RESOLUTION NO. 89-C�
IN THE MATTER OF THE ADOPTION OF A FINAL ORDER UPON CITY COUNCIL REVIEW AND
MODIFICATIONS OF CONDITIONS APPROVAL (RESOLUTION NO. 86-75) FOR SUBDIVISION
(S7-86), PLANNED DEVELOPMENT (PD2-86), AND SENSITIVE LANDS PERMITS (SL4-86),
ADOPTING FINDINGS AND CONCLUSIONS OF LAW.
WHEREAS, this matter came before the City council at its meeting of June 16,
1986 and was continued to June 23, 1986 upon an appeal by the applicant for
review of the Pla,zening Commission's denial of the application request; and
WHEREAS, the Council reversed the Planning Commission decision on July 14,
1986 and approved the application subject to conditions (Resolution
No. 86-75), and
WHEREAS, at the request of the applicant, the Council reviewed the conditions
of approval pertaining to SW 108th Avenue at a public hearing on November 24,
1986 and approved amendments to Conditions 2 and 8 of Resolution No. 86-75, and
WHEREAS, based on the record in this case, the City Council makes the
following findings of fact:
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: Conditions 2 and 8 of Resolution No. 86-75 shall be revised to
•` read as follows:
2. Standard full and half-street improvements including
sidewalks, curbs, streetlights, driveway aprons,
storm drainage and utilities shall be installed along
the SW 108th Avenue frontage. Said improvements
along SW 80th Avenue shall be built to not less than
City minor collector street standards north of the
Kent Drive (Riverwood Lane) and conform to alignment
of the intersection. Local street standards shall
apply to the southern remainder of SW 108th Avenue.
8. Additional right-of-way shall be dedicated to the
Public along the SW 108th Avenue frontage to increase
the right-of-way to 30 feet from centerline north of
the Kent Drive (Riverwood Lane) intersection and 25
feet from centerline south of this intersection. The
description for said dedication shall be tied to the
existing right-of-way centerline as established by
Washington County. The dedication document shall be
on City forms, and approved by the Engineering
Section, or shall be detailed on the plat.
Section 2: All other conditions of approval for Resolution No. 86-75 shall
romain in effect.

The Council further orders that the City Recorder send a copy of t,:e final
order as a notice of decision in the matter.
