.00 per month".
There was no second to this motion but a review of various
matters that had been discussed with respect to pay and pay
periods, during which Councilman,Klock:asked "This would be ;
during a probationary period there` should be a`date when
it is going to be increased." Councilman;Bergmann replied
"there is a six month probationary period."
Following the discussion, Councilman Bergmann then stated;
"I would'move that the salary be 'established at $400.00 for
the first six months." Motion seconded by Councilman`
Johnson and upon call for vote was unanimously approved by
Council, all members being present.
Councilman Johnson: Councilman Cooper, on this radio'equipment
that you,brought,up, what was the figure? Councilman Cooper
replied "$785.00 installed." Councilman Johnson: This is a
used set in good condition; it might be Just as well to have :one.
Councilman Cooper: Another thing, this is an 80 watt: output.
Councilman Bergmann: In regard to;the telephone with;Beaverton;
t it is ready to be put in at any time, the Telephone Company said
two days would be sufficient`notification. That would be an
Ml number;for day hours we would use the City Hall. The bill
is $21.05 per month plus a-few cents a month for the addition
of 'phones on their board, plus 10i per call for transmissions.
Mayor Woodard stated this should be done as soon as the officer
is ready to operate, stating; "i understand he can't do anything
now-

Councilman Bergmann:- Mr. Batchelar has requested some index
cards and card files which will amounttoa sum not exceeding
$20.00 and requests approval by Council. I would move that
we approve the purchase. _ Motion seconded by Councilman Klock.
Mayor Woodard Any small item should not require the approval
of Council as long as the Councilman gets an order number from
the Recorder.
Councilman Bergmann: I will withdraw the motion If Councilman
Klock agrees. (The motion was withdrawn.)
Councilman Bergmann One question; have we applied for the
mobile license?
Councilman Cooper: Request has been made for the license from
the Federal Communications Commission.
Councilman Bergmann: We have checked over the list of Business
Licenses; there are fifteen or twenty that have ,not come in. We
may have to.prepare a form letter to be sent out
Councilman Cooper: I would like to let It be known the Library
Committee is going to have a meeting next Monday, the 30th.
Councilman Cooper advised Council with respect to his efforts
in connection with securing a flag pole and suggested the matter
be held in abeyance until our next meeting and then perhaps take
some action. He also discussed with Attorney Anderson a complaint
he had received with respect to a private swimming pool tank
and it was decided Attorney Anderson should search the legal
aspect and advise subsequently.
Councilman Klock: In regard to the Hess case, that is the Lone
Oak Restaurant; it was turned over to the Planning Commission
because of the variance he had to have on his parking restrictions
and he has been informed of_anything he has to do to bring in
to:the -Planning`<Commission. '
Mayor Woodard: Councilman Johnson, do you have anything to bring
before Council?.
Councilman Johnson: I have two letters from the State; rather than
reading them I will give you the gist of;whatthey contain. (At
this time Councilman Johnson gave a resume of the two 'letters, one
being from the Division Engineer, Mr. A.E. Johnson dated September'
11th and :the other from Mr. F. B. Crandall, Secretary of the
State Speed Control Board. In connection with 'traffic signal
installations, the cost would have to be,shared-50-50`between
the;Highway Department: and the City involved and the City would
have to pay for the power consumption and future maintenance`.
In the case of the request for speed control to 25 MPH through
Tigard, this matter would be considered by the State Speed
Control Board at their meeting on October 17th, after:which the
City would be advised.)
Councilman Johnson also reported some street signs down.
After some discussion on the ;letter. from the State on the light
Mayor Woodard advised this matter should be checked and requested
if Counoiiman Johnson would check into the costs. Councilman
Johnson advised he would endeavor ,to do so.

cpuneiiman Johnson questionedAttorney Anderson with respect to
the City's right to request removal of a tall hedge on a corner
property. The hedge blocks the view of the street intersection
unless a car Is pulled completely out into the roadway and Attorney
Anderson suggested under the Nuisance'Ordinance'there is a provision
where ;it isaffectingsafety the City has the right to request it
be removed or brought into a safe condition.
Councilman Johnson also questioned in connection with telephone
poles, what right does theCityhave and Attorney Anderson felt
that under our franchise with the West Coast Telephone Company,
we can ask the Utility to move their poles.
Councilman Cooper advised the stop sign on Watkins Avenue, going
into Walnut, has been pulled up and is 18" higher than it should be.
Mayor Woodard: The Plaza has contacted me askina what we can
do about putting two stop signs at the intersection of 87th and
Center. We figured we would get steel poles and the stop signs
and they are willing to pay half the cost. The only sign now
is a`painted "Stop"' sign on the street on 87th and not too much
attention is paid to this sign. Placing stop signs there would
be all right since they would be placed on their property. (No -
action required by Council)
Councilman Johnson: Without the authorization from City Council
I requested some "Children at Play" signs. This was suggested
to me by several of the mothers around here for some of these
arterial streets. Not only do we have ou R speed limit signs but
it might be well to put up "Childred at Play" signs .to cut down
the speed. If we had that type sign up I feel it is,well;worth
while whatever it costs us.
Mayor Woodard: We have a Zone Change and 'letter from the
President of the Tigard Planning and Zoning Commission in re-
spect to' the`Cascade Motor Villa in which the Commission recom-
mends no Zone Change but does recommend an expansion under the
Non-Conforming Use to permit the placement of six additional
trailers. (Reading the letter) -i would like to hear a motion
from Council to accept this recommendation.
Councilman Klock: I make a motion that we accept the recom-,
mendatfon as read. ;Motion seconded by Councilman 'Johnson.
Upon call for'vote the motion was unanimously;approved by Council,
all members 'being `present.

Mayor Woodard: We have a"memorandum here from our Attorney
with respect to the procedure for change of zone. (Reading the
memorandum from Attorney Anderson) ISdo wish to ask the City
Council to amend our Planning and Zoning Codeto read "The
planning 'and 'Zoning Commission of Tigard" instead of the
"City of Tigard Planning and Zoning Commission".
Attorney Anderson: The way it was written, the City Council
would act in-rthe .initial instance as the planning ;body, it
would 'then act again as the City Council.
The Ordinance changed the wording to Planning Commission.
This Code does require that the`<Council have a hearing too in
the instance lin which I mention It here and if you don't hold
a hearing it :isn't legal. 'You have to 'change the zoning code
and you have to hold a hearing.
Councilman Klock: We are making the work of the Planning and
Zoning Commission legal?
