RESOLUTION NO. 89C.�
A RESOLUTION CONCERNING THE VACATION OF AN UNIMPROVED PUBLIC ACCESS EASEMENT,
ALSO KNOWN AS A PORTION OF SW 81ST AVENUE, LOCATED IN THE SOUTHWEST QUARTER O
SECTION 12, TOWNSHIP 2 SOUTH, RANGE I WEST, W.H., IN THE CITY Ue TIGARD.
WASHINGTON COUNTY. OREGON.
WHEREAS, a vacation request has been received and filed with the City Recorder
'Or vacation of a public access easement; and
WHEREAS, this portion of land was previously granted for public access
purposes and is currently unimproved; and
WHEREAS, the Tigard City Council finds itnecessary and desirable to initiate
vacation proceedings for said parcel.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
(1) That the Tigard City Council initiates the vacation reauest L,;rh *h-
understanding that those property owners who would normally sign a
Petition shall be notified by mail of the proceedings and thatthe
benefiting property owner, Waverly Construction, pay all fees and
charges as set out in THC 15.08.

IP (2) That a public hearing is heresy called to be held by LI-le C V _
on Monday, February 13, 1989, at 7:30 PH at the Tigard Civic Center
Town Hall Room, 13125 SW Hall Boulevard, within the City of Tigard, at
which time and place the Council shall hear any eb+,ection� ticctc
any interested and
person may appear and be heard for or against the
Proposed vacating of said lands.
(3) That the City Recorder be, and she is hereby, authorized and directed
tO cause to have published in the Tigard Times, a newspaper of general
Circulation in the City Of Tigard hereby designated far such purpose, a
notice of said hearing in the form hereto attached and by this
reference made a part hersof, the first publication to be January 12,
1989 and once each week thereafter for five publishings in all.
The Recorder be, and she is hereby, further directed to cause to have
posted within five (S) days after the date of first Publication, a copy
of said notice in the form attached, at Or near each end of the area
Proposed to be vacated.

(4) That to particular portion of granted public easement proposed to be
vacated is described on the attached sheet headed Exhibit "A" and by
reference made a part thereof.

NOTICE OF PUBLIC ACCESS EASEMENT VACAT_IGN S.W. 81st AVENUE
The Tigard City Council will hold a public hoaring on Munday, F®bruar-y 13,
1989, at 7:30 p.m. at Tigard Civic Center- Town Nall Room, 13125 S.W. Nall
Boulevard, Tigard, Oregon to consider the proposed vacation of an unimproved
public access easement also known as a portion of S.W. 81st Avonue, in the
City of Tigard. The request was initiated by City Council on January 9, 1989,
at the request of Waverly Construction. Any in.te:rested person may appear and
ba heard fur or against the proposed vacation of said land. Any written
objections or, remonstrances shall be filet: with the City Recorder by February
13, 1989, by 7:30 p.m.
