A RESOLUTION OF THE CITY OF COUNCIL OF THE CITY OF TIGARD SUBMITTING TO THE
VOTERS A PROPOSED CHARTER AMENDMENT TO BE CONSIDERED Ai :LIE SEPTEMBER 21,
1999,SPECIAL ELECTION
WHEREAS,an initiative petition has been properly filed and qualified for forwarding a proposed Charter
amendment to the voters of the Citi of Tigard;and
WHEREAS,the City Council of the City of Tigard has determined that the proposed Charter amendment
should be placed before the voters of the City of Tigard.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: All election is hereby called in and for the City of Tigard,Washington County,Oregon,
for the purpose of submitting to the legal voters of said City the following question:
Shall the City Charter be amended to require voter approval for use of Willamette
River as a drinking water source?
SECTION 2: Tuesday, September 21, 1999, is hereby designated as the date of the election; said
election will be conducted by mail.
SECTION 3: The election will be conducted by the Washington County Elections Department,which
department shall establish the procedures to conduct a"vote by mail'election.
SECTION 4: The precincts for said election shall be and constitute all of the territory included within
the corporate limits of the City of Tigard.
SECTION 5: The ballot title to appear on the ballots shall be:

QUESTION: Shall the City Charter be amended to require voter approval for use
of Willamette River as a drinking water source?

SUINAMARY: This measure will add a new Section 51 to the City Charter that will
prevent the City from using any water from the Willamette River as a primary,
q secondary or emergency drinking water source for its citizens unless the question of
using the Willamette River as a source of drinking water has been approved by a
majority of voters voting in a citywide election. The measure places no restrictions
on using any other source of drinking water for the citizens. This measure will

imr:�ct existing agreements relating to water supply between the City and other
jurisdictions. Each agreement contains a termination provision that will allow the
city to end the relationship if necessary.
SECTION 7: The Act containing the full Charter amendment is attached hereto and included in
this Resolution by this reference.

Explanatory Statement
If approved, this measure would amend the City Charter by adding a new section. The new
section would read as follows:
Section 51. The City of Tigard shall not use Willamette River
water as a drinking water source for its citizens unless the question of
using the Willamette River water as a drinking water source has been
approved by not less than fifty percent(50%)of voters voting in a
city wide election.
This means that the City of Tigard could not use any water from the Willamette River for
drinking water,unless such use is approved by a majority of City of Tigard voters. Approval
of this measure would not mean that a vote would be required for use of any other drinking
water source.
The City of Tigard provides water service to juri=sdictions outside the City limits. Voters in
these jurisdictions, not within Tigard voting precincts,will not be able to vote on this proposed
measure because it is an amendment to the City Charter.
The City of Tigard has agreements with other jurisdictions and agencies regarding the
provision of water service. The extent to which the approved measure would impact these
agreements is unknown.
