A RESOLUTION ESTABLISHING SANITARY SEWER DISTRICT NO.9
t WHEREAS,the City has initiated the Neighborhood Sewer Extension Program to extend public sewers t.,s
and recover costs through Reimbursement Districts in accordance with TMC Chapter 13,09;and

WHEREAS,property owners in the proposed project area have requested sewer service;and
WHEREAS,bids for the construction of the sewer improvements have been received;and "
IN
WHEREAS,property owners have been notified of a public hearing in accordance with TMC 13,.09.060
and a public hearing was conductedin accordance with TMC 13.09.050;andr

WHEREAS,the City Engineer has submitted a report describing the improvements,the area to be included

in the Reimbursement District,a method for spreading the cost among the parcels within the District,and a
recommendation for an annual fee adjustment;and, g .

WHEREAS,the City council has determined that the formation of a district as recommended by the City
Engineer is appropriate.

NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that: +
SECTION L The City Engineer's Report titled "Sanitary Sewer Reimbursement District No. 9,"
attached hereto as Exhibit A,is hereby approved.
SECTION 2: A reimbursement district is hereby established in accordance with TMC Chapter 13.09... rs
The District shall be the area shown in Exhibit'B and as described in Exhibit C,The- #

"District shall be known as"Sanitary.Sewer Reimbursement District No.9.
SECTION 3: Payment of the reimbursement fee as shown in Exhibit A is arecondition of receiving

Sanitary Sewer Reimbursement District No.9
Background
i
This project will be constructed and funded under the City of Tigard Neighborhood Sewer '
Extension Program(NSEP). Under the program the City of Tigard would install public sewers
to each lot within a project area.. At the time the property owner connects to the sewer,the owner t
a
would pay a connection fee of$2,235.00 and reimburse the City for a fair share of the cost of the
, public sewer.There is no requirement to connect to the sewer or pay any fee until connection is
made.In addition, property owners are responsible for disconnecting their existing septic
systems according to Washington County rules and for any other modifications necessary to
connect to the public sewer. To be considered for the program,a neighborhood needs to submit ii,;
evidence of resident support of a project. Residents on SW Fairhaven Street and SW Fairhaven
Way have shown support for a project in their neighborhood.

Existing sanitary sewer lines are located on SW Fairhaven Way,east of SW 110th Avenue,and q
on S W 107th Avenue,north of S W Fairhaven Street,as shown on the attached Exhibit Map B. :,'
s� One portion ofthis project extends the existing sewer on SW 107th Avenue south to SW ;
Fairhaven Street,then west to 10915 SW Fairhaven Street and east to 13605 SW Watkins Street. a Kz
These lines would serve 16 properties that currently are not on public sewer.'.There is one
property;10685 SW Fairhaven Street,which is currently connected 4o public sewer and two
properties,10965 and 10960 SW Fairhaven Street which are at an elevation which would not
allow hook-up to this line These three properties will not be included in the reimbursement r a
district. In addition.a sanitary sewer line will he extended ficin tnc intersection of Sw
Fairhaven Street and SW Fairhaven Way south to 10710 SW Fairhaven Way. This line wouldi
serve 3 properties on SW Fairhaven Way.
The remaining portion of this project extends the existing sewer on SW Fairhaven Nay east on
SW Fairhaven Way to 10740 SW Fairhaven Way.This line would serve 10 properties on SW
+ Fairhaven Way which currently are not connected to public sewer..There are four properties
a (10945,10950,10920,and 10890)on SW Fairhaven Way which currently are hooked-up to

public sewer or have sewer available for hook-up. These 4 properties will not be included in the
reimbursement district. j

Construction of this project will be paid for by the City's NSEP fund. It is expected that the a
NSEP fund will be reimbursed in the future as each property connects to the sewer. Each
property owner will be required to pay his/her fair share of the project,in full,at the time of
connection and will be responsible for financing that amount. The City will not provide
individual financing to property owners. ; .;•!r`"

The bid price for the sanitary sewer construction is 5215,128.25. Engineering and inspection
fees amount to$15,542.31(13.5%)as defined in TMC 13.09.040(]).The total project cost
including these fees is 5130,670.56. This entire amount should be reimbursed to the NSEP fund
as properties connect to the sewer and pay their fair share of the total amount. xM Thr.

In addition to sharing the cost of the public sewer line,each property owner will be required to
pay an additional$2,235 connection and inspection fee when connection to the public line is r „w
made,and will be responsible for all plumbing costs required for work done on private property. € J •
Reimbursement Rate
~» All properties in this area are zoned R-3.5 and have similar lot sizes as can be seen in Exhibit
Map B. Therefore,it is recommended that the total cost of the project be divided equally among
the 29 properties included in the reimbursement district with each property owner being
responsible for 1/29th of the total project cost. °;�

Other reimbursement rate alternatives can be determined by the square footage of each property
or by the length of frontage of each property. Because all properties are similar in size.the
.square footage method is not recommended for this reimbursement district, The length of ..k
frontage method is noteeOn' ed because three PropertieswiTitin the reimbursement district
are corner lots and would be required to pay for two frontages without receiving any additional .'w§,x '-�;
benefit from the public sewer line. IF

Each property's fair share of the public sewer line will be$4,505.88..

Interest Rate

' TMC 13.09.115 states that an annual percentage rate shall be applied to each property owner's
fair share of the sewer line costs on the anniversary date of the reimbursement agreement. The +e r
= Finance Director has set the annual interest rate at 7.37%as stated in City of Tigard resolution
