Resolution No. 90-35 CITY OF TIGARD, OREGON RESOLUTION NO. A RESOLUTION CONCERNING THE CONVEYANCE OF TRACT "AA" OF MORNING HILL SUBDIVISION AND TRACT "E" OF BELLWOOD NO. 3 SUBDIVISION IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON TO THE WETLANDS CONSERVANCY. WHEREAS, A request has been received and filed with the City of Tigard for the transfer of Tract "AA" of Morning Hill No. 6 Subdivision and Tract "E" of Bellwood No. 3 Subdivision (Exhibit "A") to the Wetlands Conservancy in exchange for a parcel located on Grant Avenue in the City of Tigard (Exhibit "B"); and WHEREAS, Tracts "AA" and "E" were previously granted for public open space and utility purposes and are currently unimproved; and WHEREAS, Tracts "AA" and "E" are not considered as a part of the public open space network as contemplated in the Tigard Comprehensive Plan or the Tigard Park Plan; and WHEREAS, the Grant Avenue parcel is within the Fanno Creek flood plain and is necessary for the completion of the Fanno Creek greenway system as contemplated s: in the Tigard Comprehensive Plan and the Tigard Park Plan; and WHEREAS, after affording public notice as required by ORS 226.320 through 226.400, the City Council held a public hearing at 7:30 PM on June 11, 1990 to consider the Wetlands Conservancy proposal as well as all other offers regarding Tracts "AA" and "E". NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: (1) The Tigard City Council finds it necessary and desirable tc, transfer Tracts "AA" and "E" to the Wetlands Conservancy in exchange for the property on Grant Avenue. (2) The City Council finds that the property transfer is appropriate and consistent with the Oregon Revised Statutes, the Tigard Comprehensive Plan, and the Tigard Parks Plan. (3) The Tigard City Council approves the transfer of Tract "AA" of Morning Hill No. 6 and Tract "E" of Bellwood No. 3 ('Exhibit "A") to the Wetlands Conservancy, for the purpose of being maintained in perpetuity for wetlands and open space, in exchange for the Grant Avenue parcel (Exhibit "B"). j�� 1ulc `?o-3S i (4) The City staff is hereby authorized and directed to complete this property transfer and to have the appropriate documents recorded with Washington County. )J�PPa.SSEDs This t day ot-/�_.G--v" � . 1590.
