Resolution No. 98-02 CITY OF TIGARD, OREGON RESOLUTION NO. 98-Q.A— A RESOLUTION REGARDING WATER SUPPLY FOR THE TIGARD, SHERWOOD AND WILSONVILLE AREA WHEREAS, Tualatin Valley Water District("TVWD")holds Permit No. 49240 issued by the State of Oregon Water Resources Department to appropriate and use 130 million gallons per day from the Willamette River with a point of diversion in the Wilsonville area; WHEREAS,Tigard and TVWD have entered into an interim agreement wheiaby TVWD has agreed to supply Tigard with domestic water while Tigard secures and develops a long-term source of supply and WHEREAS, Tigard has entered into an agreement with other municipal drinking water purveyors to create the Willamette Water Supply Agency ("WWSA") to develop and use the water allocated under Permit No.49240 and to apply for additional rights in the name of WWSA,all to be used consistent with the Regional Water Supply Plan and to provide a long-term water source to Tigard; and WHEREAS, TVWD, Tigard, the City of Wilsonville, and the State of Oregon Department of Corrections ("DOC") have discussed the siting, design and construction of a 30 million gallon per day multi-barrier treatment plant; said water treatment plant having the capability of expansion to a 150 million gallon per day facility, along with necessary transmission facilities into their respective boundaries which also would create an opportunity to supply the Cities of Sherwood and Tualatin, as IMF well as the Department of Corrections facility currently planned for the Dammasch property ("Correction Facility");and WHEREAS, the Department of Corrections has ind,icated that its peak-day domestic need (non- irrigation) is 300,000 gallons per day which must be available in March, 2000, when the Correction Facility is ready for occupancy;and WHEREAS, on January 5, 1998, Wilsonville declared a building moratorium for lack of domestic water, thereby indicating that it cannot supply the Correction Facility, as well as new users within its boundary; and WHEREAS, TVWD, Tigard, Wilsonville, and the Department of Corrections have discussed methods for TVWD to provide short-term water from the City of Portland's Bull Run System through TVWD's Washington County Supply Line and wheeled through the City of Tualatin to the Department of Corrections, and Wilsonville if it chooses, through the year 2005, with construction of the Willamette River facility by WWSA(Tigard and TVWD, initially) for long-term needs for Tigard, Wilsonville and DOC after 2005;and WHEREAS,the City of Portland has indicated that through the year 2005,up to two million gallons per day could be made available by TVWD and wheeled through Tualatin for DOC, and Wilsonville if it AM chooses;and mr RESOLUTION NO. 98- Page 1 v WHEREAS, DOC will seek funding from the Emergency Board for construction of the Corrections Facility of which ten million dollars will be sought for water improvements to assure long and short-term water supply to the facility;and WHEREAS, Tigard is willing to cooperate with TVWD through WWSA to provide short-term water supply and participate in long-term water supply to Wilsonville if Wilsonville chooses, and the Department of Corrections if the Emergency Board approves funding ten million dollars toward water system improvements with a project agreement executed by March 1, 1998, all according to the Agreement attached hereto as Exhibit A, and incorporated by reference, and the Board being fully advised, NOW, THEREFORE,BE IT RESOLVED by the Tigard City Council that: SECTION 1: Tigard hereby offers to cooperate with TVWD through WWSA to provide short-term water supply and participate in long-term water supply to Wilsonville if Wilsonville chooses, and the Department of Corrections if the Emergency Board approves the funding of ten million dollars for water system improvements with a project agreement signed by all parties no later than March 1,1998. SECTION 2: City staff is authorized to negotiate a final agreement depending upon Wilsonville's choice and funding approved by the Emergency Board and bring the appropriate final agreement to the Council for approval. SECTION 3: City staff is authorized to provide such information, including testimony, as reasonable and necessary, to support the Department of Corrections' request for funding before the Emergency Board.
