Resolution No. 92-41 HIM CITY OF TIGARD, OREGON RESOLUTION NO. 92-0+ _ A RESOLUTION OF THE CITY COUNCIL, CITY OF TIGARD, OREGON, COMMITTING TO WORT{ WITH THE CITIES OF KING CITY AND DURHAM AND THE TIGARD WATER. DISTRICT TO CARRY OUT THE WITHDRAWAL, OF THE CITIES FROM THE WATER D16TRICT AND SUPPORT THE DISSOLUTION OF THE WATER DISTRICT AND CREATE AN INTERGOVERNMENTAL COOPERATIVE AGREEMENT TO FORM A JOINT WATER AGENCY. WHEREAS, the cities of Tigard, King City, and Durham and unincorporated area within the Tigard Water District have met with representatives of the Tigard Water District over the past year, WHEREAS, creation of an agency comprised of the three cities may be in the best interests of the customers of the Tigard Water District, WHEREAS, the cities are willing to accept responsibility for operating the water system and are committed to a smooth transition so that the -i-thdrawal/dissolution proceedings will be completed by July 1993, or as soon as the process allows. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1: The City of Tigard hereby commits to work with the cities of King City and Durham to prepare an ORS 190 Intergovernmental Cooperative Agreement to operate a joint water agency serving the three cities and unincorporated areas within the Tigard Water District boundary. Section 2: The City of Tigard hereby commits to participating in a transition team which will work with the Tigard Water District to carry out the plan to withdraw the three cities from the Tigard Water District and eventually dissolve the Tigard Water District during 1993. Section 3: The City of Tigard City Council hereby agrees to negotiate with the cities of King City and Du3:ham as well as the Tigard Water District to prepare an Intergovernment Cooperative Agreement which provides for the creation of a governing board which is made up of representatives of the three cities. E Section 4: Further, the City of Tigard City Council hereby commits to follow the schedule of tasks outlined in the Tigard Water System Study Withdraw/Dissolution Proceedings (Exhibit A) to form a point ;nater agency by June 30, 1993, or as soon as the process allows. EXHIBIT B OUTLINE FOR ESTABLISHING INTERGOVERNMENTAL AGREEMENTS FOR OPERATION OF A WATER SYSTEM The following outline includes but does not limit issues that will be addressed by the Cities of King City, Durham, and Tigard and the Tigard Water District in reaching intergovernmental agreements. These agreements provide for the establishment of a joint agency for water storage and distribution within current Tigard Fater District boundaries, including participant cities.
