A RESOLUTION AUTHORIZING THE SALE O;A:YA::A I'PARCEL OF RESIDENTIAL PROPERTY �
LOCATED ON MCDONALD STREET AND SETTING A MINIMUM ACCEPTABLE SELLING PRICE.
WHEREAS,unimproved property located on McDonald Street identified by Washington County as tax map
and lot number 2S1 11BA 103 was within the boundary of the Tigardville Heights Street and McDonald Street
Sewer Local Improvement Districts,and,
® WnErt S, due to non-payment of as-sessments avid property taxes, the property was foreclosed by 1
Washington County in 1986,and,
WHEREAS,City liens for both Local Improvements are still outstanding with principal amounting to$25,763
and interest amounting to$26,087 for a total of$51,850 as of April 27, 1993.
WHEREAS,the City has been successful in gaining title to the property due to its continuing assessment lien
interest in the property,and,
WHEREAS,Tigard Municipal Code Section 3.44.015 describes the process to be followed in the disposal of
standard undeveloped property such as this,and,
WHEREAS,an appraisal has been completed by a qualified appraiser placing the value of the property at
$43,200,and,
WHEREAS,a hearing has been held in accordance with TMC 3.44.015(A)to solicit public testimony as to
whether the sale of the property is in the public interest.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
Section 1: The sale of the property described above has been determined to be in the
public interest.
Section 2: The Finance Director is directed to proceed with the sale of the property in
accordance with TMC 3.44.015 and to set the minimum bid at$43,200.
Section 3: The Finance Director is authorized to solicit bid proposals and accept the
highest bid. If no acceptable minimum bid is received, the Finance Director
is authorized to list the property with a broker in accordance with TMC
3.44.015(H).
Section 4: The Finance Director is authorized to negotiate and to sign documents on
behalf of the City to complete the sale transaction including but not limited to
bid proposals,purchase agreements,and deed.

Section 5: The Mnance Director is authorized to apply the net proceeds from the sale of
the property first to principal then to interest in the Bancroft Debt Service
fund. Any assessment interest remaining after all net proceeds have been
applied shall be written off and discharged.
