RESOLUTION NO. 90-
A RESOLUTION DECLARING THE NECESSITY AND PURPOSE FOR THE
ACQUISITION OF CERTAIN REAL PROPERTY FOR FUTURE DEVELOPMENT AT THE
TIGARD CIVIC CENTER SITE AND THE FULL USE AND ENJOYMENT BY THE
PUBLIC OF SUCH DEVELOPMENT, AND AUTHORIZING THE CONDEMNATION OF
SAID REAL PROPERTY.
WHEREAS, pursuant to Oregon Revised Statutes Chapters 223, 281, and
35, the City of Tigard is authorized to appropriate any private
property and interests therein for any public use for the general
benefit and use of the people of the City; and
WHEREAS, for the health, safety, benefit and general we'-fare of
the public, the City of Tigard needs the additional land dasci:ibed
in Exhibit A for future development of the Tigard Civic center
site, and to protect the full use and enjoyment by the public of
such development: and
WHEREAS, the owners of the real property and interests described
in Exhibit A are R. Dean and Dorothy Schmitz, husband and wife, as
contract purchasers from Harold E. Reoh and Brenda Reoh, as tenants
by entirety, legal owners; and
WHEREAS, it appearing to the City Council that acquiring the land
for future development is most compatible with the greatest public
good and the least private injury or damage:
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. The City of Tigard does hereby find and declare that
there is needed and requi-ed for the future development of the
Tigard Civic Center site, real property and interest therein more
particularly set forth and described in Exhibit A, attached hereto
and by this reference incorporated herein.
Section 2. The future development of the Tigard Civic Center
site, for which the real property and the interests therein
described in Exhibit A are required, is being taken as necessary
in the public interest and said acquisition for future development
will be most compatible with the greatest public benefit and the
least private injury or damage.
Section 3. The City of Tigard and its designees are hereby
authorized to attempt to agree with the owners identified above and
other persons in interest in the real property and interests
described in Exhibit A as to the compensation to be paid for the
appropriation of the property, and, in the event that no
satisfactory agreement can be reached, then the attorneys for the

City of Tigard are hereby directed and authorized to convmence and.
prosecute to final determination such proceedings as may be
necessary to acquire the real property and the interests therein
and that upon the filing of such proceeding, possession of real
t. property and interest therein may be taken immediately.

EXHIBIT ^A"
A tract of land in the East half of Section 2, Township 2 South,
Range Y West of the Willamette Meridian, in the City of Tigard,
County of Washington and State of Oregon, described as follows:
Beginning at the Northeast corner of that tract of land described
in Deed to Edwin J. Johnston recorded November 17, 1922 in Book
125, page 66, Washington County Deed Records; thence North 89a
West 7.73 chains to a stake; thence North 1*30• East 8 rods;
thence East to the center of S.w= Burnham Street; thence .Easterly
and Southerly along the center of S.W. Burnham Street and along
the center of State Highway No. 217 to the place of beginning.
EXCEPT the West 200 feet thereof.
