RESOLUTION NO. 86—
A RESOLUTION APPROVING AND REFERRING AN AMENDMENT" TO THE CHARTER OF TIGARD TO
THE QUALIFIED VOTERS OF THE CITY OF TIGARD FOR T14EIR APPROVAL OR REJECTION AT
AN ELECTION HELD AT THE SAME TIME AND PLACES AS THE NOVEMBER 4, 1986 STATEWIDE I
FLECTION: CALLING THAT ELECTION: AND DIRECTING THE CITY RECORDER TO DO ALL
ACTS NECESSARY AND CONVENIENT TO CARRY OUT SUCH ELECTION.
WHEREAS, this matter came before the Tigard City Council at its August 25,
1986, meeting. The Council and its staff have reviewed the Tigard City
Charter, originally adopted by the voters of Tigard on November 6, 1962, and
as amended, and find that the Charter is in need of periodic revision to
improve the government of Tigard and to meet the needs of its citizens. At
its meeting of August 11, 198b, the Council reviewed the Charter and
authorized its staff- to prepare an amendment, which are now before the Council
for final action.
WHEREAS, the Council is of the view that the proposed amendment would improve
the effectiveness of the Charter and should be voted upon by the qualified
voters of the City at the November 4, 1986 Election.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The proposed Charter ame Zdment, attached hereto as Exhibit "A,"
S and by this reference made a part hereof be, and the same is hereby, approved
by this Council and referred to the qualified voters of the City of Tigard for
their approval or rejection at the November 41 1986 Election and that the
propositions set forth in Exhibit "A" shall be on file at the office of the
City Recorder for public inspection.
Section2: A special election is hereby called to be held in the City of
Tigard on November 4, 1986, between the hours of 8:00 a.m. and 8:00 p.m.,
pacific Standard Time at the polling places designated in Exhibit: "B,"
attached hereto and by this reference made a part hereof, and being the same
place designated for the holding of the statewide election, for the purpose of
submitting to the qualified voters of the City of Tigard an amendment set
forth in Exhibit "A" for their approval or rejection.
Section 3: The ballot title, question and explanation, as set forth in
Exhibit "C," attached hereto and by this reference made a part hereof, be, and
the same is hereby, approved with respect to the measure, for which purpose
the ballot title, number and form in which the question shall be printed upon
the official ballot is thereby prescribed.
Section 4: The City Recorder is hereby authorized and directed to certify in
the manner provided by law to the Elections officer of Washington County,
Oregon, the foregoing measure for inclusion as a part of the regular ballots
to be prepared by such Officer for voting at all precincts within the City of
Tigard, as set forth in Exhibit "B," at the aforesaid special el.ection in
conjunction with the November 4, 1985 Election.

Section 5: The City Recorder shall conduct the aforesaid special election in
conjunction with the Elections Officer of Washington County, in accordance
with the election laws of the Sate of Oregon.
Section 6: The City Recorder be, and she hereby is, authorized and directed
to undertake 6,11 necessary and convenient acts to facilitate the inclusion of
the measure on the November 4, 1986 Election ballot for the approval or
rejection of the qualified voters of the City of Tigard and is further
authorized and directed to give notice of the above described election and
proposal by punishing in the Tigard Times said publication to be not less
t;,an ten (10) days prior, to the date of the aforesaid Election. The form of
such notice shall be substantially as set forth in Exhibit "D," attached
hereto and by this reference made a part hereof.

PROPOSED AMENDMENT TO THE CHARTER OF
TIGARD, OREGON
REFERRED TO THE QUALIFIED VOTERS OF TIGARD
BY T E TIGARD CITY COUNCIL TO BE VOTED UPON
AT 'THE NOVEMBER 4, 1986 ELECTION
Note — Material in brackets [] would be deleted from the Tigard City Charter
if the measure were approved and material underlined would be added if
such measure were approved.
Measure No. 51.
Section 7 of the Tigard City Charter is amended to read:
Section 7. MAYOR AND COUNCIL. The elective officers of the city shall be a
mayor and four councilors who together shall constitute the City Council.
Except for mayor and councilors holding office on the effective date of the
1982 Charter Amendment, and holding office continuously since. The mayor
shall be elected at each general election and hold office f-or a period of two
years. No councilor shall serve the city as councilor for more than eight
consecutive years, nor shall the mayor serve as mayor for mere than four
consecutive years. In no case shall any person serve on the City Council for
more thorn 12 consecutive ys ars. These limitatior;s do not aop.:y to the filling
of an unexpired term.
No person who is serving as mayor or councilor shall become a candidate for
any city office for a i.erm which would be concurrent with the term in office
then held unless that person first submits a written resignation from the then
current office at the time of filing for the other office. A resignation
submitted for the purpose of satisfying the provisions of this section shall
recite that it is given for the purpose of permitting its signer to be a
candidate for office. A resignation submitted to satisfy this section shall
riot be withdrawn. A resignation shall be adequate for purposes of this
section if it provides for the termination of the signer's service in the
office not later than the last day before service would begin in the office
for which that person seeks to become a candidate.
In the event the office of mayor or councilor becomes vacant before the normal
expiration of its term, 4 special election shall be held at he nextavailable
date to fill the officefor the unexpired term. Such an election shall be
held in accordance with the election laws of the State of Oregon and city
ordinances not inconsistent with such elections laws. The Council shall
appoint a person to fill the vacancy until an election can be held. Any
person appointed to fill a vacancy shall not be a candidate for election to
that position at the vacancy—filling election.
