RESOLUTION NO. 90-Cid
A RESOLUTION INITIATING LEGALIZATION PROCEEDINGS FOR THE RIGHT-OF-WAY OF S.W.
GREENBURG ROAD BRTWEEN S.W. TIEDEMAN AVENUE AND S.W. PACIFIC HIGHWAY IN THE
CITY OF TIGARD AND SETTING A PUBLIC HEARING.
WHEREAS, S.W. Greenburg Road is scheduled for improvement in the Summer of 1990
as a result of the passage of the Tigard Major Streets Traffic Safety
Improvement Bond measure; and
WHEREAS, the right-o£-way S.W. Greenburg Road, which was originally created in
1871, cannot be accurately retraced and re-established; and
WHEREAS: House Bill 3467 was passed by the State Legislature on April 20, 1989,
allowing City governing bodies to legalize reads within the City in a manner
similar to that used by County governing bodies to legalize county roads; and
WHEREAS, the council finds it necessary to initiate proceedings to legalize the
right-of-way of S.W. Greenburg Road and remove all doubt concerning its
location;
NOW, THEREFORE, BE IT RESOLVED BY THE TIGARD CITY COUNCIL THAT:
Section 1: The City Council hereby initiates legalization proceedings for the
right-of-way of S.W. Greenburg Road between Tiedeman Avenue and
S.W. Pacific Highway, and directs that:
a. The City Engineer have the right-of-way surveyed by a
Professional Land Surveyor registered in the State of Oregon;
and
b. The City Engineer prepare a report as to the findings and
recommendations of such legalization; and
C. A public hearing be held on January 22, 1990, to consider
said findings and recommendations; and
d. That all owners of property abutting the right-of-way
considered for legalization be notified in writing of said
public hearing.
