CONSTRUCT STREET LIGHTING IMPROVEMEIVIS ON S.W. 79TH AVENUE AND Tse HOLD A
PUBLIC HEARING, ADOPLING THE PRELIMINARY ENGI:NELR'S REPORT, AN[) DIRECTING THAT
NOTICE OF THE HEARING BE GIVEN.
WHEREAS, the City Council by Resolution No. 88--56 directed that a Preliminary
Engineer's Report: be prepared for the construction of street lighting
improvements on S.W. 79th Avenue between Pfaf-fle and Thorn Streets; and
WHEREAS, the Preliminary Engineer's Report has been completed and submitted to
the Council together with a report from the Community Development Director,
which finds the proposed project to be feasible ar•d recommends this project be
given first priority pursuant to Council policy as set forth in Resolution No.
85-35;
NOW, THEREFORE, BE: IT RESOLVED by the Tigard City Council that:
Section l: The City Council by this resolution declares its intention to
make street lighting improvements on S.W. 79th Avenue between
?faffle and Thorn Streets.
Scctiun 2: The City Council by this resolution declares its intention to
form a local improvement district with boundaries as described
in attached legal description marked Exhibit A.
Section 3: It is the intention of the City Council that the improvements
be constructed in accordance with the Preliminary Engineer's
Report attached as Exhibit B and entitled "Preliminary
Engineer's Report for SW 79th Avenue Street Lig m yq LTU". The
report may be changed in the hearings and is her-by adopted
subject to amendments.
Section 4: The total estimated cost is $3,000 for the proposed
improvements and the benefitted properties shall be assessed
for all costs of design and construction with the costs divided
equally amonq the 32 Parcnis Within r-he LID. '.
Section 5: The improvements shall be constructed by the franchised power
utility,

Section 6: A publichearing shall be held at 1-19ard City Hall, 13125 SW
Nall Boulevard, I-igar'd, Oregon on the 10th day of October,
1466, at 7:30 P.M. , at which time the City Coun,iI will hear
objections or remonstrances to the proposed improvement by any
property ownerwithin the proposed local improvement district
boundary.
Section 7: At least ten days prior to the public hearing, the Community
DavelopmenL Director is directed to give notice of the public
hearing by publication and by individual mailed notice to all
owners of real property affected by the proposed improvements.
Section 8: All remonstrances shall be filed with the City Rec,•--der• by the
close of the initial hearing. Thereafter, no remonstrances
shall be considered except as otherwise provided by Ordinance
No. 85-A0.

A tract- of land located in Section 36, Township 1 South, Range 1 Wost,
Willamette Meridian, City of Tigard, Washington County, Oregon, described as
follows:
Beginning at the northwest corner of Lot 6, Marg Terrace, a recorded plat,
Washington County Plat Records; thence South 89' 03' East, 250.10 feet to the
northeast corner of Lot 4, said Marg Terrace; thence South 000 17' West,

PRELIMINARY ENGINEER'S REPORT FOR
SW 79TH AVENUE STREET LIGHTING LID
In June 1988, the City Council received a petition requesting consideration of
formation of a local improvement district along SW 79th Avenue between Pfaffle
Street and Thorn Street for the purpose of providing street lighting. By
Resolution No. 88-56, the City Council authorized preparation of a preliminary
engineering report.
On Aug'�st 31, 1988, the City Engineer met with property owners of the
neighborhood and discussed the proposed street lighting LID. Owners of eight
of the 32 properties within the LID were represented at the meeting. Therc

The proposed LID would provide for installation of street lights on nine
existing wood poles along SW 79th Avenue. The lighting would be 100 watt,
9500 lumen, high pressure sodium luminaires. The pole locations are shown or.
attached Exhibit B and indicated by the large black dots. The street Lighting
would be installed by the Portland General Electric Company under PGE Option
