A RE:SOLUTY,;:d CALLING FOR A PUBLIC HEARING ON THE FINAL. PLANS AND SPLGLFICATIONs OF
,,,E DARTMOUTH STREET LOCAL IMPROVEMENT DISTRIcr.
WHEREF.R, on April 9, 1984, the Tigard City Council passed Ordinance No. 84-17,
establishing the Dartmouth Street Local Improvement District (LID k40); and
WHEREAS, in a writ of review proceeding against the L.ID the Oregon Court of Appeals
found no merit to the petitioners' challenges to the formation of the LID but did
rule that the assessment was defective because a portion of the planned improvement
was not located within the 1"a1 boundaries of the L.ID, and therefore set aside the
assessment as void and remanded the case fur further proceedings; and
WHEREAS, certain property owners within the LID requested the City to continue with
the LID as rapidly s possible, and other property owner's communicated conrer•ns to
the City regarding various aspects of the LID, and expressed a desire to participate
in a public hearing designed to solicit inquiries and comments regarding the LID; and
WHEpEfAS rmr r'A nn 055 tl—t when the City Council deems it in the best
interest of the public,,or when a material defect in the preliminary plans and
specifications of a local improvement district have been found, a public hearing on
the final plans and specifications may be called; and
WHEREAS, prior to determining whether to proceed with the hearing authorized by TMC
13.04.055 the City Council field a public hearing as requested by interested parties
on August 10, 1987; and
WHEREAS*, based upon the testimony presented to the City Council and the record
created at and subsequent to the public hearing, the City Couril has derided to
proceed to T—.0 with a public hearing on the final plans and
specifications rto determine whether it shall cure defects, or delete portions of the
plans which have been declared void or set aside for any reason, and whether it
shall make necessary additions to the preliminary engineer's report, so as to
proceed with the Dartmouth Street Local improvement District.
KK W, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The City Council will hold a public hearing pursuant to TMC 13.04.055 on
the 28th day of March, 1988, at the Tigard Civic Center, 13125 S.W. Hall
Blvd., Tigard, Oregon, at 7:30 P.M.
Section 2: Public notice of the hearing shall be given pursuant to TMC 13.04.055(b).
