A RESOLUTION ADOPTING FEES AND CHARGES TO BE COLLECTED FROM THE `
UNINCORPORATED AREA OF WASHINGTON COUNTY KNOWN AS THE URBAN SERVICES `

AREA BY AGREEMENT WITH XVASHINGTON COUNTY
WHEREAS, The City of Tigard and Washington County have entered into an Intergovernmental

agreement effective June 1,1997 that authorizes the City to provide certain development services to the ��c t•t k,t '7�;,

WHEREAS, The agreement contemplates that the City will establish fees and charges for building,
planning and engineering services in the area to approximate those currently being charged by the County

and that the City is entitled to use the revenues from such fees and charges to fund the provision of such

WHEREAS, Tigard Municipal Code section 3.32 allows the City council to establish fees and charges
by resolution in order to recover the costs ofproviding related services,and,
WHEREAS, The City Council hereby determines that such fees and charges are not established to makeup for for lost property tax revenues and therefore are not subject to the vote requirement provisions of article
11 Section I l(g)of the Oregon Constitution related to such fees and charges-
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: Building Permit and inspection fees including building. plumbing, electrical, es t

mechanical and other related fees and charges are hereby.established for the Urban
Services area at the same rates and values as those currentIY charged within the City '

limits.

SECTION 3: Engineering fees and charges and deposits are hereby established for the Urban Services

SECTION 4: Any other fees and charges necessary to provide services set forth in the
Intergovernmental agreement shall be charged at the rates charged within the City limits eat"

SECTION 5: The City council determines that the fees and charges imposed by this resolution are not
taxes subject to the property tax limitations of Article 11,Section 11(b)of the Oregon
Constitution,

FOR WORK WITHIN THE WASHINGTON COUNTY AREA OF INTEREST
The Engineering Department issues two types of omits for work within the public right-of-way or '�s

public easement,both of which require a deposit t be paid prior to construction that will cover
Engineering plan review,assurance administration and inspection fees related to a public
" improvement permit:
I STREET OPENING PERMIT(SOP): � v
This permit covers relatively minor work in a public right-of-way or easement,such as
sidewalk and driveway installation and service connections to main utility lines. This work ,,"'
may involve open trench work within the street.The permittee must submit a plan of the
proposed work for review and approval. The fee for this type of permit is$150 minimum plus

a deposit to cover the estimated cost of time and equipment involved in processing and
inspection. Should the deposit not fully cover all costs,the permittee will be invoiced for the
remainder_
These permits require a cash bend or surety bond to be posted. For work outside the travelled
portion of the roadway,the bond amount is$250 plus$2.50 per lineal foot of rightrof-way �. u
.involved. For work within the travelled portion of the roadway-the bond amount is$250 plus
$50 per square foot of travelled area involved.The bond is generally retained for one year

This permit covers more extensive work such as main utility line extensions, street
imarovements,etc:-In subdivisions,this type of permit also covers all grading and private
'utility:work. Plans prepared by a registered professional engineer mustbe submitted for 3!
Q '-review and approval The cost of this permit is calculated from the table below and is based on

the designengineer's estimate. The permittee will also be required to post a`performance
bond,or other such suitable security,and execute a Developer/Engineer Agreement which will
