RESOLUTION NO. 94- '2
A RESOLUTION OF THE CITY COUNCIL, CITY OF TIGARD, OREGON,
AUTHORIZING EXECUTION OF AGREEIMENTS EXTENDING RETIREMENT PLAN
PAYMENTS TO NON-REPRESENTED EMPLOYEES.
WHEREAS, List- City wishes to rnaiiitain pasity in benefits
between its employees. represented by a labor union and non-
represented employees; and
WHEREAS, funds for employee retirement contributions have been
bud«eted for Fiscal Year 94/95; and
WHEREAS, the passage of Ballot Measure 8 will mandate employee
contributions to retirement programs effective January 1, 1995; and
WHE:RE&S, the City has agreed as a matter of contract,
esta:lished practice and policy, that it will pay, as part of the
total compensation of its employees, contributions to appropriate
retirement- plans, together with the related incomE. tax benefits of
those payments; and
WHEREAS, the City Council desires to enter into agreements to
maintain parity with no change in employment status or benefit
levels for its employees.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council
that:
SECTION 1: The City administrator is authorized to execute
agreements with non-representeci employees in
substantially the form provided in the attached
Exhibit "A."
SECTION 2: The City Administrator is authorized to execute
amendments to existing employment agreewents in

EXHIBIT "A"
EMPLOY&WU ASREE*ENT
PARTIES: City of Tigard, Oregon, an Oregon municipal
corporation,
and
Employee_
RECITALS:
This Agreement is intended to clarify the employment
relationsh1p which currently exists between the parties.
The terms and conditioner of employment have been
previously established by policies, employment and compensation
practices, and other written documents applicable to individual
employees_
The City has agreed, as a matter of contract, established
practice and policy tincluding City Personnel Rules for Management
Employees, Section 5.4) , that it will pay, as part of employee's
total compensation, a 14 contribution to the ICMA 401 (A) retirement
plan, together with the related income tax benefit of this
agreement_
The retirement payment described herein has been mutually
agr=_ed to by the parties as a portion of employee's total
compensation.
IT IS AGREED;
1. The City does hereby continue the employment of employee.
This employment agreement is s,-?rject to all the terms and conditions
previously established between the parties as set forth in the
recitals herein and in any other documents establishing or affecting
the parties' relationship as employer and employee.
2. The parties have not agreed and do not hereby agree or
intend that the retirement component of employee's total
compensation will be reduced.
3. The City hereby agrees that employee's total compensation
shall continue to include the city paid !CMA retirement plan
contribution of 14% of the employee's monthly salary, together with

the related income tax benefit of this agreement, and the City shall
continue to make this payment.
4 This agreement is effective December. 7, 11,94 to
Decemb<_r 31, 1995.
