IN THE MATTER OF THE ADOPTION OF A FINAL ORDER UPON CITY COUNCIL REVIEW OF A
PLANNING DIRECTOR'S APPROVAL OF A SITE DESIGN REVIEW REQUEST (SDR 6-86) AND A
VARIANCE REQUEST (V 5-86) ADOPTING FINDINGS AND CONCLUSIONS OF LAW.
WHEREAS, this matter came before the City Council at its meeting of April 28,
1986 upon the request of Council for review of the Planning Director's
approval of the application request; and
WHEREAS, the City Council had before it the Director's approval and
documentation provided by the applicant as part of the application; and
WHEREAS, the applicable criteria in t ,Is decision are the following:

WHEREAS, based on the record in this case the City Council makes the following
findinas of fact:
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The subject site is located on the northwest corner of Pacific
Highway and Greenburg Road (WCTM 2S1 2AA Lots 1000, 1001, and
1100) within the Corporate limits of Tigard, Oregon.
Section 2: The subject property consists of three tax lots which contain a
commercial building and a single family residence.
Section 3: The Property is zoned C-G (Commercial General).
Section 4: The applicant requested site design review approval to develop a
6,800 sq. ft, retail/auto service building and an automatic car
wash. In addition, the applicant requested a variance for
deletion of a portion of public sidewalk along SW Center Street
and to allow a landscape area of 13.5% where 15% is required.
Section 5: Section 18.120.020 requires Site Development Review approval for
all new developments.
Section 6: Section 18.62.050 (6) requires a minimum of 15% landscaping in the
General Commercial (C-G) zone.

The City Council also makes the following conclusions of law:
(1) The City Council concludes that the applicants proposal
conforms to the applicable criteria contained in the Tigard
Municipal Code.

(3) The City Council concludes that a non-remonstrance agreement
for the sidewalk on Center Street shall be required. The language

The City Council, therefore, orders that the above referenced determination
be, and same hereby is, approved.
The Council further orders that the City Recorder send a copy of the final
order as a notice of final decision in this matter.

99W (Pacific Hwy.) at SW Greenburg Road

This memorandum summarizes the series of events which lad to the issuance
of the access permit for the subject development. The civil engineer, Tal
Barghausen, met with me to discuss concerns of the site related to traffic
circulation and operations of Highway 99W/Greenburg Rd. intersection. Thr--
major
hemajor issues were the allowances of left turns frau Pacific IIwy. onto the
site, provision of a channelization island to protect the traffic signal
span pole at the northwEst corner of the Greenburg intersection and capacity
analysis of the intersection.
As requested, the developer submitted a Traffic Impact Report which met the
requirements for proposed developments along state highway facilities. The
report was reviewed by our Traffic Engineer and ha-1 the following concerns
with the submitted site plan design:
1. Ability to make left turns from the site onto Pacific Hwy.
2. No clear sight line from the car wash to the Center St. exit.
3. Design of the right turn in only driveway on Greenburg Rd.
A meeting was held on March 28, 1986 to discuss site plan rnodifications to
solve our concerns. The developer, the car w:sh operators, civil and traffic
engineering consultants, City of Tigard staff and our staff were in attendance.
Through discussion and concensus of the participants, the Pacific Hwy. driveway
was modified to restrict left turns from the site onto Pacific Highway by the
adding of a raised concrete channelization island. The design of the island
does allow left turn movements form Pacific Highway into the site. The allow-
ance for these left turn movements at the driveway eliminates left turn move-
menst at both the Hwy. 99W/Greenberg and the Greenburg/Center intersections.
The existing left turn storage bay and taper area is large enough to provide
refuge for movements into the site.
With the elimination of the left turn movement out of the site at the Pacific
Highway driveway it becomes essential that motorists wanting to go eastbound
on Pacific Highway are aware of the Center Street exit. The developer agreed
to place, install and maintain signs at the exit of the car wash to direct
traffic to the Center Street exit. Maintenarce, of the directional signs is
critical to the safe operations at the site driveways.
The Greenburg Road right turn in only driveway is desired. It would relieve
( the Pacific Highway intersection of some vehicles. However, it must be designed
to discourage illegal left turns from Greenburg Road into tine site. The drive-
way design was modified by increasing the skew angle and radius of the approach

curb, moving the sidewalk back from the curb to allow for low landscaping to
block the opening from sight of the northbound Greenburg motorists.
The site plans were modified according to the concensus of the meeting and
submitted for review to my office. The revised site plans met with our
approval and the Pacific Highway access peen-it for the development was issued
on April 14, 1986.
