A RESOLUTION DECLARING THE INTENT _1-0 FORM A LOCAL IMPROVEMENT DISTRICT" TO
CONSTRUCT SANITARY SEWER IMPROVEMENTS IN THE AREA OF TOOTH AND I:NEZ AND TO
HOLD A PUBLIC HEARING, ADOPTING THE PRELIMINARY ENGINEERING REPORT AND
DIRECTING THAT NOTICE OF THE HEARING BE GIVEN.
WHEREAS; the City Council by Resolution No. 85-97 directed that a Preliminary
Engineering Report be prepared for the construction of Sanitary Sewer,
Improvements, in an area generally described as SW 100th and Inez.
WHEREAS; the Preliminary Engineering Report has been completed and submitted
to the Council together with a report From the Community Development Director
which finds the proposed project to be feasible, and recommends this project
be given first priority, pursuant to Council policy as set forth in Resolution
No. 8.5-57. Based on the Director's findings, the Director recommends the
district be formed and the improvements be made.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council. that:
1. The City council by this resolutio: declares its intention to make the
following improvements: Sanitary Sewer Facilities. The improvements will be
located in the area described in the attached Exhibit "A".
2. The City Council by this resolution declares its intention to form a local
improvement district and to assess the benefitted owners for the total cost of
the improvement.
3. It is the intention of the City Council that the improvements be
constructed in accordance with the plans and specifications contained within
the Preliminary Engineering report and entitled Preliminary Engineer's Report
on the 100th and Inez Sawer Local Improvement District, which may be changed
in the hearings and construction process and which are hereby adopted, subject
to amendments, a copy of said report is attached marked Exhibit "B".
4. 'The total. estimated cost is $ .180,76 for the proposed improvements and the
beneritted properties shall be assessed on an area basis to arrive at a fair
apportionment of the costs among the specially benefitted properties.
5. The improvement shall be constructed by competitive bid to the lowest
responsible bidder in accordance with the plans and specifications adopted as
part of this resolution and entitled, Preliminary Engineer's Report on the
100th and Inez Sewer Local Improvement District.
6. A public hearing shall be held at Fowler Junior High Schcol at 10865 SW
Walnut, Tigard, Oregon, on the 28th day of April, 1986 at 7:00 P.M. At this
time the City Council will hear objections or remonstrances to the proposed
improvement by any property owner within the proposed local improvement
district boundary.

PRELIMINARY ENGINEERS REPORT
ON THE
100TH AND INEZ SEWER L.I.D.
This Preliminary Engineers Report is submitted for considera-
tion by the Tigard City Council in conformance with Section 5.B.1.
of Ordinance No. 85-40.
BACKGROUND
On June 24, 1985 the Tigard City Council directed staff to
investigate interest in sanitary sewer service via the L.I.D.
process. Subsequently, an informal neighborhood meeting was held.
A majority of the twenty people in attendance expressed support for
proceeding with a Preliminary Engineers Report.
A Preliminary Evaluation Report was prepared by the Interim
City Engineer and submitted for Council consideration on November
25, 1985. The Council accepted the Preliminary Evaluation Report
and by Resolution directed City staff to prepare a Preliminary
Engineers Report. The City of Tigard retained R.A. Wright
Engineering, Inc. to prepare the Preliminary Evaluation Report.
R.A. Wright Engineering, Inc. prepared one preliminary sewer
layout consistent with that suggested in the Preliminary Evaluation
Report and another sewer layout, designated Design 2, that added a
sewer along the north end of 100th Avenue. Both designs were
described to owners of properties affected by one or both of the
sewer designs at a meeting on March 13, 1986. Of the twelve
properties that would be served if Design 2 is selected the owners
of five properties expressed opposition to the plan and none of the
owners of the twelve properties expressed support. Design 2 was
presented as having a unit assessment approximately 17 percent
below Design 1 and was, therefore, generally preferred by owners of
property served by both designs. As a result of the opposition
erpresseca by owners of property along the north end of 100th Avenue
consideration of Design 2 was ended. The design considered in this
report is the same as that described in the Preliminary Evaluation
Report.

SCOPE OF WORK
The existing sanitary sewer connection that can best serve the
area of S.W. 100th Avenue and Inez Street is located at the
intersection of 100th Avenue and Pembrook Street. Sewers can be
constructed north along 100th Avenue and along Inez Street, View
Terrace, and 103rd Avenue as shown on the attached EXHIBIT A,
PROJECT PLAN.
Support for sanitary sewers appears to be most concentrated on
View Terrace. This is a cul-de-sac that enters 103rd Avenue from
the east. In order to serve the cul-de-sac a sewer will have to be
constructed from 100th Avenue across about 400 feet of private
property east of the View Terrace cul-de-sac.
View Terrace and adjacent properties drain to the north. In
order to connect this area to the existing sewer at 100th Avenue
and Pembrook Street a deep sewer will have to be constructed along
100th Avenue and the sewer on View Terrace will have to be shallow.
This shallow sewer on View Terrace will mean that the daylight
basements of the residences on the north side of View Terrace will
be too deep for gravity sewer service and will have to be pumped
into the proposed sewer.
The existing sewer on Pembrook Street is not deep enough to
serve the proposed sewer on 100th Avenue. This deficiency can be
corrected by reconstructing approximately 70 feet of the existing
sewer as shown on EXHIBIT A, PROJECT PLAN.
The proposed project will include construction of the sanitary
sewers shown in EXHIBIT A, PROJECT PLAN including manholes,
building sewers, and surface restoration. A building sewer will be
constructed to within 5 feet of the property line of each property
,.ncluded in the proposed L.Y.D.
PROPOSED DISTRICT BOUNDARIES
The boundaries of the proposed 100th and Inez Local Improvement
District are shown on EXHIBIT A, PROJECT PLAN and are described in
EXHIBIT B, BOUNDARY DESCRIPTION FOR 100TH AND INEZ SEWER LOCAL
IMPROVEMENT DISTRICT.

An estimate of the probable cost of the sanitary sewer system
described in SCOPE OF WORK is as follows:

FINANCIAL INFORMATION
Method of Assessment. This report recommends that the project
costs be divided among benefited properties within the limits of
the proposed L.I.D. in proportion to the area of land within 150
feet of a property line to which sanitary sewer service is provided
by the proposed sewer improvements.
Rate of Assessment. The area of land within 150 feet of a
Property line or easement line to which sanitary sewer service is
provided is estimated to be 580,250 square feet. The estimated
cost of the project is $180,760. The unit assessment rate required
$0 raise $square0 from an assessable area of 580,250 square feet is
$0.31 per square foot.
Outstandinq Assessments. There are no outstanding City of
Tigard assessments against properties to be included in the
proposed L.I.D.
Benefited Pro erties. For each benefited property the tax
account num er (Co umn 1), names of the owners of record
2), and the estimated assessment (Column

In addition to the total assessmentforproperty,1Table aA1 also
shows the assessment area (Column 4) and assessed value of land and
improvements (Column 3). Table A, shows the percent that each
Parcel bears of the total project cost (Column 6) . Column 7 of
Table A shows the relationship of the sewer assessment (Column 5)
to the assessed value (Column 3) of the property. For the entire
district the total net cost is 9 percent of assessed value.

It is a recommendation of this report that the Council adopt a
Resolution of Intention to form the 100th and Inez Sewer Local
Improvement District in conformance with this
