Resolution No. 95-66 CITY OF TIGARD, OREGON RESOLUTION NO. 95-�� A RESOLUTION TO RECOGNIZE LEGAL ACCESS RIGHTS TO SW 88TH AVENUE FOR THE OWNERS (BIGGS) OF TAX LOT 700 2S1 12_AA. WHEREAS, Arthur V. Biggs and Patricia N. Biggs are the owners of Tax lot 700, 2S1 11AA situated between McDonald Street and Greensward Park II, in Tigard, Oregon; and WHEREAS, prior to the development of the Greensward Park II subdivision, the Biggs accessed their property over a private road easement from Hall Boulevard to the southerly end of their property; and WHEREAS, as part of the development of Greensward Park, SW 88th Avenue was constructed as a dedicated public street which extends northerly to and ends at the Biggs southern property line; and WHEREAS, SW 88th Avenue is adjacent to the Biggs property for approximately 22 feet and the Biggs have relocated the driveway to access their home by us=ing this portion of SW 88th Avenue; and WHEREAS, property owners whose property is subject to the Biggs easement have requested them to release their land from the Biggs easement; and WHEREAS, the Biggs have requested assurance from the City of Tigard that there is a legal right of access to their property from SW 88th Avenue without which the Biggs will not release and relinquish their easement to Hall Boulevard; and WHEREAS, the Biggs will be required to obtain a street opening permit to formalize the connection to the end of SW 88th Avenue; NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1: The City of Tigard, Oregon hereby recognizes thati the owners of the Biggs property have a legal right to access the existing home located on Tax Lot 700 2S1 11AA by using SW 88th Avenue which is a dedicated public street that adjoins the south property of the Biggs property.
