A RESOLUTION Or THE CITY COUNCIL OF THE CITY OF TIGARD APPROVING A !
BALLOT TITLE FOR AN INITIATIVE MEASURE CONCERNING STREET DESIGN
WHEREAS, Tigard Municipal Code Section 1.12.120 provides that a person
dissatisfied with the ballot title pro°uiae:d by the City Attorney for an
initiative measure may appeal to the City Council asking for a different
title; and
WHEREAS, an appeal has been filed in a timely manner; and
WHEREAS, Section 1.12.120 requires the City Council to either approve
the ballot title prepared by the City Attorney or prescribe another
ballot title; and
WHEREAS, after due consideration, the Tigard City Council has determined
that the ballot title attached hereto as Exhibit «Aft meets the
requirements of both the Tigard Municipal Code and the state election
Laws;
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. The ballot title attached hereto as Exhibit "A" is hereby
approved by the Tigard City Council and shall be the ballot
title for the initiative measure concerning street design
wLch is attached hereto a Exhibit "B".

Council to seek voter approval of street design
before they initiate, cause, order, approve, enact
or fund the construction of certain nGw streets or
sections of streets. Streets subject to the measure
are those which would pass through or be adjacent
to a park or wetland. Street designs could only be
submitted to the voters at the November general
election. A general election is held every two
years.

TEXT of PROPOSED XNABVRE _
The City Charter of the City of Tigard, Oregon, a municipal
corporation a_nd political subdivision of the State of Oregon,
be ascended as follows:
LIMITATION OF POWERS OF TIM GOVERNING BODY OF THE CITY
OF TIGARD IN REGARD TO CONSTRUCTION OF STREETS
Section 1.
The Governing Body of the City of Tigard shall not
initiate, cause, order, approve, enact, or fund the construction
of any new street or road, or any new section of an existing
street or road, which would pass through or adjacent to (a) any
park owned or maintain!-,d by the City, or (b) any wetland, unless
the des .gn therefor has been approved by a majority of voters at
a November general election. As used in this Section, the
following words shall have the following meanings:
(1) "Design" shall mean location, alignment, width of
right of way, width of pavement or roadway, landscaping, and
placement of any bicycle trails or sidewalks.
(2) "Majority°' shall mean a majority of those voters
actually voting on the issue in question.
(3) "Wetland" shall have the meaning set out in its
definition in the Tigard Community Development Code as of
January 1, 1995.
Section 2.
This amendment shall be etfec-tive immediately when
passed by the voters.
