A RESOLUTION ADOP-F1NG f71NDINGS AND CONCLUSIONS TO APPROVE: AN APPEAL. OF FINAL ORDER 87-12
PC AND TO AMEND 711F PLANNING COMMISSION DECISION OF ApPRO`JAI., OF SCE 87--02 (LOCKHART-
FORESS SIGN CO.-MICROAGE_COMFUTERti)•
( WHEREAS, the Micr*oage Computer company filed an appoal of the Planning Commission
decision on case SCE 87--02 on December 3, 1987 and this matter* came before the City
Council at its regular meeting of 1/11/88; and
WHEREAS, the City Council had befor-e it the Planning Commission final or-der', the
planning staff's report, the minutes and transcript of the Planning Commission hearing _
and documentation submitted by the applicant as part of the application; and
WHEREAS, the Planning Commission had approved a request` for a sign code exception (SCE
87-02) with modifications and subject to conditions at a public hearing held on 11/10/87.
NOW, THEREFORE, 8E IT RESOLVED by tFhe Tigard City ..ou--ci1 that:
Section 1: The proposal satisfied sign code exception criteria number (a)(2) given in
the Tigard Community Development Code Section 18.114. 145 which allows for an increase in
sign height: when it has been determined that site topography interferes with sign
visibility.
Section 2: The appellant had objected to the 87.5 square root maximum sign area per
sign face condition set by the Planning Commission based on the need to identify the
business to approaching motorists and an exception to the maximum allowable sign area
requirement has been determined appropriate given the unique identification needs and
visibility limitations along the freeway.
Section 3: Although the applicant erected the new sign prior to the Planning Commission
hearing, staff did not issue a summons and complaint Citation until after the Council
hearing had been held. The City Council will require the issuance of a sign permit- and
payment of the appropriate fee by 4:30 PM, February 8, 1988. Should the permit riot be.
obtained by that date and time, a civil infractions summons and complaint for violation
of Code section 18.114.110(d) will be assessed.
Section 4: The Council, ther-efor-e ORDERS that the above--referenced appeal be, APPROVED
and that the conditions set forth by the Planning Commission in Final Order 57-02 PC are
amended as follows:
1. The sign shall be no higher, than 32 feet in height with a maximum area of 114
square feet per sign face.
2. The applicant shall. obtain a City sign permit for the sign prior to 4:30 PM,
2/8/88.
3. The approval is valid for one year if exercised within one year of the final
decision date noted below.
