Resolution No. 08-51 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL RESOLUTION NO. O8,57 A RESOLUTION OF THE CITY COUNCIL AMENDING RESOLUTION NO. 08-06 TO AUTHORIZE THE CITY MANAGER TO PROCEED WITH ACQUISITION OF ALL PROPERTIES, INCLUDING THOSE VALUED AT $75,000 AND HIGHER, FOR CONSTRUCTION OF IMPROVEMENTS TO BURNHAM STREET AND ASH AVENUE. WHEREAS, the Tigard City Council approved Resolution No. 08-06 declaring the need to acquire property for the construction of unprovements to Burnham Street and Ash Avenue in die City of Tigard; and WHEREAS, Section 3 of Resolution No. 08-06 authorized the Tigard City Manager and die City's attorneys to negotiate and enter into agreements for purchase of diose properties, but limited that authorization to properties valued under$75,000; and WHEREAS, City Council has subsequently reviewed and concurred with the appraised values for properties valued at$75,000 and Higher; and WHERE-AS, City Council is interested in seeing tie property acquisition proceed expeditiously so that construction of die improvements can be scheduled. NOW,THEREFORE, BE IT RESOLVED by the Tigard City Council that: SECTION 1: Section 3 of City Council Resolution No. 08-06 is amended to read as follows: SECTION 3: The Tigard City Manager and the City's attorneys are authorized to negotiate with the owners and other persons in interest in the real properties described herein as to the compensation to be paid for the acquisition of the properties.
