RESOLUTION NO. 87- f�
A RESOLUTION DECLARING THE INTENT TO FORM A LOCAL IMPROVEMENT DISTRICT TO
CONSTRUCT STREET IMPROVEMENTS ON SW 135TH AVENUE AND TO HOLD A PUBLIC HEARING,
AMENDING THE PRELIMINARY ENGINEER'S REPORT, AND DIRECTING THAT NOTICE OF THE
HEARING DE GIVEN.
WHEREAS, the City Council by Resolution No. 87-28 declared its intention to form
a local improvement district and to make street improvements on SW 135t1i Avenue
and on Murray Boulevard.
WHEREAS, by said Resolution No. 87-28 the Council also adopted an engineer's
report with certain amendments.
WHEREAS, a public hearing on the proposed local improvement district was held on
March 16, 1987, with continuations to March 23 and June 8, 1987.
WHEREAS, as a result of public testimony, the Council has determined that only a
portion of the proposed project should be constructed at this time and that the
district boundary should be revised.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
1. The City Council by this resolution declares its intention to make the
following street improvements on S.W. 135th Avenue between Scholls Ferry Road
and the north line of Tax Lot 101 of Washington County Tax Map No. 2S1 48:
roadway improvements, curbs, sidewalks, storm drainage, street lighting, and
associated improvements, along with transitions to existing roadways where
appropriate.
2. The City Council by this resolution declares its intention to form a loc.9l
improvement district with boundaries as described :in attached legal
description marked Exhibit A-
3. It is the intention of the City Council that the improvements be constructed
in accordance with the Preliminary Engineer's Report adopted by Resolution
No. 87-28 with amendments as follows:
(a) Said report is amended by deleting Section 11 (LSD Assessment Roll)
and inserting the attached Exhibit D as the Preliminary As—ssment
Roll.
(b) The Opinion of Probable Cost is amended by inserting the :.t t v;ht'd
Exhibit C.
(c) The report may be changed in the hearings and is hereby adopted
subject to amendments.

4. The total estimated cost for the proposed improvements, not including
right-o£-way acquisition costs, is $1,124,451.00. The benefitted properties
`. shall be assessed for all costs of design and construction on the basis of
traffic generation potential, as described in the preliminary engineer's
report, to arrive at a fair apportionment of the costs among the special'.y
benefitted properties. The traffic generation potential shall be based on
the zoning, in existence on the date that this resolution is adopted.
Existing valid preliminary plats,'approved by and binding on the City of
Tigard, shall be recognized in calculating the traffic generation potential.
5. Due to the potential future alternate access via proposed Murray Boulevard
extension, properties in the area described in attached Exhibit D are
considered to have a reduced benefit and shall be assessed at 50% of the
traffic generation potential of similar lots elsewhere in the district.
6. Sufficient right--o+:-way shall be acquired where necessary to meet the minimum
City standards f;,r collector streets (30 feet each aide of the centerline of
the new roadway). Any and all costs of right-of--way acquisition, including
legal and appraisal fees, shall be assessed on a front-footage basis, as
measured along the edge of the new right-of-way. The acquisition costs will
be assessed only against those properties along the new right-of-way which
did not dedicate all necessary right-of-way to the City at no cost.
7. It is the intention of the City Council to review, during the design process,
the advisability of raising the roadway above the 100-year flood elevation of
Summer Creek. Any costs associated with such raising of the roadway shall be
borne by the City.
8. The improvements shall be constructed by one or more contracts with award of
contracts based on competitive bid procedures.
9. A public hearing shall be held at Tigard City Hall, 13125 SW Hall Boulevard,
Tigard, Oregon, on the 31st day of August, 2987, at 7:30 P.M. , at which time
the City Council will hear objections or remonstrances to the proposed
improvement by any property owner within the proposed local improvement
district boundary.
10. At least ten days prior to the public hearing, the Community Development
Director is directed to give notice of the public hearing by publication and
by individual mailed notice to all owners of real property affected by the
proposed improvements.
11. All remonstrances shall be filed with the City Recorder by the close of the
initial hearing. Thereafter, no remonstrances shall be considered except as
otherwise provided by Ordinance No. 85-40.
