NOW, THEREFORE:, bas-Q on the rHcurd in this case, the Tigard City Council
upholds the Hearing, Officer decision and conditions of approval. with
modifications to the findings and conditions as written boluw:

1982. At thatgime, no development by the landowners was planned and the City
limited the construction costs imposed on the landowners to $95,000. That.
limitation r•etauired a revision to the street standard to an "inter-im" stzvid—d
to keep the costs within the budget, in 1984, the City appro"A art expansion
to this facility and made no ch, ge ,n the "int"Am" standard .or the .uvot.
.However, the applicant is now before th> City to nearly double the size of .its
operatiun. The City consistently requires applicants to bring rae_ads erred
utilities to standatd in conjunction with new development, lhery is no
dispute Lhat the road as presently built is not to standard fur an industrial
as•ea.

are. approved, subject to the following conditions:

A, Standard half--street improvements, including concrete sidewalk,
driveway apron, curb, asphaltic concrete pavement, sanitary sewer,
storm drainage, stre.etiigh'cs and underground utilities (as
practical), shall be installed along the 74th Avenue frontage,
Improvements shall conform to the alignment of existing adjacent
improvements. The pavement thickness shall consist of 3 inches of
asphaltic concrete pavement on 2 inches of (3/4"-0) and 8 inches of
(2"--D) aggregate baserock. Thea property owner shall execute a waiver
of remonstrance onforms provided by the City, waiving the right to
object to the formation of a future local improvement district for
the purpose of constructing an asphalt pavement overlay on SW 74th

Avenue. 1.t is understood that the pavement overlay will bc: do.N.-i-ed
until such time as a substantial portion of SW 74th avenue has been
improved and paved between Bonita Road and Durham Road and additional
pavement thickness is needed to support expected traffic loadings.
Said condition shall not: in itself establish precedentas to future
improvements of S.W. 74th Avenue.
b. Additional right--uf--way shall be dedicated to the Public along the
74th Avenue frontage to increase the right--of--way to 25 feet form the
centerline. late description shall be tied to the existing
right-of.-way centerline. The dedication document shall be on City
forms and approved by the Engineering Section. Dedication forms and
instructions are available from the Engineering Section.
C. The northern driveway shall be relocat—d or deleted to comply with
the 30 foot spacing requirement between driv..-way aprons.
d. A permit or evid,gce demonstrating compliance shall be obtained by
the applicant from the VS. Amoy Corps of Engineers (Authority:
Section 404, Clears :Jageract, 33 �,.

or fill material into waters of the United States. A copy of the
permit. shall be provided to the, City Engineering Office by 1, iw
applicant.
e. The applicant shall provide for roof and parking loL rain drainage to
the public stormwater drainage system.
f. Five (5) sets of plan and profile public improvement construction
puns and one (1) itemized construction Cost estimate, stampod by a
Registwed Professional Civil Engineer, detailirn3 all proposed public
improVeiti nts sha11 be _submitted to the Enginewgng Soction For
approval, 14�o (2) sets of plan and profile plans shall be submitted
for preliminary review prier to submittal of final plans.
g. Cur =*—u_.tion of proposed public improvements shall n,�t commence until
after the Engineering section has approved public improvement plans.
The section will required 160 percent performance assurance or letter
Of commitment, with payment of a permit fee and a sign
installation/streetlight fee. Also, the execution Of a street
opening permit or construction compliance agreement shall occur- prior
to or concurrently with the: issuance of approved public improvement
plans.
h. A revised site and landscaping plan shall be submitted for planning
Director approval which includes the following items:
1, The parallel parking spaces near 74th Avenue shall have minimum
dimensions of 8.5 feet by 20 Net.
2. The northern driveway in the new parking area shall be on t-ted.
3. Specific species and size of landscaping materials shall be
identified.
4. Specific plans illustrating how the two trees located in the
southern parking lot will be saved as indicated.

5. -Iwo handicapped parkin, spares within easy access to building
entrances.
i. The. 100 year floudplain shall be dedicated to the public from Bonita
Road to the south property boundary. The dedication documents shall
'. be un form:: approved by the City and shall be re.corded with
Washington County.
2. All items noted in condition t(h) above shall be installed prior to
occupancy of the new 20,000 square FOOL addition.
3. This approval i3 valid :if exercised within one year Of the final decision
date.
