SOLUTION NO. 09-
A RESOLUTION DEDICATING 1 MILLION TO ACQUIRE THE SUMMER CREED PROPERTY",
LOCALLY KNOWN AS THE "FOWLER PROPERTY," AND AUTHORIZING THE CITY
MANAGER TO ENTER INTO A PURCHASE AND SALE AGREEMENT
WHEREAS,the City of'Tigard.recognizes the need to acquire additional park land and green spaces and has
been actively pursuing such purchases;and
EREAS,the 44-acre Summer Creep property ranlied high on the City's acquisition list;and:
WHEREAS, the property is owned by the Tigard-Tualatin School District (TTSD) and has been offered for
sale;and
WHEREAS, the property contains wetlands, mature Western Ponderosa Pine forest, open ball fields and two
perennial streams;and
WHE RE,AS, the Fanno Greenway Regional Trail enters the property near the intersection of Tigard Street and
Tiedernan Avenue providing access to'pedestrians and cyclists;and
WHEREAS, the Trust for Public Land (IPL) is a nationally-recognized, non-profit, land conservation
organization that helps local jurisdictions fund and acquire natural open space and park land;and.
WHE E" S,the TPL has an exclusive option to purchase the Summer Creek property;and
WHEREAS,an appraisal suggests the property is worth approximately$5.5 million and
WHEREAS, the Summer Creek property purchase may be conducted as a single- or multi-phase transaction;
and
WHEREAS, the TPL is working with the City to acquire the property by assembling a combination of public
funding sources from Metro, the Oregon State Parks and Recreation Department, the Oregon Water
Enhancement Board,Washington County and Clean Water Services;and
WHEREAS,the City wishes to contribute to the purchase and preset vation of this valuable regional resource.
NOW,THEREFORE,BE IT RESOLVCD'by the Tigard City Council that:
SECTION 1, The Tigard City Council dedicates $1 million to the acquisition of the Summer Creek
property for the purpose of creating publically-owned park Land and open space.
SECTION 2: The Tigard City Council authorizes the: City Manager to enter into a purchase and sale
agreement with the TPL in order to acquire the Summer Creek property.
SECTION 3: The Tigard.City Council acknowledges the City is the Intended Future Owner of the Summer
Creek property.
