TIGARD CITY COUNCIL
RESOLUTION NO. 08-66
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIGARD, OREGON
DECLARING THE NEED TO ACQUIRE PROPERTY FOR THE PURPOSE OF
CONSTRUCTING IMPROVEMENTS TO BURNT-IAM STREET AND ASH AVENUE
IN THE CITY OF TIGARD.
WHEREAS, the Tigard City Charter grants the City authority to acquire land for public purposes;
and
WHEREAS, the City of Tigard,is authorized by ORS 35.605 to purchase, acquire, take, use, enter
upon and appropriate land and property within or without its corporate limits for the purpose of
establishing, laying out,widening, enlarging or extending roads, streets or highways; and
WHEREAS, the widening and reconstruction of Burnham Street from Main Street to Hall
Boulevard, and the extension of Ash Avenue from Burnham Street to the Commuter Rail Parking
Lot are approved capital improvement projects currently being designed for construction beginning
in 2008; and
WHEREAS, the Burnham Street Improvement Project reconstructs the existing street,widens it to
ultimate width with wide sidewalks,planters,gateway treatments,green storm drainage facilities,
utility undergrounding, and landscaping in accordance with the concepts in the Tigard Downtown
Improvement Plan and the Comprehensive Streetscape Design; and
WHEREAS, the Ash Avenue Extension Project extends Ash Avenue north from Burnhain Street to
provide access to the Commuter Rail Parking Lot, and to form a part of the proposed future
extension of Ash Avenue to connect to Scoffins Street and Hunziker Street at Idall Boulevard; and
WHEREAS, for the public purposes of improving die streets'Within the City of Tigard,including
Burnham Street and Ash Avenue, for the health, safety, benefit and general welfare of the public,
die City Council has deemed necessary the acquisition of certain properties.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The City of Tigard City Council does hereby find and declare that properties located
in die City of Tigard, Washington County, Oregon are needed and requited for the
construction, operation, maintenance, repair and improvement of Burnham Street
and Ash Avenue. These properties are described as follows: Properties described in
Exhibit A attached hereto and incorporated herein by this reference; ancillary
easements as may be needed for slope, sidewalk, utility, wetland mitigation, stone
'eater treatment, storm water detention, and temporary constriction purposes;
additional properties as yet undescribed that may be needed to fully accommodate
the ultimate section for both streets in accordance 'vith the final design dra'vings;

incidental additional right-of-way at intersections and within the project Iii-nits as may
be reasonably necessary in order to accommodate project design; and any
uneconomic remnants, as determined by appraisal.
SECTION 2: The improvements to Burnham Street and die extension of Ash Avenue, for which
the real properties and interest are described herein, are required and are being taken
as necessary in the public interest, and the improvements to said properties will be
planned, designed, located and will be constructed in a manner that will be most
compatible with the greatest public benefit and die least private injury or damage.
SECTION 3: The Tigard City Manager and the City's attorneys are authorized to negotiate with
the owners and other persons in interest in the real properties described herein as to
tie compensation to be paid for the acquisition of die properties. The Tigard City
Manager is authorized to enter into agreements for purchase of these properties at
the appraised fair market values. The City Manager is further authorized to negotiate
and execute agreements for purchases that exceed tie appraised values as long as the
total agreement amount for each property is less than $75,000. Purchase of
properties for amounts that exceed the appraised values and are $75,000 or higher
must be approved by City Council.
SECTION 4: In die event that no satisfactory agreement can be reached on any of die properties,
dien the attorneys for tie City of Tigard are directed and authorized to commence
and prosecute to final determination such proceedings as may be necessary to
acquire the real properties and interest therein, including exercise of eminent
domain, and that upon tie filing of such proceedings, possession of tie real
properties and interest therein may be taken immediately to the extent provided by
late.
SECTION 5: This resolution is effective immediately upon passage.
